Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Grace Miller Land Use Planner Mason County Planning Department 5/25/2010 Page 1 of 3 SP12010-00027 Site Inspection 5/25/2010 Case No.: SP12010-00027 Comments: Planner, Grace Miller, met with Mr. Smythe and inspected the property.The purpose of the inspection was to determine which Planning Department regulations apply to development of the parcel and if there are any portions of the parcel that could be considered as uplands and therefore buildable with a Mason County Environmental Permit. While on site, staff first observed that there is no access to the parcel. In order to get to the site we had to cross private property off of Shelton Matlock Road and then cross the Simpson railroad tracks. The tracks run across Goldsborough Creek and this is the southwest corner of the property. The fill for the tracks slopes down to standing water, the entire length of the parcel where it parallels the tracks and beyond. The property consists entirely of Goldsborough Creek and its associated wetlands. There are no uplands on it. There is no evidence of old fills or roads, no power or utilities. A Mason Environmental Permit, reviewed under the Wetland Chapter of the Mason County Resource Ordinance, cannot be obtained by the applicant to develop on the parcel because there are no uplands to work with. The wetland is quite extensive with diverse wetland plants, characteristics and values. No formal wetland evaluation of the site has been conducted. In staffs estimation, the wetland meets the Category I Wetland Criteria of the Mason County Resource Ordinance. Therefore all proposed development within 300' of it or its edge would be regulated by the Planning Department under the Catgory I Wetland criteria. The parcel is very limited to actvities allowed within the wetland itself. Those activities are listed within the Mason County Resource Ordinance Wetland Chapter 7.01.070, (D),(2). Some of those activities include conservation or preservation, outdoor recreational activities that do not have a significant adverse impact on the wetland and its buffer, education, scientific research, etc.. In addition, Goldsborough Creek is regulated by the Mason County Shoreline Master Program as a Rural Shoreline Environment and a Type I Water. All development within 200' of the creek would be regulated by the Policies and Use Regulations of the applicable Shoreline Master Program chapter pertaining to that proposed development. This jurisdiction is increased because the associaed wetlands are regulated to their edge by the Master Program so this jurisdiction extends thousands of feet. The Resource Ordinance then requires a 250' buffer from the wetland edge to all development. 5/25/2010 Page 2 of 3 SP12010-00027 Site Inspection 5/25/2010 Case No.: SP12010-00027 All of the wetlands on the parcel are considered "Associated Wetlands" to Goldsborough Creek and therefore are regulated by both the Mason County Shoreline Master Program and the Mason County Resource Ordinance. The Master Program PROHIBITS landfill within associated wetlands. This would make the wetlands undevelopable with any fill for residential construction, septic systems and roads, etc.. The entire parcel appears to be located within a Flood Zone A as indicated on the enclosed FEMA Flood Insurance Rate Map, Community-Panel Number 530115 0190 C. Therfore it is also subject to the Flood Damage Prevention Ordinance requirements. In addition to the railroad tracks on the southern property line border, the parcel is surrounded on all sides by associated wetlands to Goldsborough Creek. This combination of restrictions prohibits creating a new access to the parcel from all sides. If a bridge were proposed as an access from the northwest, the owner would need to obtain easements from the private property owners and obtain an approved Shoreline Substantial Development and Conditional Use Permit. It is unlikely that Planning staff would recommend approval of this shoreline permit because there are no uplands on the parcel for the owner to access. It would essentially be a bridge into wetlands. The Decision to approve or deny a shoreline permit is made by the Mason County Hearing Examiner through the public hearing process. The fee schedule for permits is enclosed. Given the fact that the parcel is completely within jurisdictional wetlands and the creek, staff would like to add that permits for any proposed development within it would also include approvals from the State Department of Fish and Wildlife and the US Army Corps of Engineers would also be required.
