Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. (&k Tammi Clark Land Use Planner Mason County Planning Department 4/26/2005 Page 1 of 4 SP12005-00119 Site Inspection 4/26/2005 Case No.: SP12005-00119 Comments: Pre-inspection for Brenda Robinson/James Laurence on April 22, 2005: The purpose of the pre-inspection was to evaluate the stream and wetland issues and determine areas available for building and evaluate the proposed driveway changes. The parcel is rectangular in shape and is 5+ acres in size. Goldsborough Creek, a Type I stream, runs through the parcel from the west to the east, entering the parcel on the southwestern side, running diagonally, and exiting on the northeastern part of the parcel. Little Egypt Road borders the eastern portion of the parcel. The parcel has retained a mature forest canopy of cedar, fir, and alder with a dense understory. This dense vegetation made identifying a building site outside of the stream buffer very difficult. Based on staffs best ability to take measurements, it appears there may be a building site outside of the stream/wetland buffer near the southwestern part of the parcel. An old access road (parts have some revegetation and other parts are still visible) borders the northern property line for several hundred feet. There is an existing culvert. ZONING: The zoning designation for the site is Rural Residential 5. Standard building setbacks for this zoning are a 25 foot front yard setback, and 20 foot side and rear yard setback (lot line setbacks). These setbacks are measured from structures above grade such as roof overhangs (roof gutters), and other structures / appurtenances, including balconies, decks, heat pumps, etc. It is possible to reduce the front and rear setbacks to 10 feet and the sides to 5 feet through an administrative variance if such encumbrances such as slopes, streams, and wetlands are on site. STREAMS / SHORELINE: A Type 1 stream, Goldsborough Creek, was observed during the site inspection. The shoreline designation for Goldsborough Creek is Rural. The stream bisects the parcel from west to east, entering the parcel on the southwestern side and exiting on the northeastern side of the parcel. The buffer/setback for a Type 1 stream is 165 feet (150' vegetated buffer/15' building setback). Based on the best ability of staff to take measurements, it appears there is a good possibility that a building site does exist outside of the stream/wetland buffer. Repair and maintenance of the existing road within the stream buffer is allowed without a Mason Environmental Permit provided the repair/maintenance stays within the existing footprint and there is no expansion of the road. Should any portion of the roadwork within the stream buffer include expansion or relocation, 4/26/2005 Page 2 of 4 SP12005-00119 Site Inspection 4/26/2005 Case No.: SP12005-00119 then a Mason Environmental Permit would be required per the enclosed Mason County Resource Ordinance 17.01.110 Fish and Wildlife Habitat Conservation Areas Section G(1)(i). A Habitat Management Plan will be required per Section G (1). If a pasture for livestock encroaches into the 150' vegetated buffer, then a Farm Plan will be required per Section F (3). The Mason Conservation District can provide this service. Their contact number is (360) 427-9436. Since Goldsborough Creek is regulated under the Shoreline Master Program (SMP), staff has enclosed policies and regulations (SMP Chapter 7.16.010 Agriculture). Please pay special attention to Use Regulations #5 and #6, although any proposal within 200 feet of the stream will need to comply with all policies and regulations. The SMP setback of 100 feet for livestock containment would be the minimum allowed regardless of a buffer setback allowed for in the Farm Plan. Staff noted that any work, such as a well or septic, in the buffer would require further review under a Mason Environmental Permit. Information regarding development in Fish and Wildlife Habitat Conservation Areas is outlined in the enclosed Chapter 17.01.110 of the Mason County Resource Ordinance. If there are no areas outside of the stream buffer for home construction then placement of a re sidence esidence would require a variance from the Mason County Resource Ordinance (MCRO) 17,01.110 Fish and Wildlife Habitat Conservation Areas. This process would require a variance application ($1225), a Habitat Management Plan ($360 County review fee), and a public hearing and de cision b a Hearings Examiner 490 . An y g ($ ) application has been enclosed for your convenience. Application is not guarantee of approval. WETLANDS: Wetland vegetation was observed on site. A wetland delineation and categorization will be required to determine the wetland category, boundaries and buffer setback requirements. See the enclosed Mason County Resource Ordinance 17.01.070 Wetlands. Through this process the wetlands on-site would be mapped along with their associated buffers to determine what areas of the lot are located in and outside of wetland and stream buffer and setback areas. Repair/maintenance of existing roads are allowed within the wetland buffer provided the work is within the existing footprint. As with the stream buffer, any expansion/alteration will require review under a Mason Environmental Permit. Information regarding 4/26/2005 Page 3 of 4 SP12005-00119 Site Inspection 4/26/2005 Case No.: SP12005-00119 development in wetlands or their associated buffer is outlined in the enclosed Chapter 17.01.070 of the Mason County Resource Ordinance. A list of wetland consultants is also enclosed. If there are no areas for building outside of the wetland buffer, it is possible to apply for a Mason Environmental Permit to reduce the standard wetland buffer if impacts can be mitigated. Permits can be issued when the applicant can demonstrate that the activity is both unavoidable and necessary. CRITICAL AQUIFER RECHARGE AREA: The proposed project lies within a Class III Critical Aquifer Recharge Area. Title notification will be required per the provisions of the Ordinance. Enclosed please find a copy of the CARA chapter and the title notification form. GENERAL PROCESS: Future site development including a site plan, showing all setbacks from property lines, slopes, streams, wetlands, and other improvements, will be needed for building permit application submittal. Specific standards for future development contained in County Codes may be found at the County website address http://www.co.mason.wa.us.
