Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Kell McAbov Land Use Planner Mason County Planning Department 8/30/2016 Page 1 of 3 SP12016-00074 Site Inspection 8/30/2016 Case No.: SP12016-00074 Comments: Pre-inspection for BEUCHEL for the purpose of determining the development potential for three lots in the Union Rural Activity Center. MCC=Mason County Code. Parcel # 32232-55-00032: This shoreline parcel is zoned Rural Residential 2.5. This lot can be developed as a residential lot, assuming proposed structure can meet all setbacks. Minimum setbacks through an administrative variance (MCC 17.05.034 C. & D.) is 5 feet for side yards, 10 feet from front and rear yards. Accessory Dwelling Units must meet the requirements of MCC 17.03.029 and the Shoreline Master Program (SMP) 17.50.050 Accessory Living Quarters. Created on fill, the parcel is bordered by a bulkhead on the north and east. The bulkhead represents the Ordinary High Water Mark (OHWM). Per the SMP the minimum setback for the Urban designated shoreline is 15 feet. However, the Mason County Resource Ordinance has a more restrictive minimum setback of 35 feet, which includes a 20 foot buffer and 15 foot building setback. Given the constrained lot size, a Resource Ordinance Variance would be required for future development. If development is proposed less than 15 feet from OHWM (on either north or east side) then a Shoreline Variance would also be required. If development is proposed less than 10 feet from the edge of SR 106 Right-of-Way, then a Development Regulations Variance would also be required. Height limit is 35 feet. Parcel # 32232-55-00040 and 32232-55-00041: These two adjacent shoreline parcels are each zoned Rural Commercial 3. Allowed uses include the following: Convenience/general store, Retail, Restaurant, Small office, Laundry, Professional services, Personal services, Public meeting space, Nursery, Public facilities - Post office/Fire station/Fish hatchery/Library/Ranger station, Church, Local community and recreation centers, Lodging facilities, including motels, RV parks, Campgrounds and Bed and breakfast, Marina - Sales, Service and Storage, Auto service and repair, Medical/Dental clinic, Animal clinic, Winery, Commercial/government operated day care, Single-family residential accessory use or apartment. Residential use is only allowed in this zone as an accessory to the primary commercial use. Height limit is 35 feet. 8/30/2016 Page 2 of 3 SP12016-00074 i L Site Inspection 8/30/2016 Case No.: SP12016-00074 The parcel ending in # 40 has an existing 6,000 square foot legal non-conforming structure operating as a conforming use. The footprint of this structure is grandfathered. Any future development proposal cannot increase the non-conformity, and the proposed use must conform to the zoning allowances as described above. The parcel ending in # 41 is undeveloped and can be developed in regard to setbacks similarly to parcel ending in # 32 with exception to OHWM located on the north and west sides of the property. Development proposed on this lot will likely require Variances as described above. Rezone: If the proposal is to develop the Rural Commercial 3 parcels residentially, then a rezone request will be required (Rural Residential 2.5). Rezone application (page 2-3 only) can be found HERE. Please note than rezoning from RC3 to RR2.5 is considered a downzone. Criteria 4-8 do not apply. Boundary Line Adjustment: A BLA may be desired between lots ending in # 40 & 41 in order to increase the size of parcel ending in # 41 making it more developable.
