Although this zoning limits building sizes to 4,500 square feet for single tenant and 7,500 square feet for multiple tenants, Genie and I presented the question at a Staff Meeting because the cold frames are atypical structures that would not require a building permit. We confirmed that even cold frames meet the definition of'building' in the Mason County Development Regulations, therefore each cold frame may not exceed 4,500 square feet. An engineered stormwater plan would also likely be required (when impervious exceeds 5,000 square feet). In addition, you will need to hire a habitat biologist to evaluate whether there is a wetland in the vicinity, and if so, determine the boundaries and the buffer widths. The biologist would also need to determine if the drainage/creek on or near the property is a stream, and if so, what the 'type' is. If the proposed structures or other development are within the habitat buffers of a wetland or stream, the biologist will need to provide a mitigation plan (Habitat Management Plan) and show that the proposed structures are set back from the critical areas, as much as feasible. The Habitat Management Plan will need to meet the requirements of MCC 8.52.110.6 for if development is proposed in a wetland buffer, and MCC 8.52.170.j if development is proposed in a stream buffer. I have attached a list of area biologists to assist you with your search. In order to continue the plan review our office will require additional information which is listed below. 1) In order to properly evaluate that the exit system is maintained in the existing structure our office will need to have a floor plan, drawn to scale, of the existing building that contains the office, restroom, storage and sectors 1, 2, 3, and 4. The provisions of Washington State Chapter 19.27 RCW., Provisions of the construction code do not apply to temporary growing structures used solely for the commercial production of horticultural plants including ornamental plants, flowers, vegetables, and fruits. "Temporary growing structure"means a structure that has the sides and roof covered with polyethylene, polyvinyl, or similar flexible synthetic material and is used to provide plants with either frost protection or increased heat retention. A temporary growing structure is not considered a building for purposes of the building and fire code. Building department and fire-life-safety review shall not be required for a temporary growing structure. 5) The site plan submitted with the Change in Tenant application form specifies that an 8-ft fence will be constructed. A separate building permit shall be required for the fence greater than 7-ft above grade. Please respond in writing to the comments listed above.
