Shoreline Substantial Development 5 Permit 6 7 INTRODUCTION 8 The applicant has requested the installation of storm water and drainage management 9 improvements within 200' of the Hood Canal shoreline. The Examiner approves the 10 requested permit subject to conditions recommended by staff. 11 ORAL TESTIMONY 12 Scott Longanecker introduced the staff report. Applicant. The applicant is Harmon Hill of Union. 12 13 2. Hearing. The Hearing Examiner conducted a hearing on the subject application on January 13, 2004, at 1:00 p.m. in the Mason County Board of 14 Commissioners Meeting Chambers. 15 Substantive: 16 3 Site Description/Proposal. The proposal is to install storm water 17 improvements for a currently developed commercial site. The purpose of the proposal is to bring the existing and potential new development up to current 18 standards. Construction of storm water improvements will include the installation of an 18" storm drain on the property to a connection to an existing 36" storm water 19 main on State Route 106. The project will require trenching, bedding and backfilling, 20 as well as installation of concrete anchors and the upgrading of an existing catch basin. Very little vegetation will need to be removed for the project. 21 The site is located on the south shore of Hood Canal. The subject property is 13.47 22 acres in size and contains several buildings, homes, office space and parking. The site is used primarily as a retreat center. Physical attributes of the site include 23 relatively steep slopes trending down North towards the Hood Canal. The property 24 contains a mix of cleared, developed areas and well-vegetated, relatively natural areas. State Route 106 borders the site to the North and separates the developed 25 portion of the property from the Hood Canal shoreline. {PA056195 8.DOC;1/13009.900000/} Harmony Hill p. 2 Findings, Conclusions and Decision 4. Characteristics of the Area. The surrounding area is primarily designated 1 as Rural Residential under County zoning. The area is well vegetated and forested 2 with mature evergreens. The area is also characterized as a landslide hazard area due to steep slopes ranging from 15 - 45" or more, but is mapped as a Class 2 landslide 3 hazard area by Smith and Carson(1977). Under this definition,the area is considered relatively stable under normal conditions, but may become unstable due to human 4 activities. 5 5. Adverse Impacts of Proposed Use. As mitigated as recommended by staff, 6 there should be no adverse impacts created by the proposed developments. The applicant has performed a detailed geotechnical analysis to insure that the project 7 design will not impair slope stability. Staff recommended conditions of approval do not allow any adverse impacts to water quality. 8 CONCLUSIONS OF LAW 9 Procedural: l0 1. Authority of Hearing Examiner. MCC 15.03.050(1)provides the Examiner 11 with the authority to review and issue a final decision on shore permit applications. 12 Substantive: 1' 2. Shoreline Designations. The shoreline designation of the site is Urban 14 Residential. Hood Canal is also considered a Shoreline of Statewide Significance under the County Shoreline Master Program and State Shoreline Management Act. 15 3. Ayylicable Review Criteria. MCC 15.09.055(A) requires a substantial 16 development permit for any substantial development within the shoreline jurisdiction. 17 MCC 15.09.055(F) requires that permit for substantial development permits be subject to review by the Hearing Examiner. MCC 15.09.055(F)(2)(c) provides that 18 the Examiner shall base a decision on a substantial development permit application on the Shoreline Master Program for Mason County and the policies and procedures of 19 Chapter 90.58 RCW,the Shoreline Management Act. MCC 7.08 defines a substantial development as any development of which total cost for market value exceeds $5,000 20 or any development which material interferes with any normal public use of the water 21 or shorelines of the state. The staff report indicates that the project is worth over $5,000. The applicable shoreline policies and regulations are quoted and addressed 1�1� below: 2 RCW 90.58.020(1): Recognize and protect the state-wide interest over local interest. 24 4. The proposed storm water improvements will protect against flooding and 25 further erosion of the shoreline, thus serving the state-wide interest of shoreline protection. (PA0561958.DOC;1/13009.900000/) Harmony Hill p. 3 Findings, Conclusions and Decision I RCW 90.58.020(2): Preserve the natural character of the shoreline. 2 5. By controlling storm water flows, the proposed improvements will help 3 protect the adjoining short shoreline and preserve it as contemplated above. 4 RCW 90.58.020(3): Result in long-term over short-term benefit. 5 6. As noted previously, these storm water improvements will help protect the 6 adjoining shoreline and will do so on a long-term basis. 7 RCW 90.58.020(4): Protect the resources and ecology of the shoreline. 8 7. By controlling storm water flows, the proposed improvements will protect the resources and ecology of the shoreline. 