Case: SHR2013-00008
Applicant: Maureen Woodcock.
Notice is hereby given that Maureen Woodcock, who is the applicant for the
above-referenced Mason County Shoreline Conditional Use Permit, has been
granted that Shoreline Conditional Use Permit for a proposed bed and breakfast
land use. The request was reviewed on September 24, 2013 by the Mason County
Hearing Examiner and approved with conditions pursuant to the Mason County
Title 17.50 Shoreline Master Program Use Regulations, specifically for Commercial
Use activities and standards. The proposal was exempt from SEPA review.
This is a final County decision. No further appeals to the County are available.
Appeal of this decision may be made to the State Shorelines Hearing Board as
regulations apply. ►t is the appellant's responsibility to meet all legal
requirements of any appeal process.
Time Limit for Action. Per the Mason County Code Title 15 - Development Code - No
permit authorizing construction shall extend for a term of more than five years. If
actual construction of a development for which a permit has been granted has not
begun within two nears after the approval, the Hearing Examiner shall review the
permit and upon a showing of good cause, may extend the initial two year period by
permit for one year. Otherwise, the permit terminates; PROVIDED that no permit
shall be extended unless the applicant has requested such review and extension
before the Hearing Examiner PRIOR to the expiration date. Work on approved project
must begin by October 2015. This permit expires October 10, 2018.

6 (SHR2013-00008) OF LAW AND FINAL DECISION

8 INTRODUCTION
9 The applicant requests approval of a shoreline conditional use permit for a bed and
breakfast to be located within an existing residence within the Union Rural Activity Center
10 along Hood Canal. The application is approved subject to conditions.
11 TESTIMONY
12 Allan Borden, senior planner, stated the application is for a shoreline conditional use
13 permit to change the use of an existing residence to a 4-bedroom bed-and-breakfast with
one bedroom for the owner. The property is located in the union-rural activity center
14 and is along an urban-commercial shoreline. Specifically, the site is on the westside of
state route 106 with Hood Canal on the eastside. The property already has a residential
15 structure, a garage, and a carport. The staff report notes that there is at least 1 IOft of
16 vegetation buffers along the portion of the site adjoining Big Ben Creek. This buffer
will not be impacted by the development. The proposal was exempt from SEPA
17 review. All notice procedures were followed. The new use is compatible with all
existing, surrounding uses. Parking will be located on the side of the residence away
18 from the shoreline. The building is 32ft in height which is below the height limitation of
35ft. A bed-and-breakfast use is compatible with the SNIP. There are no adverse
19 impacts expected from the proposal. The staff report lists six conditions of approval
20 recommended by staff. The conditions focus on consistency with the SMP, fire
protection, proper ingress and egress, erosion control, and utility use and maintenance.
21 In regard to parking, one space per bedroom is required. For this proposal, the County
requires six spaces. There are six spaces between the residence and the road. In regard
22 to signage, a typical sign for a cottage industry is 12sgft. As long as it meets this size
23 requirement, staff would not object to a sign.

3 FINDINGS OF FACT

5 1. Applicants. The applicant is Maureen Woodcock
6 2. Hearing. The Hearing Examiner conducted a hearing on the subject
application on September 24, 2013 at 1:00 p.m., in the Mason County Commissioners
7 Meeting Chambers.
8 Substantive:
9 3. Site/Project Description. The applicant requests approval of a shoreline
10 substantial development permit and conditional use permit for a bed and breakfast to
be located within an existing residence within the Union Rural Activity Center along
11 Hood Canal. The applications are approved subject to conditions.
12 The application involves converting a two story, five bedroom, 4,400 square foot
existing residence into a four bedroom bed and breakfast with an additional bedroom
13 for the owner. The existing residence is less than 35 feet in height.

The site is a fairly flat upland area near Dalby Road that drops 8 to 10 feet from the
15 Dalby Road area to the ordinary high water mark of Big Bend Creek and the Hood
Canal shoreline. Big Bend Creek meanders along the northwest comer of the
16 property along with associated wetlands. Past grading and building development
17 have left a 110 foot buffer along Big Bend Creek.
18 Dalby Road adjoins the property to the east and SR 106 cuts across the northeast
corner of the subject property. Hood Canal is located on the other side of SR 106.

