The existing cabin/residence is situated very close[+/-5 feet]to the Ordinary High Water Mark(OHWM)of Hood Canal,especially at the existing covered deck portion on the north side of the cabin. The saltwater vegetation cover associated with the OHWM of Hood Canal is located at 13 feet from the northwest comer of the existing cabin/residence(excluding the roof overhang and porch/deck). The Mason County Shoreline Master Program will not permit new residential development(such as,new structures or expansion of structures)that is setback less than 15 feet from the OHWM. This same restriction applies to new roof eaves or overhangs on portions of the existing structures. Your present site plan shows the view line from the roof eave of the cabin/residence to the roof eave of the neighbor's mobile home;but the proposed development must also meet the proper shoreline setback. As proposed,the expansion of the bedroom on the northwest side of the cabin/residence is not meeting this shoreline setback standard. The site plan and structure remodel drawings that were submitted must be changed to meet this standard,showing the OHWM on the proposal site plan and the changes to the structural drawings that show the proposal meeting the 15-foot shoreline setback in respect to the OHWM. Page 1 of 4 CASE NOTES FOR BLD2009-00961 CONDITIONS FOR BLD2009-00961 1) A Mason County Stormwater Management Worksheet was completed and signed as part of this building permit application. Design, sizing, placement, inspection and maintenance of stormwater management systems shall be the responsibility of the owner/agent of the developed parcel. It is the owner/agent/contractor's responsibility to ensure that Mason County Department of Public Works has approved the stormwater site plan for this parcel prior to the commencement of any development activities. *NOTE if Stormwater Management option "A" was selected on the Small Parcel Stormwater Management Application/Worksheet the document entitled "Managing Storm Drainage on Small Lots, The Small Parcel Stormwater Site Plan" constitutes an approved plan based on the criteria listed on the application/worksheet. If the development has, or will have, a septic/drainfield system you are responsible for contacting Mason County Division of Environmental Health to ensure that the stormwater system will not adversely affect the septic system of this, or any other, parcel. You may also wish to consult with the septic design professional involved with the project. The Building Official may extend the time for action for a period not exceeding 180 days, upon the receipt of a written extension request indicating that circumstances beyond the control of the permit holder have prevented action from being taken. No more than one extension may be granted. X ' I 10) Provisions for surface/subsurface drainage control must be implemented with new construction or development on site and MUST NOT adversely impact adjacent parcels. Under the requirements of Mason County Stormwater Ordinance, either private ditches and drains will meet requirements of the stormwater ordinance or prior approval will be granted to use an existing utility and drainage easement dedicated for that specific purpose. For further information regarding this ordinance and the REQUIREMENT to obtain an ACCESS PERMIT for the installation/construction of a driveway or access connecting from a Mason County Road, Contact the Mason County Public Works Department prior to construction at Ext 450. For any construction which is proposed to be located within 25'of a Mason County road right of way, it is suggested to contact that office to review future planned work which may affect your project. X lL� 11) All building permits shall have a final inspection performed and approved by the Mason County Building Department prior to permit expiration. The failure to request a final inspection or to obtain approval will be documented in the legal property records on file with Mason County as being non-compliant with Mason County ordinances and building regulations. X -- t_ 12) CONSTRUCTION PROCESS TO BE FIELD CORRECTED AS REQUIRED PER MASON COUNTY BUILDING DEPARTMENTAND THE ADOPTED BUILDING CODE. The construction of the permitted project is subject to inspections by the Mason County Building Department. All construction must be in conformance with the international codes as amended and adopted by Mason County. Any corrections, changes or alterations required by a Mason County Building Inspector shall be made prior to requesting additional inspections. All plan reviews were paid for the reviews that were performed. A building permit fee of$1307.35 (1245.75+61.60) as paid along with mechanical and plumbing fees when the permit was issued originally on 7.29.2010 and with revisions on 2.28.2013. 2) 1 believe that a new permit needs to be created if the building is moved to a different parcel. All Bldg, planning, and public health plan review fees associated with the new project need to be charged since all elements of the proposal are changed. Since no inspections have been performed on permit#BLADE- 00961 perhaps the director could approve a portion of the permit fees associated with the old permit to be credited to the new permit if the old permit is canceled and a new permit is created. 3) The owner needs to know that when a structure is moved to another location a site inspection performed by a Mason County Building Inspector is required in accordance with MCC 14,08.040. 4) To modify the existing structure in the same location such as raising the Bldg, all elements need to conform to the requirements for flood resistant construction....base flood elevation will need to be evaluated and a certificate provided, floors need to be placed such that the floors are located at or above the base flood elevation level, flood venting, etc. 5) The current permit should be extended so that the owner can review their options. The side of your house meets the 15 foot setback. The eve overhang does not. Allan showed me your building plans. It would be very simple to exclude an eve overhang from the waterward side of the proposed extension of the house. Many homes on the Canal are built that way to meet side yard and shoreline setbacks. As the slant of your roof will direct water perpendicular to the area where the eve will be excluded, it should have no impact on the building. The existing cabin/residence is situated very close [+/- 5 feet] to the Ordinary High Water Mark (OHWM) of Hood Canal, especially at the existing covered deck portion on the north side of the cabin. The saltwater vegetation cover associated with the OHWM of Hood Canal is located at 13 feet from the northwest corner of the existing cabin/residence (excluding the roof overhang and porch / deck). The Mason County Shoreline Master Program will not permit new residential development (such as, new structures or expansion of structures) that is setback less than 15 feet from the OHWM. This same restriction applies to new roof eaves or overhangs on portions of the