Though the proposed fee schedule outlines some increases and new fee types, there are also some fee decreases proposed based on a re-evaluation of time spent on each permit type. Some of the new fee types are already indicated within our development regulations but have never been added to the fee schedule.A few new fee types were added such as the Cottage Industry fee in order to provide citizens with a more thorough review of their proposal before they implement a use in an area where it might not be allowed. This will potentially save the applicant investment costs and enforcement actions in the future. STAFF REPORT ~` Applicant Proposal:The Community Development Department is updating the Planning Program Fee schedule to more accurately reflect the type of work the planning department performs as well as the time taken to accomplish that work. The Community Development Department is requesting updates to the current Planning Program fee schedule to reflect more accurately the projects and review the Planning Division performs. ANALYSIS The Department reviewed planning fee schedules from comparable counties and a few adjacent counties for the years 2022 and 2023, as well as reviewed with current land use planners the time required for permit reviews and inspections. The hourly rate that the department is currently charging was reviewed against comparable counties, and was found to be on the lower end. Even with raising the hourly rate by$10, the new proposed rate of$100/hr is still on the lower end of the comparable counties. 615 W.Alder Street ♦ Shelton,Wa 98584 1 360.427.9670 ext. 352 1 ©masoncountywa.gov MC Case: Department Generated As seen from the draft fee schedule,there are some permit review fees that are proposed to stay the same, as they match up with comparable counties; some permits are very rarely applied for and thus not enough information on current review times is available to refine the fee further. There are a few review types that have been added to the fee schedule, some of these reviews have been performed by the department for several years but no fee has previously been charged.These review types are outlined in the code as requiring fees and some have the same time requirements as other reviews that we do charge for. The following are permits/reviews that are new to the schedule: Shoreline Meeting: Proposed $300 fee. This is similar to a site pre-inspection in which the planner visits the subject site, may coordinate with state and federal agencies on permitting requirements, and includes research and code analysis, as well as report writing. Common Line Mitigation Plan Review: Proposed $300 fee. This review has been required by the Resource Ordinance (RO)and Shoreline Master Program since the adoption of amendments in 2017. The RO states that the HMP review fee would be required for review of the CLMP. Due to the initial difficulty the department had with getting applicants to submit and the confusion with the requirements of a CLMP, the department did not implement a fee. Now that the department has developed a clearer understanding of the CLMP requirements and provided tools, such as the online Mitigation Plan planting area and plantings calculator, it is proposed that the $300 fee now be charged. Letter of Exemption from SEPA:The department has been providing these letters for a long time without charging.This letter is required for applicants to provide to the Department of Fish and Wildlife for the purposes of acquiring a Hydraulic Permit Approval.The time taken to complete this task depends on the complexity of the project and review against SEPA exemptions. Belfair Planned Action Review: Proposed $500. This is a new review based on the adoption of the Belfair Planned Action Ordinance and EIS in 2022. Cottage Industry Permit Review: Proposed $200. The development code(zoning code) outlines the criteria for cottage industry. The department gets many calls and in office inquiries on this topic. Creating a review for a business that goes beyond what a home occupation would entail allows the department to avoid problems down the road. Development and uses that exceed the cottage industry criteria may need a special use permit or may be unallowed in a rural residential zone. This review provides the department and the applicant an extra layer of assurance that a "use" is allowed. Planned Unit Development: Proposed $3000 preliminary and $500 final.The department amended the code to include a Planned Unit Development review process, these changes were adopted at the end of 2022.These fees are comparable to the city of Shelton's fees for the same process. 615 W.Alder Street Shelton,Wa 98584 2 360.427.9670 ext. 352 ©masoncountywa.gov MC Case: Department Generated Zoning Verification Letter: Proposed $150.Also called lender letters. The department will get requests from the public and entities trying to verify information for the purposes of lending. This letter will require parcel and code research. Many other jurisdictions provide such letters and include a fee. Decreased Fees Several permits were adjusted, after review by current land use planners,to more accurately reflect time spent on the permit. Some of these adjustments were increases, but some also decreased due to process simplification; these reviews are under the Land Segregation portion of the fee schedule. Other notable proposed decreases include rezones,flood damage prevention permits, Forest Practices Moratorium Waivers, as well as Hearing Examiner appeals. Though the proposed planning program fee schedule includes new permits and fee increases, it is more balanced due to several fee decreases and more accurately reflects the time spent on particular reviews and permits. Attachments Document from Agate Loop Neighbors Group The violations at 611 Daniels and 1590 Beaver remain uncorrected. 