4. Characteristics of the Area. Commercial development is located to the
20 north and northeast, composed of a restaurant and some retail businesses. There are
21 residences farther to the northeast along Dalby Road and along SR 106 and the
shoreline of Hood Canal. The staff report notes that water dependent recreational
22 opportunities are available along the Hood Canal shoreline.
23 5. Adverse Impacts. There are no significant adverse impacts associated
with the proposal. The proposal does not involve any exterior structural alterations
24 and as it is a residence it is similar in design to existing homes in the vicinity and is
25 compatible with surrounding commercial uses. The existing home does not adversely
affect any views of surrounding properties. Since the home is located in a wooded
upland site, it does not adversely affect views from adjoining roads or public waters.

Since the proposal involves no exterior alterations to the existing residence, no
1 adverse impacts to environmental resources are anticipated, especially since the on-
site creek and its wetlands is already protected by a 110 foot vegetative buffer and the
home is setback from Hood Canal by 120 feet. Staff have found existing parking,
3 located 100 feet from Hood Canal, to be adequate for the proposed use. The staff
report anticipates that the proposal will not generate any more noise than that
4 typically associated with residential uses and noise impacts will be mitigated by
existing vegetation that screens the home from the residential uses in the vicinity.
5 The only lighting added to the proposal is apparently security lighting and the impacts
6 of this lighting will be mitigated by a condition requiring that the security lighting be
shrouded or directed down to structure doors. The existing home is already served by
7 water and septic, which staff have found to be adequate for the proposed use. As a
use within an existing building, the proposal will not interfere with any public use of
8 the shoreline.
9 CONCLUSIONS OF LAW

Procedural:

1. Authority of Hearing Examiner. MCC 15.03.050(9) authorizes the
l2 Examiner to review and issue a final decision regarding shoreline conditional use
13 permits.
14 Substantive:
15 2. Shoreline Designation. Urban Commercial.
16 3. Permitting Criteria. The project classification table in MCC 17.50.050 requires a
17 conditional use for non-water dependent commercial uses proposed for waterfront lots.
It is unclear from the record whether Big Bend Creek is a shoreline of the state that
18 triggers the conditional use criterion, or whether the subject lot traverses SR 106 and
fronts Hood Canal. In any event, it is uncontested that the property requires a
19 conditional use permit. MCC 17.50.080 governs the criteria for approval of the
shoreline master program conditional use permits. One of the conditional use criteria
20 require consistency with applicable shoreline policies and use regulations. All
21 applicable conditional use criteria and shoreline use policies and regulations are
quoted below and applied through corresponding conclusions of law.

23 Chapter IX MCCP, Commercial Development Policy No. 1: Commercial
development on shorelines should be encouraged to provide physical and visual
24 access to the shoreline, and other opportunities for the public to enjoy the shoreline.
25 4. The bed and breakfast provides for views of Hood Canal and Big Bend
Creek. The proximity of the bed and breakfast to commercial uses to the north

provides further opportunities for enjoyment of the shoreline by bed and breakfast
1 patrons. The staff report notes that water dependent recreational opportunities are
2 available along the Hood Canal shoreline.

concepts which include open space and recreation should be encouraged in
4 commercial developments.
5 5. The staff report notes that water dependent recreational opportunities are
6 available along the Hood Canal shoreline. Buffering along Big Bend Creek provides
for visual open space.

Chapter IX MCCP, Commercial Development Policy No. 3: Commercial
8 development should be aesthetically compatible with the surrounding area.
Structures should not significantly impact views from upland properties, public
9 roadways or from the water.
10 6. As determined in FOF No. 5, the proposal does not adversely affect any
11 views and it is aesthetically compatible with the surrounding area.
12 Chapter IX MCCP, Commercial Development Policy No. 4: The location of
commercial developments along shorelines should insure the protection of natural
13 areas or system identified as having geological, ecological, biological or cultural
14 significance.
15 7. As determined in FOF No. 5, since the proposal involves no exterior
alterations to the existing residence and there is significant separation from all
16 environmental resources, no adverse impacts to environmental resources are
17 anticipated.
18 Chapter IX MCCP, Commercial Development Policy No. 5: Commercial
development should be encouraged to be located inland from the shoreline area
19 unless they are dependent on a shoreline location. Commercial development should
be discouraged over-water or in marshes, bogs, swamps and flood plains.

