Dear MS_ Bennett-Cumming: As requested on page two of your 3/18/03 letter, Martig Engineering is submitting the SEPA Checklist for the "EXISTING ROCK BULKHEAD". Mr. Vermillion has taken out the requested Building Permit (#ENF 2002-00326). Mr. Lee Boad is submitting the requested revision to the Habitat Management Plan, under separate cover. Additionally, we are restating the Variance Application Amendment originally requested within our February 25, 2003 Letter Report. Our Amendment now requests that the existing 6-foot high Cedar-Fence and the proposed two canvas-type portable storage shelters, locations being on this parcel south of the Highway, be added to our Variance Application. Attachment "A" shows the locations and setback dimensions. V The reason for altering our Variance Amendment is two-fold: 1. The portions of the Cedar-Fence higher than 6-feet have been cut-off such that their height is now only 6-feet. The fence length and location remains the same. 2. The previous rented metal storage container has been removed from the property. Two 10 x 20 foot Canvas-Type portable storage shelters are intended to replace the removed unit and be located as shown on Attachment "A" with this letter. BULKHEAD PERMIT DISCUSSION The history of the placement of the existing rock bulkhead is presented within the Martig Engineering February 25, 2003 Letter Report, which includes Photographs of it and its location on the Expanded Site Plan, Attachment "B". Existing Rock-Bulkhead fill will be removed. Attachment "B" to this letter is a revision of the 2/25/03 Report one. It shows that 38% of the existing rock bulkhead Bank- Hardening fill will be removed, the easterly 15 feet of the 40-foot long bulkhead. The portion to be removed is that section shown between Points A & B on Attachments "B" & "C" to this letter. All of the existing rock bulkhead east of Point "X" is above the Hood Canal natural vegetation line elevation. However, even before the rock bulkhead was installed, concentrated wave energy tore out any remaining natural vegetation west of"X". The older existing Concrete Bulkhead, with its truncated NE-corner, created an abrupt wave break hydraulic condition that created excessive turbulence to the natural beach east of this truncation. The 25-feet of Rock Bulkhead that will remain will remove this unnatural wave-breaking hydraulic condition, allowing for the reclamation of approximately 80 square feet of natural vegetation. Once the easterly portion of the bulkhead is removed, the beach slope shall be rehabilitated. Sandbags filled with pea-gravel will be staked to the beach as shown on Attachment "C" to this letter. These will recreate the natural stable beach slope and protect the normal vegetation zone against wind-wave erosion. Sandbags with loam soil will be randomly positioned within the pattern. These will have New Vegetation planted within them. Over time, this new vegetation will spread and root-in the beach as it did before being disturbed. The attached SEPA Checklist covers the removal of 38% of the existing Rock Bulkhead, the Reclamation of approximately 80 square feet of natural vegetation, and retaining the westerly portion of the Rock Bulkhead necessary to eliminate adverse Hydraulic Turbulence created by the truncated, prior existing, Concrete Bulkhead. 2 This concludes our response to the bulkhead-related portions of the Bennet-Cumming letter dated 3/18/03 and our formal request to amend our Variance Application to include the permanent fence and two portable storage shelters as shown on Attachment "A". Dear MS. Bennett-Cumming: Martig Engineering has received your letter dated 1/13/03 and, with this Letter Report, is providing the clarifications and additions that you requested to make the Vermillion Variance Application complete. In addition, we are amending our Variance Application to include the Fence and Portable/Rented Storage Unit positioned south of SR 106. Your 1/13/03 letter is broken into sections. This Letter Report addresses the issues in the order that they are presented within your letter_ Attached and part of this Letter Report are two Drawings labeled Attachment "A" and Attachment "B", and Thirteen Pages of Photographs. The photograph pages are referenced as 1 thru 13 in the text of this Letter Report. 1 I. VARIANCE APPLICATION ISSUES A. Related To Fill: Our investigations show that a small amount of filling did indeed take place on the Vermillion Property, north of SR 106. We calculate that no more than 82 to 113 cubic yards, Total, of fill have been placed: 30 to 40 cu yds associated with the Driveway improvements to the residence in accordance with the WSDOT permit for same; 30 to 40 cu yds associated with the Rock Bulkhead repair at the east end of the prior existing Concrete Bulkhead; 20 to 30 cu yds associated with surfacing the prior existing parking pad; and 2 to 3 cu yds associated with surfacing the prior existing path to the beach. The "Expanded Site Plan" drawing, Attachment "B", shows the locations of these fill areas. The spot elevations on this drawing confirm that no significant fill depths have occurred on the property to create "New Land". Relevant photos also show the four mentioned fill areas: 3 shows the New Driveway looking north; 4 shows the completed Driveway and the Path to the beach; 5 shows the Path in detail with the lower photo showing that the plant roots are flush with the added crushed rock surfacing; 7 shows the undisturbed ground at the uprooted root-wad of the large tree that smashed thru the cabin and the brush that is growing around the root-wad; 10 shows the Rock Retaining Wall (Bulkhead near its attachment to the Concrete Bulkhead) and the wall backfill; 12 shows