Applicant: Chad Goelzer. Notice is hereby given that Chad Goelzer, applicant for the above referenced Shoreline Substantial Development Permit,has been granted approval for the project. The Decision was dated December 5, 2011 and approves the permit by the Hearing Examiner. The request for the Substantial Development Permit was approved pursuant to the Mason County Development Regulations specifically for an accessory dwelling unit. PLAr NING DEPT, 2 Phil Olbrechts, Hearing Examiner 3 RE: Chad and Teresa Goelzer 4 5 Shoreline Substantial FINDINGS OF FACT, CONCLUSIONS Development Permit OF LAW AND FINAL DECISION 6 #SHR2011-00014 7 8 INTRODUCTION 9 The Applicants have applied for a shoreline substantial development permit for an accessory living dwelling unit ("ADU", also referenced as an accessory living 10 quarter, "ALQ"). The Examiner approves the application with conditions. 11 ORAL TESTIMONY 12 13 Grace Miller, senior planner for Mason County, was the only person present at the hearing. In response to questions from the Examiner, Ms. Grace was not aware of 14 any judicial action filed claiming the access rights asserted in Exhibit 5. 15 16 EXHIBITS 17 All exhibits entered identified in the "Exhibits" list of the 11/10/11 staff report are admitted into the record. 18 FINDINGS OF FACT 19 Procedural: 20 1. Applicant. The applicants are Chad and Teresa Goelzer. 21 22 2. Hearing. The Hearing Examiner conducted a hearing on the application on November 22, 2011, at 1:00 p.m., in the Mason County Board of Commissioners 23 Meeting Chambers. 24 Substantive: 25 3. Site/Proposal Description. The Applicants propose to build a 700 square foot garage with an upstairs accessory living quarter. The applicant will build a primary residence waterward of the ADU in the future. A private septic system that Shoreline ADU P. 1' Findings, Conclusions and Decision {PA0828887.DOC;1\13009.900000\} will serve both the primary residence and the ADU has been approved by the Mason 1 County Environmental Health Department. The two dwelling units will also be 2 served by a public water system managed by the Shorecrest subdivision. Staff has verified that the proposal meets shoreline, side yard and front yard setbacks. The 3 staff report notes that the ADU will be less than 80% of the size of the proposed primary residence. 4 4. Characteristics of the Area. The subject lot is located on the 5 Hammersley Inlet in the Shorecrest subdivision. The vicinity is a fully developed 6 residential subdivision with heavy vegetation buffering it from adjoining uses (see Ex. 6). 7 5. Adverse Impacts of Proposed Use. No adverse impacts are discernable 8 from the record. The staff report notes that there do not appear to be any impacts to surrounding properties due to view blockage, traffic, parking or drainage. The ADU 9 is proposed 81 feet from the ordinary high water mark as shown in Ex. 3, which 10 doesn't appear to conflict with adjoining views as shown by the location of existing adjoining homes in Ex. 6. The staff report notes that adjoining homes are waterward 11 of the proposed ADU. The heavy vegetation of the area and the location of the ADU on a detached garage will eliminate any aesthetic impacts. A neighboring property 12 owner in Ex. 5 claims that the proposed ADU location is on top of an undeveloped right of way necessary to access his property. As discussed in Ex. 6, County staff 13 have done a title search and have not found any public right of way in the location of 14 the ADU. This is confirmed by the plat and assessor records submitted by staff, Ex. 6 and 7. Even the plat and assessor documents provided by the neighbor in Ex. 5 don't 15 show any right of way on the subject lot. The neighbor has provided no evidence of any right of way encroachment. 16 17 CONCLUSIONS OF LAW 18 Procedural: 19 1. Authority of Hearing Examiner. MCC 15.03.050(J) provides the 20 Examiner with the authority to review and act upon shoreline substantial development permit applications. 21 Substantive: 22 23 2. Zoning and Shoreline Master Program Designation. The area is zoned as Rural Residential 5 or RR-5. The Shoreline Master Program environmental 24 designation is Urban. 25 3. Review Criteria and Application. MCC 17.03.029 governs ADUs in lands zoned Rural in Title 17 MMC. Under MCC 17.03.029, ADUs in rural lands shall be subject to a special use permit unless they are located in the shoreline jurisdiction, in Shoreline ADU p. 2 Findings, Conclusions and Decision {PA0828887.DOC;1\13009.900000\} which case they are subject to a shoreline permit. The proposed ADU is within 200 1 feet of the shoreline of Hammersley Inlet, and therefore, shall be subject to a 2 shoreline substantial development permit requirements. The review criteria for a Shoreline Substantial Development Permit application are governed by MMC 3 15.09.0500 and 15.09.050(f)(1), which requires compliance with Mason County's Shoreline Master Program (comprised of Chapter IX of the County's comprehensive 4 plan and Chapter 17.50 MMC), the SMA and Chapter 173-27 WAC. These policies and regulations, to the extent applicable, are quoted below and applied by 5 corresponding Conclusions of Law: 6 MASON COUNTY COMPREHENSIVE PLAN, Chapter IX: Accessory Living 7 Quarters. Accessory living quarters for the use of the guests, employees, or immediate family members should be allowed as a substantial development when 8 minimal impact would occur to surrounding areas. The cumulative impact of like 9 structures on neighboring properties must be considered. 10 4. As conditioned, the Applicants will only be allowed to use the ADU for guests, employees or immediate family members. As discussed in the findings of 11 fact, there are no adverse impacts associated with the proposal and the increase in density caused by the project is insignificant even if considered from a cumulative 12 standpoint given the large lots of the vicinity and the relatively small number of 13 ADUs that are constructed in Mason County. 