21 8. The proposal is located inland from the shoreline area as contemplated in
the criterion above. As determined in FOF No. 5, the proposal is located 120 feet
22 from Hood Canal and 110 feet from the on-site creek. Further, since the proposed use
is relatively benign and will be in an existing structure, this is one circumstance were
23 some proximity to the shoreline is warranted.
24 Chapter IX MCCP, Commercial Development Policy No. 6: New commercial
25 development in shorelines should be encouraged to locate in those areas with existing
commercial development that will minimize sprawl and the inefficient use of shoreline
areas.

1 9. As determined in FOF No. 4, the proposal is located in an area with
2 existing commercial development.
3 Chapter IX MCCP, Commercial Development Policy No. 7: Parking facilities
should be placed inland, away from the immediate water's edge and recreational
4 beaches.
5 10. The parking facilities are located 100 feet from the Hood Canal shoreline.
6 Chapter IX MCCP, Commercial Development Policy No. 8: Commercial
7 development should be designed and located to minimize impacts of noise and/or
light generated by the development upon adjacent properties. Commercial
8 developments which generate significant noise impacts should be discouraged.
9 11. As determined in FOF No. 5, no significant noise impacts are anticipated
10 for the proposal.
11 MCC 17.50.060 (Commercial Use Regulation No. 1): The County shall utilize the
following information in its review of commercial development proposals:

• Nature of activity;
13 Need for shore frontage;
14 Special considerations for enhancing the relationship of the activity to the
shoreline;
15 • Provisions for public visual or physical access to the shoreline;
• Provisions to insure that development will not cause severe adverse
16 environmental impact;
17 Provisions to mitigate any significant noise impacts; and
• Provisions to mitigate light or glare impacts.

12. All of the factors above have been assessed to determine that the proposal
19 will not create any significant adverse impacts in FOF No. 5 and also that the use is
appropriately located according to the shoreline commercial policies previously
20 assessed.
21 MCC 17.50.060 (Commercial Use Regulation No. 2): Commercial development
22 may be permitted on the shoreline in the following descending order of priority:
water dependent, water related and water oriented. Non-water related, non-water
23 depending and non-water oriented developments in an urban and rural environment
may be permitted by substantial development permit when: the parcel of land to be
24 developed is a minimum of 100 feet from OHWM, and is located on the up-line side of
25 a public roadway, railroad right-of-way or government controlled property.

13. The proposal is water oriented and appropriate for its location given that it
1 will be in an existing structure in an area characterized by commercial development.
2 MCC 17.50.060 (Commercial Use Regulation No. 3): Parking and loading areas
3 shall be located well away from the immediate waters'edge and beaches, unless there
is no other practical location for parking. Perimeters of parking areas shall be
4 landscaped to minimize visual impacts of the shorelines, roadways and adjacent
properties subject to approval by Public Works and/or Department of Transportation.
5 Permit applications shall identify the size, general type and location of landscaping.
6 Design of parking loading areas shall insure that surface run-off does not pollute
adjacent waters or cause soil or beach erosion. Design shall provide for storm water
7 retention. Parking plans shall be reviewed by Mason County Department of Public
Works for compliance with applicable County Ordinances. Creation of parking areas
8 by landfilling beyond the OHW mark or in biological wetlands is prohibited.
9 14. As designed and conditioned.
10 MCC 17.50.060 (Commercial Use Regulation No. 4): Those portions of a
11 commercial development which are not water dependent are prohibited over the
water.

13 15. No part of the project is proposed over water.
14 MCC 17.50.060 (Commercial Use Regulation No. 5): Water supply and waste
facilities shall comply with the strictest established guidelines, standards and
15 regulations.
16 16. The existing residence is already served by adequate sewer and water.
17 MCC 17.50.060 (Commercial Use Regulation No. 6): New commercial
18 developments shall be located adjacent to existing commercial developments
whenever possible.