the localized washout at the sharp dead- end of the prior existing concrete Bulkhead where the Rock Wall was placed and the small void that required filling. B. Development Without Permits: The Vermillions purchased the property in November of 1998. In December of 1998 they took out a County Building Permit to repair the residence that was damaged by a large tree crashing onto it. While constructing these necessary repairs, they noticed the need to repair the east end/corner of the prior-existing Concrete Bulkhead (See photo page 12) and decided that they needed to raise the residence. Conversations with County staff led to the completion of a Rock Wall at the East End of the concrete bulkhead and applying for another Building Perffit to upgrade the residence foundation and cover V I continuing repair-spawned improvements. About this time their activitylaced on hold while a County of 9 p tY review of a neighbors complaint (regarding the blocking of a neighbors view) was conducted. Other activities were underway by the Vermillions as well, including an anticipated upgrade of their Septic System and the placement of a new Dock Facility. Due to overlapping confusion, the execution of the County Permitting process became incomplete. A recent discussion with Jenny Nickerson and Larry Waters has led to the execution of an agreement to correct the deficiencies that remain, associated with the Building Permit processing of work completed to date by the 2 Vermillions. This document (dated February 19, 2003) outlines a seven-step program for bringing prior commenced activities into compliance. A copy of this document is attached. C. Expansion of Development in Stream Buffer: Two improvements have been completed by the Vermillions that have not been completed within County processing requirements, including the completion of a 60-foot long Cedar-board fence with portions higher than 6-feet, and the placement of a rented 8"x16' storage container (both being located within a County prescribed 100-foot buffer from a �l Type 4 Stream). The "Fence and Storage Building Site Plan" drawing, Attachment "A", shows the location of these two improvements. Photo Pages 1 & 2 show them, and the 2/19/03 Building Department agreement lists this as correction item Number 5. We are processing these two improvements thru the Planning Department so that the actual Building Permit Process can move forward. Therefore, as part of this Letter Report, we are formally requesting that our Variance Application be amended to include the Fence and Storage Building. The fence is located as shown, 17-feet south of the SR 106 Drainage Ditch classified as a Type 4 Stream, and the Storage Building is located 20-feet south of the Stream. Please include these two improvements within our Variance Application as an Addendum to it. D. Septic System Related Questions: It was anticipated by the Vermillions that the Septic System for the subject Residence would require being upgraded in order to continue the use of the residence. They took out a County Permit to do so. Construction of the septic system improvements has been partially completed, but like other activities, has been curtailed by the delays associated with the permitting of their requested Residence Additions Permit. At present, the existing residence is continuing to use its existing permitted system until the residence additions construction reaches the stage where construction on the new septic system can resume. The existing permit for constructing the new septic system will be renewed if/as necessary. E. Water Adequacy: The current potable water supply for the Vermillion residence is from a Spring located on Vermillion property south of SR 106. They have approved water rights for their residence. They have recently installed a filter and Ultra-Violet Disinfection of this supply to the residence and plan to continue using it in the future. F. Stream Typing: Under current County Regulations, the water flowing from the Vermillion Spring as surface water, from the spring location on the hill, hence northward along a water course into the SR 106 south drainage ditch, hence westerly along said ditch to a 12-inch diameter culvert conveying said water from 3 the south SR 106 ditch to the north drainage ditch of SR 106 where it then flows easterly to the shoreline of Hood Canal, is determined to be a Type 4 Stream. G. Construction of Rock Bulkhead: As mentioned in B. above and shown on the Page 12 photos, erosion behind the end of an existing concrete bulkhead was threatening the footings of the existing residence. This treat was noticed by the Vermillions as new owners repairing the damage from a fallen tree. Although they sought and received direction from County Staff (Allen Borden), the Vermillions did not realize that a formal Permit would ultimately be required. They simply completed a rock retaining wall as shown on the drawing, Attachment "B" and photo pages 10 & 11. They now know that a County Permit is required and have agreed to process one in accordance with Item seven of the 2/19/03 agreement with the County Building Department. Martig Engineering will assist with this permit processing, working with County Planner Pam Bennett-Cumming. H. Adequacy of Originally Submitted Mitigation: On December 18, 2002, ATEC author Michelle R, Fusman clarified the intent of the required 400 square feet of planting of native vegetation. A copy of this letter is attached. The planned mitigation planting has been revised to reflect the clarifications. The primary planting area is a 350 square foot area of existing graveled parking that will be torn-up and planted as clarified. Also, a 225 square foot area south of the residence will be