right-of-ways. Any proposed structure within 25 feet of a county

and comment . "

ALDERNEY STREET IN UNION, WASHINGTON
MIKE:
A REQUEST WAS RECEIVED FROM WALT HICKS TO CONSTRUCT A BUILDING
LESS THAN 10 FEET FROM THE EASEMENT LINE OF ALDERNEY STREET.
PUBLIC WORKS REVIEWED THE REQUEST AND INDICATED THAT THERE WAS AND
ISSUE REGARDING THE VACATION OF THE STREET.
THE COMMISSIONERS APPROVED THE VARIANCE WITH THE CONDITION
THAT THE P.A. OFFICE REVIEW THE REQUEST AND DETERMINE IF THE STREET
HAD BEEN VACATED; IF NOT, HICKS WILL NEED TO START THE PROCESS OF
VACATION IN ORDER TO RECEIVE HIS VARIANCE APPROVAL.

VARIANCE REQUEST
STRUCTURES SETBACK (S) FROM PROPERTY LINE, EASEMENT LINE OR RIGHT-
OF-WAY.
LETTER OF HARDSHIP
When requesting a variance to Section 14 . 08 . 180 of the amended
Mason county building Code, the applicant must submit a letter
indicating why it is necessary to encroach into the five foot
setback established by the code.
A hardship must be demonstrated, i .e. , constraints of citing
a structure because of topography, location of septic_, location of
accesses, or other physical features.
The purpose of the ordinance is to maintain a ten (101 ) foot
separation between structures for fire protection and access.
When requesting a neighbor to agree to the infringement of the
five foot setback, the neighbor is agreeing that any structure that
is proposed on his/her property must set back farther than five
feet in order to maintain a ten foot separation.
When requesting a variance from an EASEMENT, only the owner is
required to sign the setback form provided indicating he/she is
taking the responsibility of the structure near an easement.
In no case will a variance be granted to place a structure
within an easement .

STRUCTURE SETBACKS FROM EASEMENT LINE
14.08.180 UBC Section 503 .1 Building Setbacks U.B.C. 503 .1 is adopted and amended
by adding a new sentence: "All structures greater than 30" in height shall be
set back five (5) feet or more from any easement or property line from the
closest projection and ten (10) feet from county and state road right-of-way
shall be subject to Public Works review and comment.
A variance may be granted to said line if a hardship can be demonstrated. This
document must be recorded with the Mason County Auditor.
The legal description of the property owner escribed (1) is:

RE; VARIANCE REQUEST
Dear Walt,
The County Commissioners approved your variance request with
the following conditions :
1 . The variance request is to be reviewed by the Prosecuting
Attorney' s office to determine if the road has been
vacated.
2 . If the road has not been vacated, your request is approved
on the condition that you begin the process of vacating
Alderney St .
Enclosed is the information received from Public Works . You
may want to track these conditions by contacting Mike Clift, Deputy
Prosecuting Attorney at 427-9670, extension 298, or Jay Harmon from
Public Works Department, 427-9670, extension 456 .
There seems to be an issue with the vacation of Alderney
Street that needs to be rectified prior to approval of your
request .
