BLD2006-00439) for proposed construction or development in the county. Upon review of your application, I have determined that the contents of the application are incomplete or do not provide enough detail for review. Therefore, review of your application will not proceed until the necessary information is provided (see the comment section of this letter for details.) Sincerely, Kell McAboy Land Use Planner Mason County Planning Department 4/12/2006 1 of 4 BLD2006-00439 NOTIFICATION OF INCOMPLETE APPLICATION 4/12/2006 Case No.: BLD2006-00439 Comments: After review of your building permit (BLD2006-00439) for new construction of a 1,440 square foot storage building, it has been determined that an Administrative Variance, a Resource Ordinance Variance and a Shoreline Substantial Development permit will be necessary. It is also possible that a Shoreline Conditional Use Permit is necessary. ADMINISTRATIVE VARIANCE According to the site plan submitted with the building permit, the proposed building location is 20-feet from the edge of the S.R. 106 right-of-way. Mason County Development Regulations 1.04.220 requires a minimum "front-yard" building setback of 25-feet. Section 1.05.034C. allows for a reduction of the required front-yard yard setback under certain circumstances, but not less than 10-feet. Due to the steep slopes on the property, the proposed building would meet the requirements, and would be approved for the Administrative Variance. Application enclosed. RESOURCE ORDINANCE VARIANCE The Type 4 stream that flows in proximity to the proposed building location is jurisdictional including the portion, which is maintained as a ditch by the Washington State Department of Transportation. Type 4 streams require a 100-foot buffer plus a 15-foot building setback per Mason County Resource Ordinance (MCRO) 17.01.110 Table 3. A variance is required for new construction within buffers per 17.01.110 G.1.c.1. Application enclosed. SHORELINE JURISDICTION The proposed building location is approximately 100-feet from the Ordinary High Water Mark of Hood Canal. Therefore it is subject to the regulations in Mason County's Shoreline Master Program. Definitions section 7.08: Shorelands. Those lands extending landward for 200 feet in all directions, as measured on a horizontal plane from the ordinary high water mark, floodways and contiguous floodplain areas landward 200 feet from such floodways, and all wetlands and river deltas associated with the streams, lakes and tidal waters which are subject to the provisions of the Act and this master program. SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT Residential and appurtenant structures are exempt from a Substantial Development Permit per Mason County Shoreline Master Program (MCSMP) 7.16.080. However, the proposed storage building does not meet the criteria as a residential appurtenant structure as defined in the MCSMP Definitions section 7.08: 4/12/2006 2 of 4 BLD2006-00439 NOTIFICATION OF INCOMPLETE APPLICATION 4/12/2006 Case No.: BLD2006-00439 Appurtenant Structure. A structure which is necessarily connected to the use and enjoyment of a single-family residence and is located landward of the ordinary high water mark and the perimeter of a wetland. Normal appurtenant structures include a garage; deck; driveway; utilities; storage shed (one story - less than 600 square feet), woodshed, pump house, upland retaining wall and grading which does not exceed 250 cubic yards and which does not involve placement of fill in any wetland or waterward of the ordinary high water mark The subject property currently includes a single-family residence and a garage. The storage building would need to be revised to reflect a 600 square foot building or smaller in order to avoid the requirement of a Substantial Development Permit. MCSMP Definitions section 7.08: Substantial Development. Any development of which the total cost or fair market value exceeds Five Thousand ($5,000) Dollars, or any development which materially interferes with normal public use of the water or shorelines of the state; except that those developments defined above as an "exemption" do not require a substantial development permit but may require a variance or conditional use permit. Application enclosed. CONDITIONAL USE PERMIT It is possible that the proposed building would also need a Shoreline Conditional Use Permit depending on its intended use. Although it appears that the storage structure will not be used in connection with the property's aquaculture operation, the applicant may want to consider applying for a conditional use permit if there is an intention P Y now or in the future to conduct such use. MCSMP Definitions section 7.08: Cottage Industry. Small scale commercial or industrial activities on residential properties performed in the residence or building accessory thereto. The principle practitioner must reside on the property. Cottage Industries are considered as residential uses and minor commercial development and substantial developments under this Master Program provided they do not alter the character of the site as a residential property and wholesale and retail trade is minimal. Cottage Industries must comply with all applicable County Ordinances and require a Conditional Use Permit. Application enclosed. PUBLIC HEARING Resource Ordinance Variances, Shoreline Substantial Development Permits and Shoreline Conditional Use Permits all require public hearings with the County's Hearing Examiner. Hungerford,Attorney PO Box 1191 Shelton,WA 98592 Dear Jim, This letter is an attempt to give you informational substance regarding our approach to obtaining a storage building permit. As we go through the process, I'm sure there will be more,but this is a start. The storage building is basically to store our three boats, summer outdoor furniture, recreational equipment, our 4 x 4 quad, the tractor loader, our pickup and accumulated family tools,keepsakes and land maintenance equipment. Our equipment and this building are so very necessary to maintain our acreage and our way of life. The only oyster business use is perhaps storing our oyster delivery truck,however it is questionable how much storage time would be taken by this truck. The purpose of the building is for security and longevity of our accumulated personal belongings. The property has had two earlier out-of-date habitat management plans. If a variance from the creek is necessary perhaps a shirt-tail addendum to Lee Boad's present HMP for the FP application can be used to work out any required mitigation. We have checked in the past as to a different location and it was found to distant or steep for a practical building. I think that will hold up now also. I think you have copies of the professional work already done on the property. This is about as far as I can go now,but will provide whatever I have or what is necessary for you and the county to go forward with the process.
