The Department of Natural Resources(DNR) has received and reviewed your request for cancelation of
the reclamation permit for the Old Belfair mine located in Section 17 Township 23 North Range 1 West
W.M., Mason County. With the information submitted to DNR by you and Mason County(Date stamped
by DNR June 27, 28 and 29, 2011)all of the requirements of RCW 78.44.390 have been met. Permit 70-
012066 is hereby cancelled in favor of the current Mason County Grading Permit. No further mining may
occur at the site without a new Surface Mine Reclamation Permit.
All interest in Performance Security#47126821854567 issued by Key Bank N.A. for the Old Belfair pit
(Permit#70-012066) in the amount of$27,500 is hereby released.

Transfer of Reclamation Responsibilities to Mason County.
Dear Mr. Skov:
Mason County Department of Community Development has been contacted by Mr. Jeffrey
Hartman, the owner of Hood Canal Land &Gravel L.P., in regard to the cancellation of his State
Reclamation Permit No. 70-12066 and the cessation of gravel operation at the property located
on Parcel Number 12317-11-00000, north of Belfair in Mason County. This process would follow
RCW 78.44.390 provisions.
Mr. Hartman and Mason County have discussed the transfer of responsibility for reclamation from
the Dept. of Natural Resources to Mason County through the RCW 78.44.390 provisions. Both
parties have agreed that Mason County would assume that responsibility and that WA Dept. of
Natural Resources would cancel the state permit once the notification from Mason County was
received. This request is based upon the change in scope of operations on the subject property:
the extractive operations have ceased, and some degree of on-site reclamation has proceeded.
The owners have applied for and been granted a Mason County grading permit to continue minor
grading to achieve final grades for roads and for locations where extraction had taken place, and
to complete the re-vegetation of the site and removal of noxious shrub species. The owners are
required to maintain a current county grading permit and comply with all conditions of that
permit. Any further activity on the property shall follow the current Mason County zoning and
development standards.

Dear Mr. Hartman:
This letter is to notify you that the Washington Department of Ecology(Ecology) requires you to
apply for and obtain Sand and Gravel General Permit Coverage for the Old Belfair Sand&
Gravel mine, located in Mason County(Sec. 17, Township 23 N, Range 01 W). Enclosed with
this letter is an application for coverage under the Sand and Gravel General Permit. Please
complete this application and return it to the Department of Ecology by Certified Mail with
Return Receipt within 30-days.
Sand and Gravel General Permit coverage for the Old Belfair Mine was issued to Allen Shearer
Sand& Gravel LLC (permit number WAG-50-1177). The permit was terminated on March 3,
2011, for failure to pay permit fees. As landowner, you are responsible for providing coverage
of the mine under the Sand& Gravel General Permit until the site is reclaimed.
Under the Sand and Gravel General Permit, a site is considered reclaimed when the Washington
Department of Natural Resources(DNR)has determined that reclamation has been completed,
DNR has entirely released the reclamation bond, and that local jurisdiction is satisfied, if
required. The Old Belfair Mine is currently in the process of being reclaimed under Surface Mine
Reclamation Permit No. 70-12066, as administered by the DNR. However,reclamation is not
complete and the reclamation bond has not been released.
Within 30-days of receiving this letter, please submit the complete Sand and Gravel General
Permit Application by Certified Mail with Return Receipt to:

Dear Mr. Hartman:
This letter is to notify you that the Washington Department of Ecology(Ecology) requires you to
apply for and obtain Sand and Gravel General Permit Coverage for the Old Belfair Sand&
Gravel mine, located in Mason County(Sec. 17,Township 23 N, Range 01 W). Enclosed with
this letter is an application for coverage under the Sand and Gravel General Permit. Please
complete this application and return it to the Department of Ecology by Certified Mail with
Return Receipt within 30-days.
Sand and Gravel General Permit coverage for the Old Belfair Mine was issued to Allen Shearer
Sand& Gravel LLC (permit number WAG-50-1177). The permit was terminated on March 3,
2011, for failure to pay permit fees. As landowner, you are responsible for providing coverage
of the mine under the Sand& Gravel General Permit until the site is reclaimed.
Under the Sand and Gravel General Permit, a site is considered reclaimed when the Washington
Department of Natural Resources(DNR)has determined that reclamation has been completed,
DNR has entirely released the reclamation bond, and that local jurisdiction is satisfied, if
required. The Old Belfair Mine is currently in the process of being reclaimed under Surface Mine
Reclamation Permit No. 70-12066, as administered by the DNR. However,reclamation is not
complete and the reclamation bond has not been released.
Within 30-days of receiving this letter,please submit the complete Sand and Gravel General
Permit Application by Certified Mail with Return Receipt to:

Transfer of Reclamation Responsibilities to Mason County.
Dear Mr. Skov:
Mason County Department of Community Development has been contacted by Mr. Jeffrey
Hartman, the owner of Hood Canal Land & Gravel L.P., in regard to the cancellation of his State
Reclamation Permit No. 70-12066 and the cessation of gravel operation at the property located
on Parcel Number 12317-11-00000, north of Belfair in Mason County. This process would follow
RCW 78.44.390 provisions.
Mr. Hartman and Mason County have discussed the transfer of responsibility for reclamation from
the Dept. of Natural Resources to Mason County through the RCW 78.44.390 provisions. Both
parties have agreed that Mason County would assume that responsibility and that WA Dept. of
Natural Resources would cancel the state permit once the notification from Mason County was
received. This request is based upon the change in scope of operations on the subject property:
the extractive operations have ceased, and some degree of on-site reclamation has proceeded.
The owners have applied for and been granted a Mason County grading permit to continue minor
grading to achieve final grades for roads and for locations where extraction had taken place, and
to complete the re-vegetation of the site and removal of noxious shrub species. The owners are
required to maintain a current county grading permit and comply with all conditions of that
permit. Any further activity on the property shall follow the current Mason County zoning and
development standards.

Dear Mr. Skov:
We are in receipt of a request regarding the cancellation of the State Reclamation Permit pursuant
to RCW 78.44.390. for the Gary Merlino Construction Company,Inc.operation at the Cedar
Shores Sand and Gravel Mine.
I have discussed the transfer of responsibility for reclamation from WADNR to King County in
accordance with the above referenced RCW.with the project owners and we have greed that King
County would assume that responsibility and that WADNR would cancel the state permit once
notification from King County was received.The request is based on the change in scope of the
operation at the site.Extractive operations have ceased and previously the operators sought and
received approval of a revision to the King County grading permit to allow the import of fill to
the site.This fill is being used to backfill the open pit areas and will eventually achieve a final
reclamation in exceedence of that required and approved under the State Reclamation Permit.The
operators are required to maintain a current King County Grading Permit and to comply with all
conditions of that permit until final grades are achieved and the site is totally revegetated in
accordance with the zoning and applicable standards.