611 Daniels has failed to remove garbage and junk vehicles. At the May 7 meeting, Mr. Tracy said that staff had observed a person or persons removing vehicles and cleaning up trash. As of today, our neighbors still see that nothing appears to have changed. In fact, shortly after the county posted the sign on the 611 Daniels property, the sign at the 1590 Beaver property was torn down, and squatters have been observed migrating to the Beaver property. The signage at 611 Daniels has also been removed. A call was placed to the Health Department, and the caller was told the department would have to "start over." What does that mean? Mr. Neatherlin asked Mr. Tracy to report back, and we would like to hear from him again. Ecological Impact: Prior to the May 7 meeting, Mr. Tracy indicated that he had contacted Ecology, because Ecology is the department with jurisdiction to test for the presence of toxins such as gasoline, oil, transmission and other fluids. The Salmon Restoration/Culvert project at the end of Daniels road was costly for the county, yet waste from 611 Daniels gets into Uncle John's creek through the culvert. Please note that this testing, if it has not already been done, needs to happen after a rain. What action have they taken since? Building a Coalition or Task Force: Sheriff Spurling indicated that a coalition was being built to include Commissioner Trask, Health Department, law enforcement and other entities. He also indicated that "escalating enforcement action" was being taken, and that there is an ongoing investigation now that the infant's death has given them a foot in the door. How far in the door?! Our neighbors would appreciate an update on what actions have been taken since May 7? Concern for the Welfare of the Children: Is the surviving child still in protective custody or has he been returned to the mother? Are there other children living on the premises? Who made the decision to release Layla Giacchino to her family knowing the child had been born with narcotics in her system? Increased Criminal Activity: On June 5-6 multiple vehicle were broken into or dismantled and contents stolen on Daniels Road. We were told there were perhaps as many as 8-9 different residences affected. Also, I received a personal call from the Sheriffs office on April 2 regarding my property "just wondering if anyone is supposed to be here right now," and given a case number. When I called back the person I spoke with couldn't clarify what had happened. Agate Loop Neighbors has doubled in size since I last came here who are working to spread awareness about the challenges we face in our neighborhood. PURPOSE Pursuant to RCW (Revised Code of Washington) 90.72-Shellfish Protection Districts, the Mason County Board of Commissioners (MCBOCC) adopted Resolution No. 2021-023 establishing one Shellfish Protection District in the cony to address non-point pollution sources affecting shellfish harvest areas. The Mason County Clean Water District Advisory Committee (hereafter referred to as the Committee) was established by MCBOCC via Resolution No. 2021-52. The Committee is a group of citizens, tribal and governmental organizations, businesses, and non-profits to advise the MCBOCC in its implementation of its Clean Water District activities. The Committee will work towards the following objectives: Provide coordination between multiple governmental jurisdictions, including Tribes, public and private groups that share an interest in public health and environmental management of the water quality of Mason County. Provide recommendations to the MCBOCC and Mason County Public Health and Human Services (MCPH) on use of annual parcel fees collected. Provide guidance to the MCBOCC and MCPH in the development of ordinances, policies, procedures, programs, and priorities that will protect public health, preserve water quality, protect Tribal Treaty Rights of access to clean fish and shellfish, and be consistent with state and local regulatory mandates. Provide perspective for the MCBOCC and MPCH to assure that surface water quality ordinances, policies, procedures, priorities and plans are understandable and functional. Provide support for implementation of public education and public engagement strategies and opportunities for residents to learn and participate in various programs and projects related to surface water quality. II. REGULAR MEETINGS The Committee will meet regularly, not less than four (4) times per year. Dates and times will be set during the first meeting of the year. Special meetings can be Page 1 of 4 called by the majority of the Committee. The location for each meeting will be selected by MCPH. III. RULES OF ORDER Committee proceedings will be conducted informally by consensus, but formal recommendations shall be voted on by the Committee members. In cases where more formal proceedings are necessary, the meetings will be conducted according to the latest edition of Robert's Manual of Parliamentary Rules. IV. AMENDMENTS Recommendations for amendments to these by-laws require a simple majority vote of the Committee members present at any regular meeting of the Committee, if notice of the