Dear Ms . Boothe,
In response to your letter dated September 6, 1991, Mason County
would be agreeable to a meeting as requested with one condition,
that the operator also be present at the meeting. However,
Mason County will not re-evaluate this situation until the
differences between the landowner and the operator are resolved and
all fines are paid and mitigation measures are completed.
The operator, who was present at the site inspection conducted on
Thursday, August 15 , 1991, indicated that the landowner instructed
him to do the work without the required permits . Subsequently, it
was indicated by you that Mr. Likes did not authorize any of the
un-permitted activities that occurred on his property which leaves
the matter unsettled. It is the interpretation of the county that
the responsibility to obtain required permits rests with the
landowner.
It is the policy of Mason County to exercise its authority under
RCW 76 . 09 . 060 and enact a development moratorium of not more than
6 years from the time of occurrence as per the following criteria:
1 . Owner or operator fails to apply for a Forest Practices
Application (cutting permit) from the Department of Natural
Resources and where a substantial impact on the environment
results from the cutting activities .
2 . Owner or operator fails to file a conversion statement with
the Forest Practices Application (cutting permit) from the
Department of Natural Resources and where substantial impact
on the environment results from the cutting activities .

Due to the failure of the operator or the landowner to obtain
required permits, compliance with the State Environmental Policy
Act was circumvented resulting in significant impacts to the
environment . Mason County had no opportunity to fulfill the
requirements of the State Environmental Policy Act and protect
resources with public interest . Therefore, a development
moratorium for Parcel # 42018-24- 00030 , SW SE NW Section 18 ,
Township 20N, Range 4WWM, owned by Don Likes will remain in effect
until further notice . Any activities which violate this moratorium
could result in further action taken by the county.
I can be available for a meeting on one or two days notice. Please
notify me of the dates DNR and WDF are available to attend. If you
have any further questions please contact me.
