The request was approved pursuant to the Mason County Development Regulations Ordinance No. 82-96, specifically for the construction of an accessory dwelling unit. The proposal was exempt from SEPA review per WAC 197-11-800 (1), (b), (i). This is a final County decision. No further appeals to the County are available. Applicant. The applicant is Lisa King. 22 2. Hearing. The Hearing Examiner conducted a hearing on the application on August 23, 2005, at 1:00 p.m., in the Mason County Board of Commissioners 23 Meeting Chambers, Building I. 24 Substantive: 25 3. Site/Proposal Description. The site for the proposed use is located at 6713 W. Shelton-Matlock Rd., Shelton, WA 98584 in S 990' of E 1/2 W 1/2 SW NE EX TR1. The assessor's tax parcel number is 42018-13-00060. The parcel has been cleared of many of evergreen and deciduous trees and is being maintained as a mowed field at this time. The subject lot is located west of Shelton off the Shelton- Matlock Road. A 1,250-square-foot residence and a drainfield currently exist on the site. 4 The applicant proposes to place a 960-square-foot manufactured home on the 5 parcel. The primary residence on the site is 1,250 square feet. The distance between 6 the primary residence and the proposed ADU is 110 feet. 7 4. Characteristics of the Area. The site is located in an area zoned as Rural Residential 5 adjacent to the Dayton Hamlet. Several single-family residences 8 occupy the general vicinity. there is a small store/gas station to the north. 9 5. Adverse Impacts of Proposed Use. No adverse impacts have been 10 identified. 11 12 CONCLUSIONS OF LAW Procedural: 13 14 1. Authority of Hearing Examiner. MCC 15.03.050(10) provides the Examiner with the authority to review and act upon special use permit applications. 15 Substantive: 16 17 2. Comp Plan and Zoniny- Designation. The Mason County Comprehensive Plan designation for the site is Rural and the zoning is Rural Residential 5. 18 3. SEPA Compliance. The proposal is exempt from SEPA review under 19 MCC 8.36.010 and WAC 197-11-800(1)(b)(i). 20 4. Review Criteria and Application. MCC 1.03.029(A) requires a special use 21 permit for accessory dwelling units in areas zoned rural. M.C.C. 1.05.040 provides the standards for special use permits. Those criteria are addressed below: 22 MCC 1.05.040(A): That the proposed use will not be detrimental to the public 23 health, safety and welfare. 24 5. No potential detrimental effects have been identified by the staff, applicant 25 or other witnesses. The placement of the manufactured home meets all county code requirements,including setbacks and assures adequate off-street parking. The proposed use is consistent with the Comprehensive Plan. The Rural 3 Residential 5 zone allows one accessory dwelling unit per parcel. 4 MCC 1.05.040(C): That the proposed use will not introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent 5 properties and the community at large. 6 7. No hazardous conditions are expected as a result of this proposal. 7 MCC 1.05.040(D): That the proposed use is served by adequate public facilities 8 which are in place, or planned as a condition of approval or as an identified item in 9 the County's Capital Facilities Plan. 10 8. The accessory dwelling unit will be connected to an approved water system and the applicant has applied for a separate septic system permit. Acquriing 11 the septic permit is a condition of approval of this permit. The applicant has also planned a new driveway and parking area for the proposed accessory dwelling unit. 12 MCC 1.05.040(E): That the proposed use will not have a significant impact upon 13 existing uses on adjacent lands. 14 9. The proposal will have no significant impacts on existing adjacent land 1.5 uses, which are residential. The ADU is proposed for a 6.60 acre parcel and no adjoining property owners have testified against the project. 16 MCC 1.05.040(F): If located outside an Urban Growth Area, that the proposed use 17 will not result in the need to extend urban services. 18 10. The parcel is already served by urban services for the existing residence. 19 With the approval of an on-site septic system, there will be no need to extend services. 20 Additional Review Criteria 21 22 MMC 15.09.050 Type III review 23 (1) The development does not conflict with the comprehensive plan and meets the requirements and intent of the Mason County Code, especially Titles 6, 8, and 16. 24 20. The proposed development is consistent with the Mason County 25 Comprehensive Plan and meets the requirements of the Mason County Code. The applicant has applied for a septic system permit and acquisition of the permit is a condition of approval, thereby meeting the requirements of Title 6--Sanitary Code. Title 16-- 1 Subdivisions does not apply to this proposal. (2) The development does not impact the public health, safety and welfare and is in 3 the public interest. 4 21. The project creates no significant adverse impacts and is consistent with 5 the public health, safety and welfare and is in the public interest. 