existing structures. Your present site plan shows the view line from the roof eave of the cabin/residence to the roof eave of the neighbor's mobile home; but the proposed development must also meet the proper shoreline setback. As proposed, the expansion of the bedroom on the northwest side of the cabin/residence is not meeting this shoreline setback standard. As noted above, please reference Permit Number BLD2009-00961, which is a currently active permit, for their property at 17 Waterwheel Place, Union, Tax Parcel Number 32233-50-00004. Due to unforeseen circumstances, they have been unable to begin construction work under this permit, and as you will note, progress needs to be made prior to August 28 in order for the permit to remain active. However, last winter's"king tide" has impacted their plans to go forward as permitted. While their family has owned this property for many years, they have not personally experienced or been told of a tide as high as occurred last winter. Since they were not in the area during the winter, they were not aware that the water rose to a level above the bottom of the wood floor structure of the existing cabin, leaving floor insulation and framing wet, with tidal water stuck in the crawlspace (since there are no low relief openings in the foundation walls) even after the tide had receded. By the time they learned of the tide and were able to get things checked, this situation had impacted the existing floor structure significantly, though water and wet insulation have now been removed, and the floor structure is drying. In spite of this damage, their intent was to move forward with the permitted plan this summer, with the revision that they would raise the whole structure (existing and new) about 2 feet. This would obviously impact the cost and complexity of keeping the existing cabin (which is nearing 40 years old) and adding on to it as permitted, but they set out to find contractors and get prices for the work. It has taken some time to do so, and unfortunately they are just now finding that the project as designed, plus lifting up the existing cabin, demolishing the existing foundation, and constructing a new one, is no longer feasible. Without the added cost of lifting the existing cabin, the project was marginally economically feasible, but when all of those costs are added in, an economic hardship is created, which they are just now recognizing. Due to this hardship, their desire is to redesign some aspects of the plan under the existing permit, with our help(see the attached site concept plan). The changes would be as follows.- The existing cabin structure, less foundation, would be lifted and relocated to a different site, Tax Parcel Number 32233-50-00906, also owned by the Abrams, located across Highway 106. A code complying new foundation would be constructed, and a new septic system would be designed for approval. Though I have not yet been able to study the characteristics of this site, you will note that there was a permit several years ago to relocate a different structure to this site. The structure became unavailable and the project was abandoned, but this seems to indicate that the project is potentially within permit guidelines. The Abrams are proposing that not only should the structure be built with a higher ground floor level, but they are also interested in moving the entire structure behind the 15 foot setback line, so that the structure is no longer partially nonconforming. This would seem to be beneficial to all interested parties and would avoid any technical issues related to increasing nonconformance. As you can see, working through these steps will take some time. The Abrams would very much prefer to do the weather critical work during the summer, but this summer's season will soon be past, and there is not time to go through the necessary steps prior to August 28. This is a unique case, and we recognize that there will need to be additional review by more than one department of any proposed changes to the existing permit, so after conferring with both Planning and Building staff, it seemed best to request written approval from you as department head for the following: 1. Agreement in principle that the above revisions can be made as a modification to the existing permit, with appropriate fees added where necessary for additional plan checks, changes in scope, etc. The Abrams do not wish to"push the envelope" or try to get around regulations which were in effect at the time of permitting, and as noted above, are willing to go further to bring the whole project into conformance. They also recognize that each department must review changes for conformance, and are not seeking a blanket approval at this date. But they are very concerned about potential effects of losing this permit and becoming subject to newer or future regulations that might completely alter their ability to make improvements as noted above. Therefore, it is important to them that the existing permit remain in effect, and they are requesting that the necessary changes be allowed under the existing permit. 2. In order to facilitate Item 1 above, to allow time for design and further review by county staff, they are requesting that your approval of this petition will also be considered as demonstrating progress on the permit, as necessary to allow for another 6 months of time to be added to the permit period, without using their 6 month extension and limiting future construction flexibility. 3. However, because of the height of the King Tides,we had some damage to the house and had to remove wet insulation and obtain a tidal elevation survey. We learned that it may be cost effective to build a new structure instead of remodeling the existing house. We won't know for sure until we can obtain complete bids on the project but hope to build a more attractive house that will improve the aesthetic view for all who enjoy Sunny Beach Cove. When we met with the county group last summer, it was agreed that the insulation work would be considered progress so we would have 6 months to do further work and wouldn't have to use up the one time normal 6 month extension without progress. Since the meeting we have spent a lot of time traveling to visit and help with Bill's sister who finally passed away last fall. At of today, we have obtained the tidal elevation survey report and are submitting the adjusted plans to accommodate moving the house and constructing a new house. The original plan for the garage had an indentation because of some large trees but we have learned they need removal anyhow because of proximity to existing and proposed structures so the garage can be rectangular now. We also met with contractors who move houses and install new foundations. The engineering is included so the plans would be complete. However, we do not know the total cost of the project yet. In the event it is too costly,we may be forced to only modify the existing house at least temporarily. For that reason, we need the prior approved design left open as an option.
