Project Description: Determine shoreline and other setback requirements for after
the fact construction of an RV shed that had been Stop Worked
by County Building Dept. near Hood Canal shoreline and SR
106.

As part of this departments review of your permit application, a Shoreline Inspection (SPI) was
performed on your property. Below you will find comments made regarding the proposed
development and its critical values.
In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must
be included in your specific proposal-, these setbacks are included as part of the comments listed
below.
This information is based on County and State regulations as they exist to date. These regulations
may change and may affect the requirements for development of the subject property.

Comments: The Zoning for the site is Rural Residential 5 and the shoreline
designation is Urban Residential under the Mason County
Shoreline Master Program (SMP). Under these regulations the
minimum sideyard setback for structures is 5', and the minimum
front yard setback is 25' measured from property lines, easements
and right-of-ways. It is not allowed to place a structure over/
encroach on property lines, easements or right-of-ways, however
it is possible to apply for a variance to reduce the standard
setbacks.
In order to process your building permit for an RV storage building
there are several items that would need to be addressed. In it's
current location the RV shed does not meet the minimum
shoreline setback requirements of the Mason County Shoreline
Master Program or Resource Ordinance Chapter 17.01.110
(enclosed), or front-yard setback requirements of Mason County
Development Regulations. With the information you have
submitted so far, it appears this project would require an
after-the-fact Shoreline Variance, after-the-fact Resource
Ordinance Variance and after-the-fact Development Regulations
Variance. The project would also require a Mason Environmental
Permit and Habitat Management Plan per R.O. Chapter
17.01.110. All after-the-fact variances and permits would be
subject to triple fees.
Based upon our site visit it appears that the minimum 35 foot
setback per R.O. Chapter 17.01.110 would meet the setback
requirements of the Resource Ordinance and Shoreline Master
program. Since the adjacent house to the south is over 150 feet
from the subject property lot line, the shore common line was
determined by an imaginary line drawn from the most waterward
corner of the on-site cabin and a point 100 feet landward along
the southern line. This determination was based on an
property
approximation due to the extreme topography on the east side of
SR 106. This estimated common line was compared to a
measurement 35 feet from the existing bulkhead at the closest
point to the new structure on the southwest side. Based upon this
information the 35 foot minimum setback appeared to meet
shoreline setback requirements.
If the RV storage shed can be relocated to meet this 35 foot
minimum setback, then it appears that the shoreline and resource
ordinance variances can be avoided. Some restoration of the
buffer area will like) be needed. It is et to be determined where

Property Mgmt. - right of way section should be contacted
regarding the precise location of the SR 106 right of way, so that
accurate setbacks can be determined.