9 10 RCW 90.58.020(5): Increase public access to publicly owned areas of the shorelines. 11 8. Mason County has no constitutional authority to mitigate this project to 12 require public access to publicly owned shorelines due to the installation of riprap. 13 The project will not decrease public access to publicly owned areas of the shoreline. 14 RCW 90.58.020(6): Increase recreational opportunities for the public and the shoreline. 15 9. The proposed storm water improvements will protect fish habitat and 16 prevent damage to shorelines by flooding. This will increase recreational 17 opportunities for the public on the shoreline. 18 10. The proposed storm water improvements are similarly consistent with the other policies enunciated in RCW 90.58.020 for the reasons cited repeatedly above, 19 namely,prevention of flooding and protection of adjoining shorelines. 20 MCC 7.16.040 Policy 1: Commercial development on shorelines should be 21 encouraged to provide physical and/or visual access to the shoreline, and other opportunities for the public to enjoy the shoreline. 22 11. This proposal will not add to or detract from the public's ability to use, 23 access or view the shoreline. Given this absence of nexus between public access and a proposed shoreline, the Mason County has no constitutional authority to require 24 physical and/or visual access to the shoreline. 25 (PA0561958.DOC;1/13009.900000/) Harmony Hill p. 4 Findings, Conclusions and Decision MCC 7.16.040 Policy 2: Multiple use concepts, which include open space and 1 recreation, should be encouraged in commercial developments. 2 12. The proposed storm water improvements have no established nexus to the 3 need for open space or recreation and Mason County, therefore, cannot require any open space or recreation mitigation measures. 4 MCC 7.16.040 Policy 3: Commercial development should be aesthetically 5 compatible with the surrounding area. Structures should not significantly impact 6 views from upland properties, public roadways or from the water 7 13. This project will be underground, so there will not be aesthetic or visual impact. 8 MCC 7.16.040 Policy 4: The location of commercial developments along shorelines 9 should ensure the protection of natural areas or systems identified as having 10 geological, ecological, biological or cultural significance. 11 14. The permit is sufficiently conditioned to protect any significant environmental or cultural features. No significant impacts have been identified or are 12 expected. 13 MCC 7.16.040 Policy No. 5: Commercial developments should be encouraged to be 14 located inland from the shoreline area unless they are dependent on a shoreline location. Commercial developments should be discouraged over-water or in 15 marshes, bogs, swamps and floodplains. 16 15. The project is a whole is located as far inland as it can be and ties into existing 17 shoreline features and improvements along S.R. 106. 18 MCC 7.16.040 Policy No. 6: New commercial development in shorelines should be encouraged to locate in those areas with existing commercial development that will 19 minimize sprawl and the inefficient use of shoreline areas. 20 16. The project is located on an existing commercially zoned property and 21 will serve the existing commercial development. 22 MCC 7.16.040 Policy No. 7: Parking facilities should be placed inland, away from the immediate water's edge and recreational beaches. 23 17. The existing parking is proposed to be within 200' of the shoreline. 24 25 1 PA0561958.DOC;1/13009.900000/) Harmony Hill p. 5 Findings, Conclusions and Decision MCC 7.16.040 Policy No. 8: Commercial development should be designed and 1 located to minimize impacts of noise and/or light generated by the development upon adjacent properties. Commercial developments, which generate significant noise impacts, should be discouraged. 3 18. Staff recommended conditions of approval limits construction in day light 4 hours to minimize noise impacts. No other aspect of the proposed storm water 5 improvements implicates adverse noise or light impacts. 6 MCC 7.16.040 Use Regulation No. 1: The County shall use the following information in reviewing commercial development proposals: 7 • Nature of the activity; R • Need for shore frontage; 90 Special considerations for enhancing the relationship of the activity to the shoreline; 10 Provisions for public visual or physical access to the shoreline; • Provisions to ensure that the development will not cause severe adverse 11 environmental impacts; • Provisions to mitigate any significant noise impacts; 12 • Provisions to mitigate light or glare impacts. 13 19. The nature of the project is non-intrusive and meant to control and manage 14 on-site storm water to prevent erosion and other problems. The location of the project within shoreline jurisdiction is due to the topography of the site and location 15 of the adjacent state highway and existing storm water facilities. No significant 16 environmental or other impacts are expected. The project should mitigate potential environmental problems associated with uncontrolled storm water. Staff 17 recommended conditions of approval also help to protect water quality and also any adverse impacts resulting from construction of the site, such as erosion and noise. 