planted. This 575 square feet of planting area, shown on the Attachment "B" drawing. Is more than the 400 required. The additional 125 square feet is hoped to allow the set-back Variance Request, associated with the Fence and portable Storage unit located south of SR 106, to be granted. I. Location of Proposed Addition: The "Expanded Site Plan" drawing, Attachment "B", is a new drawing made from new measurements made by Martig Engineering. This drawing shows the location of the residence additions with improved accuracy, confirming the setback distances and configurations shown on C-1, the original drawing. Note that the actual location of the entrance driveway to the residence and the vegetation areas are located more accurately. It is the intent of the Vermillions to stake out the Addition footings for the County to review before construction begins. This will assure that the agreed-to setbacks are in fact being met. If this requires that a building wall be shortened some slight amount, in order to meet all agreed-to setbacks, that is what will be done. J. Location of Proposed Parking: As shown on the "Expanded Site Plan", no parking spaces are planned. In fact, 350 square feet of the existing gravel surface parking pad is being torn-up and planted. K. Permittinq of Dock: As discussed above, the permitting of the Dock is being addressed as Item 1 of the 2/19/03 County Building Department Agreement with the Vermillions. 4 I L. Other: Agua Tierra clarifying mitigation is being addressed as discussed in I.H. above. II. PLANNING RELATED ISSUES - (Based on further Site Review) A. Construction of Rock Bulkhead: We understand that the Rock Bulkhead issue must be brought into compliance with County Permitting requirements. This is agreed-to in Item 7 of the 2/19/03 County agreement with the Vermillions Martig Engineering is in the process of working with Pam Bennett-Cumming to acquire an after-the-fact permit for the Rockery Bulkhead, as found to be permittable. Photo Pages 8 & 9 show the developed Hood Canal Shoreline in the vicinity of the Vermillion property, including their property. Page 12 shows the original bulkhead problem that required attention. The photos on Page 9 were taken at High Tide to show, by water surface, the contour of the vegetation line. As you can see, only a short 25-foot section of the installed Rock (that being immediately east of its connection with the prior-existing concrete bulkhead) encroaches into the water, below the vegetation elevation. It is necessary that this portion be placed here, which is probably what Mr. Borden was suggesting could be done. The remaining 15-feet or so of placed rock is definitely above the line of vegetation and placed to stabilize the existing vegetation as shown on photo Page 10. We will meet with Fish & Wildlife and Pam to resolve the issues and process the necessary documents, including SEPA, as necessary to obtain Permit Compliance. B. Some Fill on Site in General: As discussed in I. A. above, some fill has been place on the Vermillion Site, approximately 82 to 113 cubic yards Total. C. Road Graded Through Wetland: In order to access the Commercial Shellfish along the Vermillion property, a prior-existing Path thru the vegetated portion of the site has been used. However, this access route has increased in width to as much as 6- feet due to the use of a small-motorized four-wheel vehicle and its small trailer for use in shellfish planting/harvesting. To improve the Path, several inches of �.� surfacing crushed rock were placed along the Path/Road. The length of the Path r thru the 0.05 acre vegetated area is 20 to 25 feet. Photo Pages 4 & 5 show this path. The lower photo on Page 5 shows that the crushed rock placed on the path did not bury the roots of the living plants. The Attachment "B" drawing shows that the 6-foot wide Path/Road will be maintained while removing 350 square feet of the existing crushed-rock surfaced parking pad and replanting it with native vegetation as clarified by ATEC. 5 D. Additional Construction Beyond Scope of Earlier Building Permit Approvals: As delineated in the County Building Department 2/19/03 Agreement with the Vermillions, some construction has been completed beyond the scope of earlier Building Permit approvals. All of these construction activities are addressed within this Agreement and are currently being addressed. Photo Page 13 shows the 4-foot by 10-foot Laundry/Storage Addition constructed outside of the west-wall of the residence that is being addressed as outlined in Item 6 of the Agreement. All other construction permit requirements are discussed in other sections of this Letter Report. E. Scale of Proposed Addition as Represented in Relation to Actual Fit on Property: The Attachment "B" drawing is a new drawing prepared by Martig Engineering using new measurements taken by them. It confirms that the Additions to the Residence will fit in accordance with the setbacks requested in the Variance Application under consideration. It also shows that the clarified Mitigation Vegetation planting can be accomplished. Note that no Parking Spaces are requested as part of the requested Additions. Additional related discussions are contained in I.I. above. F. Construction of Fence Structure in Buffer of Type 4 Stream (south of SR 106): As discussed in I.C. above, a fence was constructed within the 100-foot Buffer of the County designated Type 4 Stream. This construction was completed by the Vermillions to screen off their property south of SR 106 before they were informed that the Highway Ditch was designated a Type 4 Stream. They now know that the fence lies within this 100-foot Buffer, as show on the Attachment "A" drawing. They are