Enclosed are copies of the Inspection Report (SM-7A) and Notice of Correction(SM- 713). The SM-7A identifies items that will need some attention. Some of these items are also listed on the SM-713 that will need to be corrected. The Notice of Correction is based on things observed on 13 June 2002 and need to be completed by 7 February 2003 (60 days). A request for an extension of this deadline to achieve compliance may be submitted, but only for good cause shown. This must be done in writing, as follows: Include information on why you believe the deadline should be extended and the request should be done by 8 January 2003, addressed to Charles Turley, RP&S Assistant Region Manager in the DNR Central Region Office. The DNR will respond to requests for extension in writing, and has discretion to either reaffirm the original deadline, or establish a new deadline. Pursuant to RCW 43.05.100(2), this Notice of Correction is not a formal enforcement action and is not subject to appeal. However it is a matter of public record. At this time the Standard Performance Security is adequate at One Hundred Five Thousand Dollars ($107,000.00) for reclamation of this site as observed on 13 June 2002. Bill Leber was on-site and we informed him that the facility was still in violation of the Sand and Gravel general permit conditions. Enclosed is an inspection report that documents deficiencies with the permit. The permittee sent in an application for renewal on February 18, 1999, prior to the August 6, 1999, expiration date. Since an application for renewal was submitted before the expiration date, the permittee acquired continued coverage for the existing operations. However, the Sand and Gravel General Permit was updated on August 6, 1999, which contains new water discharge monitoring requirements and other new permit conditions. On May 10, 1999, Mason County issued a Determination of Significance and request for comments on the Scope of an Environmental Impact Study(EIS). In order to follow the State Environmental Policy Act(SEPA)process requirements, Ecology chose to delay reissuance of permit coverage. As we are all aware, the SEPA requirement for conducting an EIS study was not met by Belfair Sand and Gravel. In addition to potential expansion of the grandfathered portion of the site, a new asphalt batch plant is currently being proposed. Ecology cannot determine if portions of this site may have exceeded the original Mason County grandfathered operations. In order to regulate with the new Sand and Gravel general permit conditions, Ecology requests from Mason County what portions of operations meets county land Mr. Ron Henrickson Page 2 use requirements. Ecology proposes to reissue the coverage for the existing grandfathered operations within thirty(30) days of receipt of this letter. It became apparent during that discussion that the County did not complete SEPA review. I believe that no action beyond scoping of the original proposal occurred. I am attempting to sort through our past actions and come up with a response that addresses the asphalt proposal. I have recently been contacted by John Piertz of Department of Ecology, who stated that DOE will not issue a new Discharge permit to the gravel mine until SEPA review is satisfied. We may have to pick up the pieces here and begin a detailed review that would, in effect, stop much of the proposed new activity. Scuffy Construction to establish a new hot mix asphalt plant at the existing surface mine located at 2493 Old Belfair Highway in Mason County. On October 9, 2002, commencing at 10:00 am at ORCAA's office in Olympia, a formal public hearing will be conducted by the ORCAA Board of Directors to hear testimony regarding air quality implications of the proposed asphalt plant. PRELIMINARY DETERMINATION: The proposed asphalt plant will emit minor quantities of air pollutants including oxides of nitrogen, carbon monoxide, particulate matter, sulfur dioxide, and hazardous air pollutants. ORCAA completed a preliminary review, and has determined that emissions and air quality impacts from the proposed plant will likely comply with applicable air regulations and standards. On this basis, ORCAA's Preliminary Determination is to approve R.J Scuffy's NOC application. DOCUMENT AVAILABILITY: Copies of ORCAA's Preliminary Determination and the NOC application by R.J. Proper BMP implementation and application is required to minimize turbid stormwater runoff. Develop a management plan for controlling erosion and sedimentation which is incorporated into the Erosion and Sediment Control Plan(ESCP)-Condition S 10,p.28. 2.) Stormwater/process water ponds contained extensive sedimentation and were extremely turbid. Stormwater ponds were also dredged with sediment waste piles exposed immediately adjacent to ponds. Uncontrolled turbid stormwater resulted in on-site erosion and off-site turbid discharge. (photos 2, 4, 11, and 12) ➢ VIOLATION OF CONDITION S9 AND S10 and RCW 90.48.080 Recommendation: Design and construct detention pond(s) that meets the 1Oyear/24 hour design storm to detain stormwater runoff from mined/excavated area.Develop a time schedule for the planning, designing and constructing phases of the detention ponds. Develop a management plan for sediment waste and residue at the facility,which is incorporated into the Stormwater Pollution Prevention Plan(SWPPP)-Condition S9,p. 25. 3.) Stormwater flowing on-site is eroding ditches along the access roads and contributing to additional off-site turbid discharge. Recommendation: A professional engineer is required under WAC 173-240, for the submission of plans and reports for construction of industrial wastewater facilities. This includes calculating stormwater runoff characteristics and the design/construction of stormwater or process water detention ponds. See May 22,2002 NOC for additional submittals not yet received. 3.) Discharge Monitoring Reports (DMRs) submitted to Ecology on 6/25/02. DMRs contain several violations to effluent limitations.