18 MCC 7.16.040 Use Regulation No. 2: Commercial development may be permitted 19 on the shoreline in the following descending order of priority: water dependent, 2 water related and water oriented. Non-water related, non-water depending and non- water oriented developments in an urban and rural environment may be permitted by 21 Substantial Development Permit when the parcel of land to be developed is a minimum of 100'from OHWM and is located on the upland side of a public roadway, 22 railroad right of way or government controlled property. 23 20. The project is water related in that it is designed to prevent adverse 24 impacts to shoreline water quality and shoreline resources caused by storm water development from upland developments. 25 {PA0561958.DOC;1/13009.900000/} Harmony Hill p. 6 Findings, Conclusions and Decision MCC 7.16.040 Use Regulation No. 6: New commercial developments shall be 1 located adjacent to existing commercial developments whenever possible. 2 21. The proposed storm water facilities will be installed adjacent to existing 3 commercial developments. 4 MCC 7.16.040 Use Regulation No. 7: New or expanded structures shall not extend more than 35'in height above average grade level. 5 6 22. The proposed storm water improvements will be underground. 7 MCC 7.16.040 Use Regulation No. 8: Commercial developments adjacent to aquaculture operations shall practice strict pollution control procedures. 8 23. There is no evidence that the project is adjacent to any aquaculture 9 operations. Even if it was, the project is mitigated to prohibit any degradation of 10 Water quality, which should serve to adequately protect aquaculture operations. 11 MCC 7.16.040 Use Regulation No. 9: Commercial developments shall be located and designed to minimize noise impacts on adjacent properties. 12 24. The only noise associated with the project will be during construction, and 13 staff has minimized these noise impacts by limiting construction noise to day light 14 hours. 15 DECISION 16 The Examiner approves the requested shoreline substantial development permit and shoreline conditional use permit for the proposed storm water improvements, as 17 depicted in Exhibit 2, the Shoreline Permit Application. Introduction. This report evaluates a proposal by Harmony Hill (non-profit retreat and wellness center) to install storm water, drainage management system improvements for a currently developed site adjacent to State Route 106, East of Union Washington. The site is within 200-feet of the Hood Canal shoreline. Planning staff recommends approval subject to attached conditions. II. Applicant. Harmony Hill of Union. III. Date of Application: November 11, 2003 IV. Property Location. 7362 East S.R. 106, Union WA. Just East of the Union Rural Activity Center on State Route 106, approximately '/a mile East of the Alderbrook Inn. The jurisdictional shoreline water body is the Hood Canal. Legal description: Parcel#32233-44-00040, W1/2 GOVT LOT 1, S 9/57 EX TAX 683-C, 669-C 7362 &7361 E HIGHWAY 106 UNION V. Project Description. The Mason County Comprehensive Plan designation for the site is Rural and the site zoning is Rural Tourist. The current use as a retreat/wellness center is a conforming land use. VII. SEPA Compliance. A Mitigated Determination of Nonsignificance was issued on September 26, 2003 for the proposal. The only comments received were from WA Dept. of Ecology stating that the proposal may need a Shoreline Substantial Development permit if the project had a value of over$5,000. VIII. Other Permits. The proposal requires a Mason Environmental Permit, which has been applied for. Other permits may be needed and have possibly already been obtained from the WA Dept. of Transportation to tie into the existing storm water system. IX. Analysis. This proposal requires a Shoreline Substantial Development Permit because of the because the fair market value of the project within shoreline jurisdiction exceeds $5,000,per section 7.08 of the Mason County Shoreline Master, definition of Substantial Development. The proposal does not appear to trigger the need for a Conditional Use Permit. scottUHarmonyHillSDPreport 2 Commercial Development Policies and Use Regulations of SMP Chapter 7.16.040 follow. Permit application shall identify the size, general type and location of landscaping. Design of parking and loading areas shall ensure that surface runoff does not pollute adjacent waters or cause soil or beach erosion. Design shall provide for storm water retention. Parking plans shall be reviewed by Mason County Department of Public Works for compliance with all applicable County Ordinances. Creation of parking areas by landfilling beyond OHW mark or in biological wetlands is prohibited. Staff response: The project is meant to mitigate existing and potential future parking facilities. 