proposed amendment is contained in the previous and current agendas. All proposed amendments must be approved by the MCBOCC. V. QUORUM A quorum will consist of 50%of the active members in attendance (minimum 4 members) and will have authority to transact Committee business. VI. MEMBERSHIP A. Committee membership shall follow Mason County Resolution 2021-052 adopted by the Board of County Commissioners on August 31sr 2021: • One representative of the Mason County Board of County Commissioners, non-voting unless in the event of a voting tie • Three citizens from (residing within) the Clean Water District • One representative from Mason Conservation District • One representative from the Squaxin Island Tribe • One representative from the Skokomish Tribe • One representative from the City of Shelton • One representative of the Commercial Shellfish Growers B. Selection of Members: All citizen positions will be appointed by the MCBOCC according to the current Boards and Commissions Handbook. Other representative term positions will be selected by the organization itself. Knowledge of and experience in water quality is preferred but not required. C. Terms of Membership: All three citizen positions will serve a three-year term except for the first year, which follows the approved resolution to achieve staggered terms. The officers of the Committee shall include a Chair and Vice-Chair. The Chair and Vice-Chair may be removed by a simple majority of the Committee. B. The Vice-Chair shall preside over all meetings at which the Chair is not in attendance. Should both the Chair and Vice-Chair be absent, an Acting Chair may be selected by the members in attendance. D. The Chair shall preside over all meetings, keep order, be fair and ensure that all members have an opportunity to participate. E. The term of the office for Chair and Vice-Chair shall be one (1) year. The Chair and Vice-Chair may not serve more than two (2) consecutive terms. VIII. ROLES & RESPONSIBILITIES A. I I The vacation areas in question have likely already been vacated as a matter of law under what is called the ancient right of way statute, RCW 36.87.090. Due to amendments 12 made to the original statute in 1909, a court has ruled that he statute generally operates to vacate roads that were dedicated prior to March 11, 1904 and remained unused for a 13 period of at least five years. See Gillis v. King County, 42 Wn.2d 373 (1953). The 14 Engineer's Report, Ex. 1, notes that the vacation area was dedicated as a County road in 1889 and that the County has no record of it ever being opened. As such,the vacation 15 area meets the criterion for vacated as a matter of law under RCW 36.87.090. Approval of the vacation by the County Commissioners will serve to clarify for County records 16 that the vacation area is not owned by the County as right of way. 17 Even though the vacation area has likely already been vacated as a matter of law under 18 RCW 36.87.090, there is always the possibility that the County could have reacquired title as right of way by prescription. RCW 36.75.070 provides that all public highways 19 not designated as state highways that are maintained by the County for a period of seven years shall become county roads owned by the County. Highline School Dist. 20 No. 401 v. Port of Seattle, 87 Wn.2d 6, 548 P.2d 1085 (1976). County staff confirmed 21 during the hearing that the vacation area does not meet the criteria for easement by prescription. The parcels adjoining the vacation area are served by other private roads 22 and would not become landlocked by the proposed vacation. No other lots would become landlocked as well. 23 TESTIMONY 24 25 Tina Schaefer, Senior Right of Way Agent for Mason County, summarized the engineer's report. In response to Examiner questions Ms. Schaefer clarified that the vacation would not landlock any lots. All lots potentially accessed by the vacation area are currently accessed by private maintained roads. This classification 20 means that the vacation area has been vacated as a matter of law under RCW 36.87.090. As such the vacation area has no ownership value to the County and no associated duty 21 for vacation petitioners to provide compensation. 22 3. Utility of Vacation Area.As noted in the engineer's report,Public Works staff have 23 determined that the proposed vacation area is not necessary for future use in the County's road system. The vacation area has likely already been vacated as a matter 24 of law for the reasons identified in the Summary portion of this Decision and supported by Finding of Fact No. 2. No lots will be landlocked as a result of the proposal. 25 4. Petition Includes Majority of Abutting Owners. As shown in Ex. See Gillis v. King County, 42 Wn.2d 373 (1953). The 14 Engineer's Report, Ex. 1, notes that the vacation area was dedicated as a County road in 1889 and that the County has no record of it ever being opened. Approval of the vacation by the County Commissioners will serve to clarify for County records 16 that the vacation area is not owned by the County as right of way. 17 Even though the vacation area has likely already been vacated as a matter of law under 18 RCW 36.87.090, there is always the possibility that the County could have reacquired title as right of way by prescription. RCW 36.75.070 provides that all public highways 19 not designated as state highways that are maintained by the County for a period of seven years shall become county roads owned by the County. Highline School Dist. 20 No. 