17. The proposal is not a new commercial development and is adjacent to
20 existing commercial development.
21 MCC 17.50.060 (Commercial Use Regulation No. 7): New or expanded structures
22 shall not extend more than 35 feet in height above average grade level.
23 18. The existing residence is less than 35 feet in height.
24 MCC 17.50.060 (Commercial Use Regulation No. 8): Commercial developments
25 adjacent to aqua-culture operations shall practice strict pollution control procedures.

19. There is nothing to suggest that the project is adjacent to an aqua-culture
1 operation.
2 MCC 17.50.060 (Commercial Use Regulation No. 9): Commercial development
shall be located and designed to minimize noise impacts on adjacent properties.
4 20. As previously discussed, there are no significant noise impacts associated
with the proposal.

6 CONDITIONAL USE PERMIT CRITERIA:

8 That the proposed use will be consistent with the policies of RCW 90.58 and the
9 policies of the shoreline master program;
10 21. The proposal is consistent with Mason County's shoreline master program
for the reasons discussed above. It is consistent with the policies of RCW 90.58
11 because it provides visual and physical access to the shoreline to commercial patrons
while not interfering with navigation or public access and not creating any significant
12 impacts to the shoreline environment.
13 That the proposed use will not interfere with the normal public use of the shoreline;
14
22. As previously noted the project is set back more than 100 feet from the
15 shoreline and as determined in FOF No. 5 it will not interfere with public use of the
shoreline. The criterion is satisfied.

That the proposed use of the site and design of the project will be compatible with
17 other permitted uses within the area;
18
23. As determined in FOF No. 5, the proposal is compatible with all
19 surrounding uses and will no create any significant adverse impacts to any properties
in the vicinity. The criterion is met.

21 That the proposed use will cause no unreasonable adverse effects to the shoreline
environment in which it is to be located;
22
24. As determined in FOF No. 5, the proposal will not create any significant
23 adverse impacts to environmental resources. The criterion is met.
24 That the public interest suffers no substantial detrimental effect.

23. As discussed in the findings of fact and other parts of this decision, there
I are no recognizable significant adverse impacts created by this project, therefore the
2 public interest suffers no substantial detrimental effect.
3 24. Cumulative Impacts. MCC 17.50.080 requires consideration of
cumulative impacts in the granting of a conditional use permit. The proposal is in a
4 limited area of Mason County's shorelines that authorizes non-water dependent
commercial development and doesn't have any significant adverse impacts.
5 Consequently,cumulative impacts are minimal.
6 DECISION

The conditional use permit is approved subject to the conditions recommended in the
8 staff report as well as the following:
9 1. Perimeters of parking areas shall be landscaped to minimize visual impacts of the
10 shorelines, roadways and adjacent properties subject to approval by Public Works
and/or Department of Transportation. The applicant shall identify the size,
11 general type and location of landscaping. Design of parking loading areas shall
insure that surface run-off does not pollute adjacent waters or cause soil or beach
12 erosion. Design shall provide for storm water retention. Parking plans shall be
reviewed by Mason County Department of Public Works for compliance with
13 applicable County Ordinances.)
14 2. Security lighting be shrouded or directed down to structure doors.
3. Any signage shall be subject to approval of staff.

STAFF REPORT
I. Introduction. This report evaluates a request for a Shoreline Conditional Use
Permit for a proposed bed and breakfast in an existing residence in the Union Rural
Activity Center along Hood Canal. Using Mason County Code (MCC) Chapter
17.50 Shoreline Master Program Commercial Development review standards, staff
finds the proposal is consistent with Mason County Shoreline Master Program
Substantial Development and Conditional Use Permit standards and a decision
should include six review conditions.
II. Applicants. Maureen Woodcock.
III. Property Location. At 20 E Dalby Rd., Union, WA.;tax parcel 32232-50-99000;
in R 3 W, T 22 N, Section 32, SWIA of the SW1/4.
IV. Project Description. Shoreline Substantial Development and Conditional Use
Permit(Exhibit 2)to evaluate the change of use of an existing 5 bedroom, 4,400 sq.
ft., 2-story residence to a 4 bedroom bed and breakfast, and one bedroom owner
residence. Suitable parking for owner and guests provided adjacent to residence
and access drive and away from Dalby Rd. and State Route 106. Site plan is shown
on Exhibit 2.
V. EVALUATION.
A. Characteristics of the site. The site is a fairly flat upland area near Dalby
Rd. that drops 8 to 10 feet from the Dalby Rd. area to the Ordinary High
Water Mark along the nearby Big Bend Creek and at the Hood Canal
shoreline (Exhibit 5). Past grading and building development have
established vegetation buffers along the creek(110 ft. remains) and property
lines. The property is served by the private water system and is connected for
the commercial land use to a permitted septic system.