4. Those portions of a commercial development, which are not water dependent,are prohibited over the water. Staff response: Not applicable. scottl/HarmonyHillSDPreport 4 t 5. Water supply and waste facilities shall comply with the strictest established guidelines, standards and regulations. Staff response: Not applicable. 6. New commercial developments shall be located adjacent to existing commercial developments whenever possible. Staff response: The proposed storm water facilities will be installed adjacent to existing commercial developments. 7. New or expanded structures shall not extend more than 35 feet in height above average grade level. Staff response: Not applicable. 8. Commercial developments adjacent to aquaculture operations shall practice strict pollution control procedures. Staff response: The project should partially mitigate any potential impacts to water quality or aquaculture by appropriately managing on-site storm water and preventing unnecessary erosion and other sources of pollution. 9. Commercial developments shall be located and designed to minimize noise impacts on adjacent properties. Staff response: The only noise associated with the project will be during construction. X. Conclusions. As designed, the project is consistent with the Mason County Shoreline Master Program Chapter 7.16.040 (Commercial Development. Staff recommends approval of the proposal, subject to the following conditions: 1. The project shall be required to control erosion during construction. Removal of vegetation should be minimized and any areas disturbed should be restored to prevent erosion and other environmental impacts. 2. Water quality is not to be degraded to the detriment of the aquatic environment as a result of this project. 3. Debris or deleterious material resulting from construction shall be removed from the project site and shall not be allowed to enter waters of the State. 4. The applicant is responsible for obtaining and adhering to the conditions of all other relevant permits for this project,including but not limited to permits from the Washington Department of Ecology, Washington Department of Transportation and Washington Department of Fish and Wildlife. 5. Scope: The scope of the exploration and analysis included a review of geological maps of the area and geologic and related literature, a reconnaissance of the immediate site, surficial examination, field and laboratory testing, and an engineering analysis and evaluation of the foundation materials. Findings and recommendations within this report are for specific application to the proposed project. All recommendations are according to generally accepted soils and foundation engineering practices. General Geology Of Area: The soil as described by the Coastal Zone Atlas of Washington for Mason County is a Vashon till. General Climate Of Area: The climate is temperate and marine. The influence of the Puget Sound and the Pacific Ocean modifies summer and winter temperatures and eliminates periods of extreme heat and cold. DESCRIPTION OF SITE Site Location: The site for the proposed complex, which is the subject of this report, is located to the south of SR 106 and east of Alderbrook, near Union, WA. [See vicinity map.] Site Topography, Drainage And Vegetation: The site is situated on a slight bluff gently sloping toward SR 106 to the north. The site has extensive ditching in and around the roads, parking and buildings in order to alleviate surface runoff. Most of the area around the complex is used as garden and lawn. Native vegetation, predominantly evergreen trees are found farther to the south, upslope and away from the complex. All drainage percolates about three ft. into the ground l through the top layer and travels over the surface of the impervious layer underneath to the roadside ditch ! along SR 106. The site is currently being used as a complex for Harmony Hill. FIELD EXPLORATION General Notes: The field exploration to determine the engineering characteristics of the foundation materials included a reconnaissance of the project site, performing field penetrometer tests and recovering disturbed grab samples. Testing Procedures: Penetrometer Tests - From the samples obtained, penetrometer tests were performed to obtain approximate bearing capacities of the individual soils strata. The results of the penetrometer tests provide a direct reading of bearing capacity of the soils being tested. 