processing an after-the-fact Building Permit for the Fence, since some of the 60-foot long fence measures greater than 6-feet in height. In order to secure this Permit, we are hereby formally requesting that our Variance Application be Amended to include our request that a 17-foot setback of the fence be allowed from the Type 4 Stream as shown on the Attachment "A" drawing. G. Placement of Storage Structure in Buffer of Type 4 Stream (south of SR 106): As discussed in I.C. above, a portable Storage Container/Structure was placed within the 100-foot Buffer of the County designated Type 4 Stream. This was done by the Vermillions to accommodate their move into the 8371 Hwy 106 residence, as their new primary residence (since the sale of their Olympia residence occurred as planned, even though the Hood Canal Residence Additions, expected to be completed, are not yet even permitted). They had no idea that the placement of a rented storage unit on their property would require a County permit, let alone be in violation of ANY County required Permit. The now know h a that a setback variance is required for the laced stora ge a e unit that q P 9 ( lies within the100-foot Buffer of a Type 4 Stream), as show on the Attachment "A" drawing, and that a Building Permit is also required to anchor the unit to the ground. 6 In order to secure the Building Permit, we are hereby formally requesting that the setback of the Storage Unit be allowed from the Type 4 Stream as shown on the Attachment "A" drawing. This concludes our Letter Report intended to: (i) Address all issues outlined within your 1/13/03 Letter, as follow-up to our 1/9/03 meeting; and (ii) Formally request that our Variance Application be Amended to include the request for reduced setbacks from the designated Type 4 Stream to the Fence & Storage Unit, as presented within this report and its Attachment "A" drawing. Bennett-Cumming: Martig Engineering is submitting an application for a Reduction in the Required Front Yard Setback for the above referenced Vermillian project, as a supplement to his original application. In addition, we are submitting a copy of a portion of the Bluhm Associates Land Surveyors, Inc. map, dated 5/22/02, which shows the entire Tax Parcel Number 32234- 44-00000 at a scale of 1' = 50' along with our Martig Engineering Site Plan covering only the portion of this Parcel where Variance Application(s) requests apply. PROPOSED PROJECT Jerry Vermillain proposes to construct an addition to his existing single-family residence, at the above referenced Parcel, and has previously submitted an application to do so. The addition includes a new Master Bedroom (with bath) on the west side and 1 a new Garage on the east. SETBACK PROBLEMS The existing residence was constructed many years ago on the south shore of Hood Canal. It is protected by an existing bulkhead on the north or water side of the residence and by the constructed Highway improvements on the south side. Easterly of the residence, a long-standing south-to-north 12-inch diameter Highway drainage culvert discharges onto the Vermillian Parcel. Both the flow rate (20 to 100 gallons per minute) and the volume of water being discharged is extremely small. Once the water discharges onto the Vermillian property, it flows due east along the toe of the highway fill, away from the existing residence, infiltrating into the gravelly sandy soil and disappearing at the vegetation line without flowing into Hood Canal proper (except possibly for short periods when the Canal is at High Tides). Through the passing of time, regulations and environmental concerns have evolved to the point that the existing residence is out of compliance with new County requirements. This residence is in very good condition, has survived earthquakes, stormy high tides, and major storm events with no problems. The owner desires to construct a new bedroom and garage onto the existing residence structure. Although there is space to accommodate these new additions and all environmental reviews confirm that these additions can be made with no adverse impact, certain County variances are required, both to bring the existing residence into compliance as well as to provide for the desired additions. These County variance requirements include: 1. The setback from the Hood Canal shoreline bulkhead to the north wall of the residence, both as it exists and with additions, (10-feet as existing & 14 to 16-feet as desired); 2. The setback from the Highway 106 northerly right-of way line to the south wall of the residence, both as it exists and with additions, (31-feet as existing and14 to 40-feet as desired from R/W line, but 39-feet from north pavement line); and 3. The setback from the discharge point of the Highway 106 12-inch diameter drainage culvert, (57-foot as existing & 23-feet as desired). Mr. Vermillian has previously submitted numerous applications and letters addressing these three setback issues. Martig Engineering has been engaged to supplement his previous work and provide the necessary elements to make his Application complete for the purpose of securing a Building Permit from the County to construct the desired additions to his existing residence. 2 Please note that all other requests and applications made by Mr. Vermillian addressing other projects on other portions of his total property are excluded from the Building Permit Application for constructing the desired additions to his existing residence, which we are now addressing. These other requests and applications will be dealt with separately, after we have satisfied all County requirements to secure this Building Permit for the additions, starting with the compliance issues defined by Kristen French.