B. Characteristics of the area. The subject property is within an existing area of
commercial development to the north and northeast, with a restaurant and few
retail buildings to the north, and small retail businesses to the northeast along
State Route 106 (Exhibit 4). There are residences farther to the northeast along
Dalby Rd. and along State Route 106 and the shoreline of Hood Canal.
C. Shoreline Designation. The shoreline designation of the site is Urban
Commercial Shoreline Environment.
D. Zoning. The zoning is Union Rural Activity Center Rural Residential 2.5
designation.
E. SEPA Compliance and other public notice requirements. This project was
determined on August 6, 2013 to be is exempt from SEPA review,per WAC
197-11-800. Potential impacts can be addressed through permit conditions.
The Shoreline Management Permit application(SHR2013-00008, submitted
on July 29, 2013) is attached (Exhibit 2). The Notice of Application for
Shoreline Management Permit,placed in the paper on August)* and 12,
2013, is attached(Exhibit 6). The Affidavit of Publication of Shoreline
Management Permit is attached(Exhibit 7).
F. Other Permits. In addition to this Mason County Shoreline Master Program
Conditional Use Permit,this proposal will require a Mason County building
permits; connection to the existing septic system and adequate community
water are part of the permit approval for change of use occupancy.
VI. ANALYSIS.
This proposal requires a Conditional Use Permit, as the proposal is a non-water
dependent commercial land use. Mason County Shoreline Master Program Chapter
7.16.040 (Commercial Development) and Chapter 7.28.010 (Conditional Uses) guides
review of this proposal.
Applicable Commercial Development Policies are:
1. Commercial development on shorelines should be encouraged to provide physical and/or
visual access to the shoreline,and other opportunities for the public to enjoy the shoreline.
The proposed bed and breakfast residence is setback at least 125 feet from the shoreline
which is west of the state highway (Exhibit 5) and the structure provides a residential use
of the property so that a physical as well as visual access to the shoreline is still allowed.
2. Multiple use concepts which include open space and recreation should be encouraged in
commercial development.
The proposal uses the residence situated adjacent to the stream and saltwater shoreline
and the native vegetation buffer present as attributes to the location of the bed and
breakfast. Water-dependent recreation opportunities are directly available along Hood
Canal.

3. Commercial development should be aesthetically compatible with the surrounding area.
Structures should not significantly impact views from the upland properties,public roadways,
or the water.
The subject property is nearby commercial properties and on the shore side of State
Route 106 to the northwest and northeast. The existing residence with the landscaping
present is very similar to the residences in the vicinity. This structure offers a good view
towards Hood Canal without affecting the views from nearby properties.
4. The location of commercial developments along shorelines should ensure the protection of
natural areas or systems identified as having geological,ecological,biological,or cultural
significance.
The existing residence is setback 120 feet from Hood Canal and I10 feet from Big Bend
Creek just to the north and northwest. These buffers will be assets offered by the bed and
breakfast enterprise.
5. Commercial developments should be encouraged to locate inland from the shoreline area,
unless they are dependent on a shoreline location. Commercial developments should be
discouraged over water or in marshes,bogs, swamps,and wetlands.
The proposal includes the 120 foot residential setback from the shoreline high water
mark and the location on the "upland"side of State Route 106; This location enables
residents and visitors opportunities to enjoy the shoreline in a residential structure
setbackfrom saltwater and freshwater critical areas.
6. New commercial development in shoreline areas should be encouraged to locate in those
areas with existing commercial uses in a manner that will minimize sprawl and inefficient use
of shoreline areas.
The site is within an area of existing commercial land uses in the Union Rural Activity
Center and situated in the Urban Commercial shoreline designation. The location is in
an appropriate area of similar land use activities (Exhibit 4).
7. Parking facilities should be placed inland, away from the immediate water's edge and
recreational beaches.
Parking areas adequate for the intended land use are existing and situated on the
property near the Dalby Road side of the existing residence (Exhibit 2), and over 100 feet
from the saltwater shoreline.
8. Commercial development should be designed and located to minimize impacts of noise
and/or light generated by the development upon adjacent properties. Commercial
developments which generate significant noise impacts should be discouraged.
The proposed bed and breakfast land use is in the same scale as the existing restaurant
and retail land uses on adjacent properties. The development is screened by existing
vegetation from nearby residential land uses. The same level of noise as a residential use
is expected from the proposed land use.