14 MCC 17.50.060 - Use regulations for accessory living quarters. Accessory living quarters are defined in this chapter as separate living quarters attached or detached 15 from the primary residence which contains less habitable area than the primary residence. They are subject to the following criteria: (1) Only one accessory living 16 quarter per lot. (2) Strict compliance with current sewage setback and design 17 standards as per WAC 248-76-090. (3) Minimal impact on surrounding properties from view blockage, traffic, parking and drainage. (4) Compliance with setback 18 criteria. (5) Accessory living quarters shall require a substantial development permit and shall not exceed 1,000 square feet. 19 5. The proposal will result in no more than one ADU on the subject lot. 20 The staff report states that the project has been approved for septic use by Mason 21 County Environmental Health. Compliance with sewer regulations is also made a condition of approval. According to staff, the proposal provides minimal impacts on 22 surrounding properties from view blockage, traffic, parking and drainage and the proposal complies with all applicable setbacks. The proposed ADU is less than 1,000 23 square feet. All of the criteria above are satisfied. 24 As to traffic impacts, as discussed in the Findings of Fact there are assertions that the 25 proposed ADU will be located on undeveloped right of way, but there is nothing to support this position and property records strongly suggest otherwise. The Examiner has no authority to adjudicate property interests outside the land use process such as Shoreline ADU p. 3 Findings, Conclusions and Decision {PA0828887.DOC;1\13009.900000\} right of way boundaries. See Halverson v. Bellevue, 41 Wn. App. 457 (1985). Since I there does not appear to be any reasonable potential for a conflict with public right of 2 way and no judicial action has been filed on the issue,there is no reasonable basis for deferring approval until access issues are resolved in superior court, the proper forum 3 for adjudicating right of way boundaries. If the Quarantas believe that the proposal will interfere with access rights to their property via public right of way, they are 4 encouraged to speak to a private attorney about seeking injunctive relief in superior 5 court, the proper forum for adjudicating access rights. 6 MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW 7 MCC 15.09.050(C): Required Review: The Hearing Examiner shall review proposed development according to the following criteria: 8 1. The development does not conflict with the Comprehensive Plan and meets 9 the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 10 2. Development does not impact the public health, safety and welfare and is 11 in the public interest. 12 3. Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the 13 Comprehensive Plan. 14 MCC 15.09.055(C): 15 6. The most directly applicable provisions of the Mason County 16 Comprehensive Plan are its shoreline policies. As determined above, the proposal is consistent with the shoreline policies and there is nothing to suggest any 17 inconsistencies with any other policies. The staff report concludes that the proposal 18 will not violate adopted level of service standards for park and traffic facilities and there is nothing in the record to suggest otherwise for this relatively minor project. 19 The project is SEPA exempt per WAC 917-11-800(1)(b)(i). The project is conditioned to comply with Title 6 sewer regulations. Title 16 is inapplicable since 20 no division of land is involved. The only other directly applicable code provision is 21 MCC 17.03.029, with which it complies as more directly discussed below. As discussed in the findings of fact, as conditioned the project does not create any 22 significant adverse impacts. Consequently, the project does not impact the public health, safety and welfare. The criterion quoted above is met. 23 MCC 17.03.029 Accessory dwelling unit requirement. 24 25 In rural lands, accessory dwelling units (ADU) must meet the following requirements: Shoreline ADU p. 4 Findings, Conclusions and Decision {PA0828887.DOC;1\13009.900000\} 1. The ADU shall be subject to a special use permit, unless in the shoreline I jurisdiction, it is subject to a shoreline permit; 2 2. The owner of the ADU must reside on the lot in either the principal 3 residence or ADU; 4 3. The ADU shall be located within one hundred fifty feet of the principal residence or shall be a conversion of an existing detached structure (i.e. garage); 5 6 4. The ADU shall not exceed eighty percent of the square footage of the habitable area of the primary residence or one thousand feet, whichever is smaller; 7 S. All setback requirements must be met by the ADU,- 8 6. All applicable health district standards for water and sewer must be met 9 by the ADU; 10 7. No recreational vehicles shall be allowed as ADU; 11 8. Only one ADU is allowed on any property; 12 13 9. An additional off-street parking space must be provided for the ADU. 14 7. The project, as conditioned, is consistent with MCC 17.03.029. The application is for a shoreline permit because it is located within 200 feet of 15 Hammersley Inlet. As conditioned, the owner will reside in the primary residences. The ADU will be located within 150 feet of the future principal residence, as depicted 16 in Ex. 3. The ADU will be 700 square feet in area. The ADU, as conditioned and as determined in the Findings of Fact, will meet all setback requirements and all 17 applicable health standards for water and sewer. There will be one ADU on the 18 property. The staff report notes that the ADU will be less than 80% in area of the principal residence, but the size of the principal residence is not identified in the 19 record. Consequently, the 80% limitation will be made a condition of approval. The proposal will be conditioned to provide for an additional parking stall. 