401 v. Port of Seattle, 87 Wn.2d 6, 548 P.2d 1085 (1976). County staff confirmed 21 during the hearing that the vacation area does not meet the criteria for easement by prescription. The parcels adjoining the vacation area are served by other private roads 22 and would not become landlocked by the proposed vacation. No other lots would become landlocked as well. 23 TESTIMONY 24 25 Tina Schaefer, Senior Right of Way Agent for Mason County, summarized the engineer's report. She noted that all lots potentially accessed by the vacation area are currently accessed by private maintained roads and that the County has no record of the vacation area ever being opened as a County road. This is stable funding that we will receive every year along with our other FPHS funding from the State Department of Health on a July-June schedule. We assessed the Environmental Health Program and determined that we need to create a new regular, full time,non-represented position to maximize the benefits of this funding. We propose creating a new Environmental Health Supervisor position which will be responsible for supervising the Environmental Health Specialists and overseeing the day-to-day operation of the environmental Health Programs. This will allow the Environmental Health Manager to spend more time working on policy, code, and pursuing grant funding to provide additional services to the people of Mason County. Human Resources and Public Health have worked collaboratively to develop the attached position description. Our consultant completed an analysis of our comparable counties and recommends this position be placed at Non-Represented Range 33. Implement policies and facilitate training to provide clear guidance to staff and ensure compliance with federal, state, and local regulations. ESSENTIAL FUNCTIONS: (Any one position may not include all the duties listed nor do the listed examples include all tasks which may be found in positions of this class.) Responsible for assigning, supervising, training, and evaluating the work performance of assigned staff. Review progress and carry out changes in priorities and schedules to ensure services are provided in an efficient and timely manner. Serve as acting EH Manager when the Manager is unavailable. Implement established policies, procedures, work rules, and performance standards to ensure the efficient and effective operation of assigned programs in compliance with county standards and federal, state, and local laws. Investigate and resolve personnel issues when appropriate. Analyze data related to assigned programs; prepare reports, communicate effectively both orally and in writing to staff, EH Manager, Health Officer, and Director. Communicate with the public and represent the department in a variety of public settings locally, regionally, and state-wide. Provide input to the EH Manager to review and assess assigned program budget. Evaluate staffing needs and time commitment relative to current fees and recommend changes to fees in response to changing regulations and community needs. Coordinate assigned EH program activities with other County departments and outside governmental and community agencies and organizations. Maintain interagency cooperation with all regulatory agencies. Provide leadership to assigned EH programs. Provide input to EH Manager for development of local plans and policies. Support County Boards and Committees by providing leadership, consultation, analysis, technical advice, and communication related to EH programs. Represent the department in the absence of the EH Manager. Review permits and ensure program review and quality improvement in assigned programs. Est. 12.2023 Oversee enforcement activities for all applicable federal, state, and local rules pertaining to assigned EH programs as authorized. Implement and maintain data systems and records that provide proper evaluation, control, and documentation of assigned operations. Support the EH Manager during EH emergency response to declared emergencies within the boundaries of Mason County. May be asked to assist with other public health emergency situations and train public health staff. Direct the resolution of inquiries, complaints, problems, or emergencies affecting the availability or quality of services. Respond to sensitive or complex inquiries or service complaints. Regular, reliable, and punctual attendance. Other duties as assigned. OTHER JOB DUTIES: • May be required to obtain additional education as required to conduct business functions. MINIMUM QUALIFICATIONS:_(Any equivalent combination of education and experience which provides the applicant with the knowledge, skills, and abilities required to perform the job may be considered.) • Bachelor's degree in public health, environmental or natural science, public administration, or a related field. • Four (4) years of progressively responsible experience. • One (1) year of supervisory or lead experience. • Ability to obtain Registered Sanitarian (RS) designation from WSBRS or REHS certification from NEHA within twelve (12) months of hire. PREFERRED QUALIFICATIONS: • Master's degree in public health or a related field. • Registered Sanitarian designation from WSBRS or REHS certification from NEHA Est. 12.2023 LICENSES, CERTIFICATES, AND OTHER REQUIREMENTS: Valid Washington State Driver's License WORKING CONDITIONS: (The physical demands described are representative of those that must be met by the employee to successfully perform the essential functions of this job.