2. Commercial development may be permitted in the shoreline area in the following descending
order of priority: water-dependent,water-related,and water-oriented.
The existing building on the property will contain a water-oriented commercial land use.
The property's location will take advantage of north views to the Hood Canal shoreline.
3.Parking and loading areas shall be located well away from the immediate water's edge and
beaches,unless there is no other practical location for parking. Parking and landscaping plans
shall be reviewed for compliance with all applicable county ordinances.
Parking will be on-site nearby to the residence and the county road. Perimeter
vegetation will be maintained along all roads.
5. Water supply and waste facilities shall comply with the strictest established guidelines,
standards, and regulations.
Public water and commercial septic systems are already connected on the property; they
will be continually maintained.
6.New commercial development shall be located adjacent to existing commercial developments
whenever possible.
Existing retail and restaurant land uses are on properties that are commercial zoned in
the Union Rural Activity Center adjacent to the subject property.
7.New or expanded structures shall not extend more than 35 feet in height above average grade
level.
Structure height is no more than 32 feet in the site vicinity (Exhibit 2), which is in
conformance with the Rural Residential 2.5 zone (Sec. 17.04.214).
9. Commercial developments shall be located and designed to minimize noise impacts to
adjacent properties.
The site plan proposes buffering of adjacent residential properties, general landscaping
through the development, and maintaining native plantings along the creek.
CONDITIONAL USE EVALUATION
As part of the application materials,the applicant has provided her responses to the five
Conditional Use criteria; it is part of Exhibit XX.

As part of the standards of Chapter 7.28.010,uses which are classified or set forth in the
Master Program as conditional uses may be authorized provided the applicant can
demonstrate all of the following:
1. "The proposed use will be consistent with the policies of RCW 90.58 and the policies
of the Master Program."
The policies of the Shoreline Management Act RCW 90.58 emphasize that coordinated
land use planning is necessary in order to protect the public interest associated with the
shorelines of the state, while enabling a range of compatible land use activities to occur
(from residential, to commercial, to recreational uses. The applicant has proposed a
lodging land use that is suitable for the Rural Activity Center Commercial zoning
designation, and is consistent with these shoreline policies and the anticipated overnight
accommodation needs of the Union commercial area.
2. "The proposed use will not interfere with the normal public use of the shoreline."
The proposed bed and breakfast use is situated on the "upland"side of the state highway
and has a 100 foot setback from the Hood Canal shoreline situated to the northeast. The
intended use will not interfere with the public use of the shoreline nearshore areas.
3. "The proposed use of the site and design of the project will be compatible with other
permitted uses in the area."
The bed and breakfast is compatible with the existing restaurant, commercial office, and
recreational vehicle park to the north, and retail uses on the northeast side of State Route
106. The proposed overnight accommodations complements the existing recreational
vehicle park and resort properties located to the north and 600 feet to the northeast of the
subject property.
4. "The proposed use will cause no unreasonable adverse effects to the shoreline
environment in which it is located."
With the existing 100 foot shoreline setback and the native vegetation buffer to the
stream, no adverse impacts to the shoreline or other critical areas are anticipated. As
the residence has existed for over 20 years, access to the saltwater shoreline will
continue and the vegetation buffer will be maintained by the native plantings between the
buildings and the creek area.
5. "That the Public interest suffers no substantial detrimental effect."
As the existing residence provides overnight accommodations for area visitors, the public
interest in the shoreline suffers no detrimental effect, since shoreline access is not altered
and shoreline views from the property are included as part of the bed and breakfast
proposed land use.
VII. Evaluations.
The applicant has proposed a 4-room bed and breakfast land use that is suitable for the
Rural Activity Center and consistent with the needs of Union. With the existing 100-foot
shoreline setback and maintained buffer along Big Bend Creek,the proposed use will not
interfere with access to and the public use of the nearby shoreline from the bed and
breakfast use. This land use is compatible with existing commercial and residential land

