Shoreline Designation: Urban Parcel Number 322344400000 Address: 8371 E STATE ROUTE 106 UNION Legal Description: LOT 1 EX + TAX 824 Project Description: Construct 64 ft. long by 6 ft. wide fixed pier, 45 ft. long by 4 ft. wide ramp, and 8 ft. deep by 40 ft. wide float (344 sq. ft. area); 115 ft. total length structure is attached to existing concrete bulkhead; pier is fixed by 4 chemonite pilings and float is secured by 2 chemonite pilings. This permit has been granted by Mason County persuant to the Shoreline Management Act of 1971 and nothing in this permit shall excuse the applicant from compliance with any other federal, state or local statutes, ordinances or regulations applicable to this project but not inconsistent with the Shoreline Management Act. (Chapter 90.58 RCW). This permit may be rescinded pursuant to RCW 90.58.140(7) in the event the permittee fails to comply with the terms and conditions hereof. CONSTRUCTION PURSUANT TO THIS PERMIT WILL NOT BEGIN OR IS NOT AUTHORIZED UNTIL THIRTY (30) DAYS FROM THE DATE OF FILING THE FINAL ORDER OF THE LOCAL GOVERNMENT WITH THE REGIONAL OFFICE OF THE DEPARTMENT OF ECOLOGY AND THE ATTORNEY GENERAL, OR UNTIL ALL REVIEW PROCEEDINGS INITIATED WITHIN THIRTY(30) DAYS FROM THE DATE OF SUCH FILING HAVE TERMINATED. No permit authorizing construction shall extend for a term of more than five (5) years. If actual construction of a development for which a permit has been granted has not begun within two years after the approval of the permit by the Board of County Commissioners, the Board shall, at the expiration of the two-year period, review the permit, and upon a showing of good cause, extend the permit for one year. Otherwise, the permit terminates; provided that no permit shall be extended unless the applicant has requested such review and extension prior to the last regular meeting of the Board coming before the permit exipration date. SHR2000-00012 SUBSTANTIAL DEVELOPMENT PERMIT JOINT-USE PIER-RAMP-FLOAT STRUCTURE MONTANA REACH, INC. 1. The use of pressure-treated wood piling is approved for use in this project, provided that the supplier certifies in writing that appropriate best management practices have been employed in its production and that the material is fixed and free of excessive surface residue prior to installation. This certificate shall state the purchaser's name and shall be provided to Mason County prior to construction. 2. The applicant shall secure a Washington Department of Fish and Wildlife Hydraulic Project Approval and follow all construction specifications authorized in that permit. 3. The applicant shall secure an Army Corps of Engineers approval and follow all construction specifications authorized in that permit. 4. The applicant shall use best management practices for construction of the structure and shall remove construction debris from the shoreline area following project completion. 5. The applicant shall implement the approved proposal in a manner that is consistent with all policies and provisions of the Shoreline Management Act and its rules, the standards of the Mason County Shoreline Master Program, and the building codes of the Mason County Building Department. 6. The applicant shall secure approval of a boundary line adjustment for the two subject properties prior to the construction of the proposed pier-ramp-float structure. 7. The applicant shall prepare a joint-use agreement for the two properties addressing the easement access and maintenance of this pier-ramp-float stricture; this agreement shall be reviewed by the Mason Co. Planning Dept. and recorded with the property deed in the Mason Co. Auditor's Office. 8. The applicant shall secure Mason Co. Health Dept. approval of the existing on-site septic system on the property as functioning adequately, prior to construction of the proposed pier-ramp-float structure. 9. The proposal site plan is revised to a 16 long float section on the west side, making the float total length equal to 44 feet. 10. The proposed 6 ft wide pier shall be attached to the concrete bulkhead 12 feet west of the inset stairs in this bulkhead. 11. The handrails along the pier and ramp sections of the proposed structure shall be designed for maximum visibility by adjacent property owners. MASON COUNTY BOARD OF COMMISSIONERS PUBLIC HEARING -- JULY 11, 2000 FINDINGS OF FACT: Montana Reach, Inc. (SHR2000-00012) 1. Under consideration is the construction of a multi-owner joint use pier-ramp-float structure (115 feet total length; 432 sq ft area and 48 ft width float with no boat slip) on Hood Canal, 4 mile east of Union. The shoreline designation of this portion of Hood Canal is Urban Residential Environment. 2. The proposed land use is guided by the Piers and Docks policies and regulations in the Mason County Shoreline Master Program Chapter 17.16.170. 3. The use requires review as a Substantial Development Permit because the fair market value exceeds $2500 and the project is not exempt from permit requirements. 4. One agency comment was received for the proposed project. The letter brought up the concern for construction best management practices and coordination of review with the U.S. Army Corps of Engineers. 5. Seven letters of comment were received for the proposed project. Those comments focused on potential congestion with use of beach for swimming, boating, and other recreation, and on obstruction of Hood Canal views towards the northeast. Many of the letters noted that the beach area of the applicant is being used for commercial shellfish raising and whether the structure would be used for this purpose. Some of the letters stated that their concern was more with the location of the structure (adjacent to properties to the west) rather than an opposition to the pier-ramp-float structure itself. 6. The Board of County Commissioners heard the Planning Department staff report and the additional information provided by the applicant (biological evaluation and site maps). The concerns of structure location within the shoreline area and the shellfish raising along the beach were raised by public testimony. Upon request of the Board, the applicant supplied additional maps of the proposed structure in relation to the property lines and a boundary line request to create two waterfront lots in order to qualify for a joint use structure request. 7. Based on the Shoreline Master Program policies and use regulations, the proposed facility meets the standards for length and width of joint use pier and ramp and the dimensions of a float without a boat slip. The facility shall be secured using chemonite treated wood piling and .attached to the existing concrete bulkhead. FROM THE PRECEDING FACTS, the proposed multi-owner joint use pier-ramp-float structure is consistent with the policies and use regulations of Chapter 7.16.170 (Mason County Shoreline Master Program). Corporation owned by Jerry and Donna Vermillion 8371 East State Route 106 Union, Washington Lot 1, R3W T22N Sec 34 I have spoken to another property owners in the area. Karen Anderson had filled out a request to investigate the septic system with Mason County, I spoke to Pam Denton and I am mailing this information to clarify the requirements placed on the building permit and occupancy permit for the property. I understand that a Mason county employee was on site and inspected the non-conforming system last week and asked Mr. Vermillion to call her. 1 have forwarded similar information to Jennifer Tabaldi, State Department of Health, Shellfish Program concerning the closeness of the commercial shellfish area. This past weekend there were at least 12 people using the Vermillion household during the course of the weekend. I also observed three individuals, possibly commercially picking oysters from the beach just east of the Vermillion's house, placing the oysters in bags in the area of the high water tide xnark. The Vermillion's have asked for a substantial development permit SHR 2000 —00012 and a hearing with the County Commissioners on June $th. For the health and safety of neighbors and the shellfish I would appreciate an investigation to insure compliance with all shoreline and development requirements.