10011 Blomberg Street SW,Olympia,WA 98512 Phone#: (206)754-4612 Fax#: (206)7544848 GEOTECHNICAL TESTING LABORATORY FOUNDATION DISCUSSION AND RECOMMENDATIONS General Notes: Two requirements must be satisfied in the design of foundations. First, the load must be less than the ultimate bearing capacity of the foundation soils to maintain stability, and secondly, the differential settlement must not exceed an amount that will produce adverse behavior to the superstructure. The allowable settlement is usually exceeded before bearing capacity considerations become important; thus, the allowable bearing pressure is normally controlled by settlement considerations. Considering the subsurface conditions and the proposed construction, it is recommended that the structure be founded upon conventional reinforced concrete footings. Settlements should not exceed tolerable limits if the following design and construction recommendations are observed. Foundation Design Recommendations: On the basis of the data obtained from the site and the test results from the various laboratory tests performed, GEOTECHNICAL TESTING LAB recommends that the following guidelines be used for the net allowable soils bearing capacity. Net Allowable Footing ASTM D 1557 Soils Bearing Depth Subgrade Compaction Capacity 18" 95 % 2,000 lbs./ft2 Any excessively loose or soft spots or areas that do not meet the compaction requirements that are encountered in the footing subgrade will require over-excavation and backfilling with at least 2 ft. of structural fill. In order to minimize the effects of any slight differential movement that may occur due to variations in the character of the supporting soils and any variations in seasonal moisture contents, it is recommended that all footings be suitably reinforced to make them as rigid as possible. CONSTRUCTION CONSIDERATIONS Earthwork: It is recommended that all loose soils and deleterious materials be stripped from the foundation area to the firm native soil and wasted. Exact depths of stripping should be adjusted in the field to assure that the entire root zone is removed. It is recommended that the final exposed subgrade be inspected by a representative of the soils consultant. This inspection should verify that all organic material has been removed. Any soft spots or deflecting areas should be removed to firm native soil and/or replaced with structural fill. After the existing subgrade soils are excavated to design grade,the footing area shall be compacted to 95% of the maximum dry density as per ASTM D-1557. Enough density tests should be taken to monitor proper compaction. In relatively pervious soils, such as sands, indicated groundwater elevations are considered to be reliable groundwater levels. In impervious soil (cohesive), the accurate determination of the groundwater elevation may not be possible even after several days of observation. Seasonal variations, temperature and recent rainfall conditions may influence the level of the groundwater table and volumes of water will depend on the permeability of the soils. Laboratory Testing Program: Along with the field investigation, a supplemental laboratory testing program was conducted to determine additional pertinent engineering characteristics of the foundation materials necessary in analyzing the behavior of the proposed structures. The laboratory testing program included supplementary visual classification and water content determinations on all samples. In addition, selected samples were subjected to Grain Size Analysis. SUBSURFACE CONDITIONS General Notes: The types of foundation materials encountered have been visually classified and are included in the report. The results of the field penetrometer and other laboratory tests are presented in the report. Description Of Foundation Materials: The geology of the area as taken from the "Coastal Zone Atlas, Volume 9, Mason County" consists of Vashon till (Qvt) that transitions into Pleistocene sand deposits older than Vashon till along SR 106. The Vashon till was deposited by the Vashon Stade of the Frazier Glaciation. The Pleistocene sand deposits consist of sands, silty sands, and pebbly sands commonly bedded and may contain gravel lenses and inter- bedding with the sands. On this site there was noticeable inter-bedding of gravel with the native sands. The native soils can be considered at or near their natural angle of repose, and that the factor of safety for most of the slope will be near unity. PROJECT DESCRIPTION The purpose of this section is to enumerate details of the proposed structures. The following information was provided by the project manager. The construction would consist of wood frame structures not to exceed two stories in height. Conventional reinforced spread footings and reinforced slab-on-grade are contemplated. Differential settlements are limited to 3/4 inch. An active coefficient of 0.25 for lateral pressures and a friction coefficient of 0.60 may be used for the structural fill. Groundwater Control: Groundwater was encountered at the time the field exploration was conducted. Groundwater is expected to cause some difficulties during construction of this project. It is recommended that runoff caused by wet weather be directed away from all open excavations. The on-site soils can be expected to become soft and pump if subjected to excessive traffic after becoming wet during periods of bad weather. This can be avoided by constructing temporary or permanent driveway sections should wet weather be forecast. The footing drain on all structures shall be placed so that the pipe invert is below the bottom of the footing and roof drains are not connected to the footing drain. On-site internal driveways should