Project Description: Shoreline preinspection to determine shoreline setbacks for
addition to existing cabin. Determine setbacks from existing
year round stream at edge of site.
Dear Applicant:
As part of this department's review of your permit application, a Shoreline Inspection (SPI) was
performed on your property. Below you will find comments made regarding the proposed
development and its critical values.
In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands
must be included in your specific proposal; these setbacks are included as part of the comments
listed below.
This information is based on County and State regulations as they exist to date. These regulations
may change and may affect the requirements for development of the subject property.

Shoreline Inspection

Comments: The site is on Highway 106, and the property spans both sides of
the road. An existing cabin is located on the waterward side of
the highway. A stream on the upland side crosses under the road
and flows along the edge of the cabin site into Hood Canal. The
preinspection focused on several issues which are addressed
individually below. Where more than one setback applies to a
specific development, the development must meet both setbacks,
which means the greater setback prevails.
SHORELINE MASTER PROGRAM: Site within 200 feet of the
Ordinary High Water Mark of Hood Canal is under Shoreline
Master Program jurisdiction, designation Urban Residential. The
existing cabin is a nonconforming structure, in that its waterward
roof projection is 8ft 6in. from the outside edge of the concrete
bulkhead. The waterward wall of the cabin is 1 Oft 1 in. from the
outside edge of the concrete bulkhead. There is an existing
residential structure on the property to the west (left looking at the
water). Within 150 feet of the property on the east side (right
looking at the water) there are no residential structures. On this
site the shoreline setback for any proposed addition or
appurtenant structures was determined by using the shoreline
setback common line drawn from the adjacent residence roofline
to the 15 foot default setback point on the existing cabin on site.
Proposed residential development to the west of the cabin shall
be landward of this line. The shoreline setback common line
crosses the fence on the west side of Vermillion property at a
point approximately 30 ft landward of the waterward edge of the
concrete bulkhead. This distance will need to be confirmed once
the pole and tarp structure which is located in violation of the
setback, is removed, relocated or modified. On the easterly side
of the cabin, the shoreline setback would be landward of a line
drawn from the 15 foot default setback point on the side of the
cabin, continuing at 15 ft from the OHWM as measured from the
top outside edge of the rock bulkhead. Sideyard shoreline
setback shall be 5 feet. (Please contact Building Inspector Tami
Griffey at (360) 427-9670 ext 356 for information on setback from
Highway 106). Reduction of any sideyard setback below 5 feet
requires application for and approval of a shoreline variance.
STRUCTURES NONCONFORMING TO THE SMP, TO BE
CORRECTED : (a) There is an approximately 1ft 6in wide section
of the west property line fence between the intersection of the
common line and where the lower (30in. or less) portion of the
fence begins, which is nonconforming to the shoreline setback.
The nonconforming section of fence must be lowered to meet the

30in. or less provision in the Residential Development Chapter
7.16.080 of the SMP, or be removed. (b) There are two (each 1 Oft
x 20ft) pole and tarp structures located one on each side of the
existing cabin. At least one of these (west side of cabin) has a
portion which is located in violation of the shoreline setback
common line and sideyard setback. Both the fence section and
pole and tarp structure(s) which are in violation of the shoreline
setbacks must be modified, removed or moved so they are
consistent with setback provisions. This was discussed with you
during the site visit and you indicated your willingness to comply.
Please contact me within 30 days of the date of this letter to
arrange for a site inspection to verify compliance.
FISH AND WILDLIFE HABITAT CONSERVATION AREA
CHAPTER OF RESOURCE ORDINANCE: There is a Type IV
stream on site. Type IV waters have a 100 foot vegetative buffer,
with an additional building setback of 15 feet. Because we have
not measured the buffer in relation to your land, staff does not
know if your property (including that across the road) contains
land outside the buffer. In cases where there is no land outside
the buffer, application for a variance may be made. Applications
are reviewed based on the attached variance criteria, and
application for a variance does not guarantee approval. The
variance process includes public notice, a public comment period,
review before the Planning Commission, and a public hearing
before the Board of County Commissioners. Your application will
need to demonstrate consistency with ALL variance criteria.
FLOODPLAIN: Portion of site is within the Zone A floodplain of
Hood Canal as shown in Flood Insurance Rate Map
5301150120C. New construction and substantial improvements
in the floodplain shall meet the provisions of the Mason County
Flood Damage Prevention Ordinance (copy enclosed).