uses along State Route 106 and Dalby Rd. No adverse impacts to the shoreline are
anticipated from this change of use. The public interest in the shoreline suffers no
detrimental effect as shoreline access and shoreline views are part of the bed and
breakfast proposed land use. Staff finds the proposal is consistent with Mason County
Shoreline Master Program Conditional Use Permit standards and a decision should
include six review conditions.
VIII. Conclusions.
As designed,this proposal is consistent with the Shoreline Management Act and with
Mason County Shoreline Master Program Chapter 7.16.040 (Commercial Development)
and Chapter 7.24.010 (Conditional Uses) standards, subject to the following conditions:
1) The proposed project shall be consistent with all policies and provisions of the
Shoreline Management Act, its rules, and the standards of the Mason County
Shoreline Master Program.
2) The applicant shall meet the standards of the Conditional Use Permit review,
including proper standards under the Union Rural Activity Center Rural
Residential 2.5 zone(Sec. 17.04.214) for setbacks, height, site coverage, and
parking needs for the land uses proposed.
3) The applicant shall meet the fire protection standards of Mason County in the
construction and operation of a bed and breakfast land use in the Union Rural
Activity Center.
4) The applicant shall provide proper ingress and egress for the proposed land use
and secure the proper road traffic access permits from Mason County Department
of Public Works.
5) The applicant shall use best management practices to prevent debris and runoff
from entering the waters (fresh and saltwater) of the State during property
maintenance.
6) Public water and commercial septic systems already connected on the property
will be continually maintained to Mason County Public Health standards.
IX. Choice of Actions

ADDITIONAL INFORMATION FOR SHORELINE CONDITIONAL USE
The purpose of Conditional Use Permit is to allow greater flexibility in varying the new
application of the Use Regulations of the Master Program. Conditional Use Permits
should also be granted in circumstances where denial of the permit would result in a
thwarting of the policy enumerated in R.C.W.90.58.0200. In authorizing a Conditional
Use, special circumstances may be attached to the permit by local government or the
Department of Ecology to prevent undesirable effects of the proposed use.
Uses which are classified, or set forth in the Master Program as conditional uses, may be
authorized provided the applicant can demonstrate all of the following:
1. Show that the proposed use will be consistent with the policies of R.C.W. 90.58 and the policies
of the master Program.
This application, to permit an existing residence to also function as a 4
bedroom Bed & Breakfast, supports the intent of the Master Shoreline Program "to
foster all reasonable and appropriate uses': Since there will be no change in
landscaping, nor construction of new buildings, nor any changes to the wetlands
and Big Bend Creek or to the shoreline of Hood Canal, there will be no adverse
effects to the wildlife, the vegetation, to public health, or to aquatic life. The
application fits the definition of a small commercial activity on a residential
property where the principle practitioner resides; the project is also consistent with
the definition that a Cottage Industry is considered as a residential use and a minor
commercial enterprise. Applicant has complied with all applicable County
Ordinances as required.
2. Show that the proposed use will not interfere with the normal public us of the
shoreline.
Situated across State Route 106, the shoreline will remain
vacant, will continue to be accessible to local foot traffic, and will
continue to provide the public with a grand view of Hood Canal and
provide lots of photographic opportunities.

