LETTER OF HARDSHIP
When requesting a variance to Section 14.08.180 of the amended Mason County
Building Code, the applicant must submit a letter indicating why it is necessary to
encroach into the five (5) foot setback established by the code.
A hardship must be demonstrated (i.e. constraints of citing a structure because of
topography, location of septic, location of accesses or other physical features, or what
the use of the structure is and why the size is such that it will be encroaching.)
The purpose of the ordinance is to maintain a ten (10) foot separation between
structures for fire protection and access.
When requesting a neighbor to agree to the infringement of the five (5) foot setback,
the neighbor is agreeing that any structure that is proposed on his/her property must
set back farther than five (5) feet in order to maintain a ten (10) foot separation.
When requesting a variance from an EASEMENT, only the owner is required to sign
the setback form provided indicating he/she is taking the responsibility of the structure
near an easement.
In no case will a variance be granted to place a structure within an easement.

Retirement age couple is requesting Right-of-way and Sideline variances to
allow the building of a residence with all components on a single level as
much as possible. Elimination of stairs and ramps for ease of wheelchair
and handicapped access as well as the simplifying of the activities of daily
living. Our building site is limited by size, topographical, environmental-
policy, and highway sight and access constraints.
Obtaining sideline and right-of-way setback variances for house and garage
location would reduce access and construction problems as well as
substantially limit costs. Also moving the house and garage closer to the
highway will move them up grade, and therefore above the winter, high-
tide water table levels. This would also minimize the annual problem of
washed-up logs, and debris hitting the house. The cost reductions would be
derived from reduced quantities of foundation, pavement and backfill.
Highway access and visibility would be enhanced to improve safety.
The adjacent parcel to the west is unbuildable according to the Mason
County Planning Department, therefore no harm will happen to that
property. That parcel is owned by our family and enhanced joint family use
for recreation and watersports would also be obtained by placing the
garage closer to the right of way. It would just make a nicer yard. Even
with the garage placed in that location it would still be over 18' away from
the fog line.
An additional benefit of placing the garage closer to the right of way would
be moving it out of the line of view to the West.

the closest projection and ten(10)feet from any county and state road right-of-way. Any proposed structure within
twenty-five(25)feet of a county road rlght-of-way shall be subject to Public Works review and comment.
A variance may be granted to said line If a hardship can be demonstrated and the Mason County Public Works
Department has no objections. This document must be recorded with the Auditor of Mason County.