be constructed so that the roadside ditch acts as an interceptor. This can be accomplished by placing the bottom of the ditch 6 inches into the impervious soil and maintaining a positive gradient to the discharge area. Should the ditch become excessively steep or deep, the ditch can be filled with quarry spawl (6 in. minus) to maintain safety. This should only be needed on the southernmost side of the highest road. Geoseismic Setting: This project site is located within a "Zone 3 Area" as per the 2000 edition of the Uniform Building Code. All building structures on this project should be designed as per the U.B.C. requirement for such a seismic classification. The material on site has a soil profile SD with 600 ft./sec. S Vs >_ 1,200 ft./sec shear wave velocity. Slope Stability: The slope is classified by the Coastal Zone Atlas for Mason County as "intermediate". Intermediate slopes consist of areas considered to have less than critical geologic, groundwater, or wave erosion factors, but which may become critical, and therefore subject to landsliding if disturbed. A common example is a stabilized and vegetated sand and gravel talus slope, the surface of which is sloping at the angle of repose or less (less than approximately 70 percent (35 degrees). Intermediate slope stability includes heavily vegetated, very steep slopes underlain by sand, gravel, till and/or bedrock. Erosion at the toe of slope is absent except when the state pulls the ditch along SR-106. Slopes may fail by a number of mechanisms, depending on the nature of the soil involved and the arrangement of natural earth materials at the site in question. Generally, the driving forces are represented by a component of soil weight downslope and the resisting forces are represented by the soil strength acting in the opposite direction. The factor of safety (FS) of the slope is expressed as the ratio of the resisting forces or "moments" to the driving forces or "moments". When the FS is 1 or less, the slope must fail. When the FS exceeds 1, the slope is theoretically stable. When estimating the FS for the slopes encountered, we considered 4 types of information: 1. the soil and water profiles 2. the kinematics of the potential slope failure 3. the strength and weight of the soil 4. the proposed slope geometry We have calculated "worst case" scenarios and have found that the on-site soil can support slopes with the buildings at there proposed locations. (see site plan) Please bear in mind that any slope exposed to the elements will weather and deteriorate until vegetation returns to the surface of the slope. Slopes in excess of one ft. vertical to one ft. horizontal should be supported by an engineered retaining structure. If no retaining structures are used, sloughing of the slope along the driveway approach can be expected. Impact Analysis: We do not anticipate that the proposed project will have any off-site impact. On-site care should be taken during construction to make sure that runoff caused by wet weather be fenced to protect drainage ways from siltation. Liquifaction Potential: The materials on site are of a cohesionless nature, consisting of semi-cemented materials. The potential for liquefaction of the soils in this area is negligible and not expected to present any problems for the project. Hillside Foundations (Daylight Dimension): Structures built on sloping sites offer a number of potential problems. Fig. 1 illustrates a basic consideration for what is called the "daylight' dimension, which is the horizontal distance from the bottom of the footing to the adjacent ground surface. Many building codes require a minimum distance for this dimension in order to assure some safety against the pushing out of the footing in the downslope direction. Logically, the limit for this distance depends on the type of soil and the angle of the slope of the ground surface. As the slope increases, the daylight dimension is less assured and should be limited to some minimum distance. A depth of 32 inches will provide the critical exposure necessary. A common problem with hillside construction is that shown in Fig. 2, where recontouring of the construction site results in a portion of the building being placed on some significant depth of fill. If possible, all of the footings should be carried down to a depth below the fill. If structural fill is used and placed with reasonable compaction, it may be possible to rest the footings in the fill, provided that this is done only with inspection and supervision by a soils testing firm. General Comments: When the plans and specifications are complete, or if significant changes are made in the character or location of the proposed structure, a consultation should be arranged to review them regarding the prevailing soil conditions. Then it may be necessary to submit supplementary recommendations. It is recommended that the service of a qualified soils consulting firm be engaged to test and evaluate the soils in the footing excavations before concreting to determine that the soils meet the compaction requirements.