6 (3) The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the 7 comprehensive plan. If the development results in a level of service lower than those set forth in the comprehensive plan, the development may be approved if 8 improvements or strategies to raise the level of service above the minimum standard are made concurrent with the development. For the purpose of this section, 9 "concurrent with the development" is defined as the required improvements or 10 strategies in place at the time of occupancy, or a financial commitment is in place to complete the improvements or strategies within six years of approval of the 11 development. 12 22. Introduction. This report evaluates a proposal for the addition of a manufactured home as an accessory dwelling unit. The completed unit will be 960 square feet. References to County Ordinances are as approved. Staff recommends approval of the Special Use Permit. II. Applicant. Lisa King. III. Property Location. 7613 W Shelton-Matlock Rd., Shelton, WA 98584. S 990' of E '/z W '/z SW NE EX TR1. Parcel # 42018-13-00060. IV. Project Description. The proposal is to place a 960 square foot manufactured home on the parcel. The primary residence on site is 1,250 square feet. The distance between the primary residence and the proposal is 110 feet. See site plan (Exhibit 4). V. Evaluations. A. Characteristics of the site. The parcel is located in an area of rural residential development. The lot is approximately 6.60 acres adjacent to the Dayton Hamlet. Comprehensive Plan Designation / Zoning. The Mason County Comprehensive Plan designation for the site is Rural and the zoning is Rural Residential 5. VI. SEPA Compliance. Project is SEPA exempt per WAC 197-11-800 (1)(b)(i). VII. Other Permits/Approvals. The proposal will require Mason County Building Permit for the residential (ADU) construction. A Notice of Application and Public Hearing (Exhibit 6) was posted in the Mason County Journal on July 7, 2005. Notice was posted on site and mailed to neighboring properties on July 1, 2005. No comments have been received to date. VIII. Analysis. This proposal requires a Special Use Permit due to the requirements of the Mason County Development Regulations, dated May 17, 2005, section 1.03.029. The parcel currently contains a primary residence that is 1,250 square feet and a septic system. Applicable Development Regulations as listed under section 1.03.029 A. are: A. The ADU shall be subject to a special use permit, unless in the shoreline jurisdiction it is subject to a shoreline permit. B. The owner of the ADU must reside on the lot in either the principal residence or ADU. C. The ADU shall be located within 150 feet of the principal residence or shall be a conversion of an existing detached structure (i.e. garage). D. The ADU shall not exceed 80% of the square footage of the habitable area of the primary residence or 1,000 square feet, whichever is smaller. E. All setback requirements must be met by the ADU. F. All applicable health district standards for water and sewer must be met by the ADU. G. No recreational vehicles shall be allowed as ADUs. H. Only one ADU is allowed on any property. I. An additional off-street parking space must be provided for the ADU. Staff Response: The ADU as proposed meets all of the above criteria A— I. Applicable Special Use review criteria: See the applicant's answers to these criteria, marked Exhibit 3. 1. Will the proposed use be detrimental to the public health, safety and welfare? Staff Response: The placement of the manufactured home meets all county setbacks and assures adequate off street parking. No potential detrimental effects have been identified. Staff Response: There do not appear to be any conflicts with the County Comprehensive Plan. Rural Residential 5 zoning does allow for one accessory dwelling unit per parcel. A family member will occupy the proposed ADU. 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? Staff Response: No hazardous conditions would be expected as a result of the proposal. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Staff Response: The ADU will be connected to an approved water system and a permit for a separate septic system has been applied for(S WG2005-00392). There is a new driveway and parking area proposed for the ADU. 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? Staff Response: There will be no significant impact upon existing, adjacent land uses. Adjacent land uses are residential. A family member will occupy the ADU. 6. If located outside an Urban Growth Area, will the proposal result in the need to extend urban services? Staff Response: The addition of a single-family residence would not result in a need to extend urban services. Project Analysis: Based upon these policies and regulations, the project conforms to the policies and use regulations of the Mason County Development Regulations with regards to Accessory Dwelling Units. IX. Conclusions. As designed, the project is consistent with the Mason County Development Regulations. Staff recommends approval. X. Choices of Action. 1. Approval of the SUP request. 2. Denial of the SUP request. 3. Conditional approval of the SUP request. 4. Postpone the decision for further information.
