Ld6LU4. ::7 f E7M07NTANA REACH, INC: y Vermillion Kiwa Drive SE ia, WA 98513 05/25/99 11:00 FAX 503 224 7324 DUNN CARNEY ONE fi�002/003 These comments are submitted pursuant to WAC 197-11-340(c) in connection with the DNS issued on 5/15/99 regarding an application for a permit to construct a floating dock by Montana Reach, Inc., Jerry Vermillion, president, located at 8371 E. State Route 106, Union, Washington, in connection with Parcel No. 322344400010, Mason County, Washington. Id 0g tip I am Joan O'Neill, and 1 have an interest in real property located at 8363 East Highway 106, which property abuts the property of Montana Reach, Inc_/Jerry Vermillion. I received and reviewed an environmental questionnaire completed by Jerry Vermillion, together with three maps, a sketch and the DNS. COMMENTS &dijon L An' als (a) No birds are listed as observed in the area of the float on Mr. Vermillion's questionnaire. However, the proposed float is in the area called "Pebble Cove" and since 1995, 1, my husband and our guests have observed the following seabirds and ducks in the area: Gulls, Herons, Kingfishers, Loons, including the Common Loon, Grebes, Puffins, two kinds of Scoters (black and surf), Pigeon Guillemots, Mallards, Cormorants, Goldeneye, Bufflehead and Coots_ There may be more, as I am making this list from memory in Portland, Oregon and without the assistance of my bird log which is at my home at Hood Canal_ No mammals are listed in Mr_ Vermillion's questionnaire answer, however, I have observed deer, river otter, seals and otter in the cove- (b) No endangered species are listed in Mr. Vermillion's answers. However, the Common Loon is listed in one of my bird books as an endangered species. I have contacted the appropriate agency regarding endangered species to learn what species may be on the current list, and I do not yet have that information. However, one of my bird books lists some of the species that I have sighted as "declining in numbers". (c) The answer to this question states that the site is not on a migration route. I can only speak from my observations, but my husband and I have observed entire flocks of birds flying in a "V" formation coming in to land on the water in the late afternoon and early evening during what appears to be a migration season. Repeated flocks of these birds have landed on the waters at the eastern end of the cove and just beyond the eastern end of the cove. These birds appear to have it on their flight path_ It is an awesome sight to watch flock after flock of birds come in throughout the evening and land in the same area as if guided by some internal radar. II 05/25/99 11:00 FAX 503 224 7324 DUNN CARNEY ONE 16003/003 Entire flocks of Buffleheads and Goldeneyes land in the'western end of the cove and in front of my property which abuts the property of Montana Reach, Inc. These ducks feed up and down in the cove and in front of may property. I think these are migratory ducks. Section 8 and and Shoreline U This section asks how many people will be displaced. Although no people will actually be displaced as, it is a swimming float, Mr. Vermillion has given notice to the owners of four mooring buoys that they must move those buoys by June 1, 1999, as he feels they will interfere with his plans to build this floating dock, and a land based dock which he has stated he will build. I am one of those interested owners, although from the sketch it does not appear to me the mooring in which I have an interest is in the vicinity of the proposed float. However, I have contacted the appropriate governmental agency to request an application for a permit for the mooring buoy to see if such a permit is feasible.