20 21 DECISION 22 The Hearing Examiner approves the requested Substantial Shoreline Development Permit with the conditions recommended in the staff report with the following 23 additional conditions: 24 25 1 MCC 17.03.029(2) allows the owner to live in the primary residence or the ADU, however the comprehensive plan policy quoted above require the guests, etc. to live in the ADU. The only way to reconcile these two provisions is to require the owners to live in the primary residence. Shoreline ADU p. 5 Findings, Conclusions and Decision {PA0828887.DOC;1\13009.900000\} 1. PROPOSAL: The proposal is to construct a new 700 square foot garage with an upstairs accessory living quarter.The applicant will construct a primary residence in the future. A. Characteristics of the site and area: The property is currently vacant.The garage is proposed to be located 81'from the OHWM of the shoreline.The future residence will be located closer to the water,with a minimum 35' shoreline setback.The property's shoreline view is south across Hammersley Inlet.There are adjacent residences located closer to the shoreline. B. Shoreline designation:The shoreline designation of the site is Urban Residential. C. Zoning: The zoning is Rural Residential 5. D. SEPA Compliance:The project is SEPA exempt under WAC 197-11-800(b)(i). E. Other Permits:A Mason County Building Permit with Environmental Health approval for the septic system. V. ANALYSIS: The Accessory Living Quarters section of the Mason County Comprehensive Plan Shoreline Management Program and the Use Regulations Section 17.05.060 of Chapter 17.50 Mason County Shoreline Master Program Use Regulations guide in the review of this proposal.Accessory living quarters are defined as"separate living quarters,attached or detached from the primary residence which contain less habitable area than the primary residence."The applicable policies and use regulations follow: 1 H:\sdpstaffadu7.doc POLICY: Accessory living quarters for the use of guests,employees or immediate family members should be allowed as a Substantial Development when minimal impact would occur to the surrounding area.The cumulative impact of like structures on neighboring properties must be considered. Compliance with setback criteria set forth in Table. 5. Accessory living quarters shall require a Substantial Development Permit and shall not exceed 1,000 square feet. This is the only accessory living quarter proposed for the lot.The primary residence and proposed accessory living quarter will be served by a private septic system on the property.The water will be provided by the public water system,managed by the Shorecrest subdivision.Both have been approved for use by the Environmental Health Department. There do not appear to be any impacts to surrounding properties for view blockage,traffic,parking or drainage.The structure meets the shoreline,side yard and frontyard setbacks. The adjacent property owner to the east submitted a letter requesting further review of the proposed location of the garage/ADU in relation to an easement road.Upon further investigation by the Planning and Public Works Departments,no evidence that the alleged easement exists in the records for the parcels.On 10/27/11 Planning staff requested evidence from the neighbor that this easement exists.To date,the Planning Department has not received a response.Please see attached Exhibits 5,6 and 7. The structure meets the size limitation because it will be 700 square feet of living area and up to 1,000 sf is permitted.It is also less than 80%of the size of the new structure.The proposed structure will be built within a platted subdivision. IV. CONCLUSION. The Hearing Examiner shall review proposed development according to the following criteria: (1) The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code,especially Title 6, 8 and 16. (2) Development does not impact the public health,safety and welfare and is in the public interest. (3) Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. Staff has verified that the proposed development does in fact comply with the Mason County Code, including Title 6,8 and 16.The project is not subject to Title 16 which only governs subdivisions.The project will not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan.The project will also have no adverse impact upon health,safety and welfare. 2 H:\sdpstaffadu7.doc One public comment letter regarding the proposal was received,to date,and is attached as Exhibit 5.Based upon the policies and regulations,the project is consistent with the Mason County Shoreline Master Program Residential Development Accessory Dwelling Unit requirements. These setbacks are measured from structures or projections above grade,such as roof overhangs or gutters,balconies,stairs,decks,fuel tanks,storage buildings,or heat pumps. An administrative variance may be requested to reduce these setback distances from property lines,to as low as 5 feet(side yard)or 10 feet(front yard),if the size,shape,or features of the property constrain development from the proper setbacks at the time of building permit submittal. Resource Ordinance-Slope areas: There is a general slope from north to south from the county road that does not exceed 15 percent associated with the low natural topography adjacent to the Hammersley Inlet. Replanting with the use of native plants such as huckleberry,salal,ocean spray,rhododendron,and sword ferns is preferred in the effort to replace plants proposed in your site plan for the new residence. This setback determination may change if the adjacent property owners to the north and south submit applications and are granted permits for new or remodeled residences established at proper shoreline setbacks.