3. Show that the proposed use of the site and design of the project will be compatible
with other permitted uses within the area.

e are commercial and residential developments on all sides
of this project. This is a Rural Activity Center and is defined as an
urbanized area. A restaurant and some commercial cabins are to the
West, a gift shop and rental cottages are across State Route 106, there
are a couple of private homes adjacent on Dalby Road, plus vacation
cottages and vacant lands to the East, and Hood Canal is to the North.
It is a very mixed use area.
4. Show that the proposed use will cause no unreasonable adverse effects to the shoreline
environment in which it is to be located.
Since this project has no change in landscaping, in its existing
buildings, and remains a residence, there will be no adverse effects. It
will maintain the status quo it has had for the last 20 years.
5. Show that the public interest suffers no substantial detrimental effect.
Since the project is defined as a Cottage Industry it therefore will
have Tittle, if any, negative impact on the public interest. This
assessment is predicated on the project maintaining its residential
profile.
Other uses, which are not classified or set forth in the Master Program, may be authorized
as conditional uses provided that the applicant can demonstrate,in addition to the criteria
set forth above,that extraordinary circumstances preclude reasonable use of the property
in a manner consistent with the Use Regulations of the Master Program.
In the granting of all Conditional Use Permits, consideration shall be given to the

I am writing to support the proposed change of use for this home which is diagonally
across Hwy 106 from 2 homes we own on Waterwheel Place, Union.
1. Maureen has proven capability to successfully run a hospitality business since she
ran the adjacent Robinhood Resort for many years. This summer the Robinhood
was frequently sold out so there is need for additional capacity in Union.
2. The immediate area of this home has historically been one of business mixed with
residential and the change would not adversely affect adjacent properties. On the
contrary, having tourists visit would bring benefits.
3. Maureen has a track record of preserving a healthy environment for salmon and
other wildlife on her parcel. We witnessed heavy numbers of large chum salmon
spawning in large pools last November all along Big Bend Creek inside and
adjacent to her property. Having others able to view this would bring more
support for the health of creeks and Hood Canal.
4. This small change would help bring additional financial benefits to small
businesses in Union which have been hit by the economic downturn.
S. Maureen has tried to sell her property for over a year with price reduction. Any
further lowering of the asking price would create a "distressed sale"situation
which would adversely affect the valuations of other residential property in Union.
6. Maureen has been a community supporter and booster for many years. She has
been generous in offering her home to use for fundraisers, candidates'resceptions,

Dear Ms. Woodcock:
On October 11,2013,the Department of Ecology(Ecology)received the Mason County decision
on your Shoreline Substantial Development and Conditional Use Permits for the change of the
use of an existing 5 bedroom,4,400 square foot, 2-story residence to a 4 bedroom bed and
breakfast, and one bedroom owner residence. Suitable parking for owner and guests will be
provided adjacent to residence. The proposal is within shoreline jurisdiction of Hood Canal.
By law, local governments must review all SDPs for compliance with:
• The Shoreline Management Act(Chapter 90.58 RCW)
• Ecology's Substantial Development Permit approval criteria(Chapter 173-27-150 WAC)
• The Mason County Local Shoreline Master Program
Local governments,after reviewing SDPs for compliance, are required to submit them to
Ecology. Your approved SDP has been received by Ecology.
By law,Ecology must review Conditional Use Permits for compliance with:
• The Shoreline Management Act(Chapter 90.58 RCW)
• Ecology's Conditional Use Permit approval criteria(Chapter 173-27-160 WAC)
• The Mason County Local Shoreline Master Program
After reviewing Conditional Use Permits for compliance, Ecology must decide whether to
approve, approve with conditions,or disapprove them.
Our Decision:
Ecology approves your Conditional Use Permit provided your project complies with the
conditions required by Mason County. Please note,however,that other federal,state and
local permits may be required in addition to this shoreline permit.
What Happens Next?
Before you begin activities authorized by this permit,the law requires you to wait at least 21
days from the date of this letter, which is the "date of'filing". This waiting period allows anyone
(including you)who disagrees with any aspect of this permit to appeal the decision to the state
Shorelines Hearings Board. You must wait for the conclusion of an appeal before you can begin
the activities authorized by this permit.
The Shorelines Hearings Board will notify you by letter if they receive an appeal. We
recommend you contact the Shorelines Hearings Board before you begin permit activities to
ensure no appeal has been received. They can be reached at(360) 664-9160 or
http://www.eho.wa.gov.
If you want to appeal this decision you can find appeal instructions (Chapter 461-08 WAC)at
the Shorelines Hearings Board website above. They are also posted on the website of the
