That this FPA is in conformance with the following Mason County ordinances: 11.05 That the proposed FPA involves 4 acres on two parcels. That the notifications required by 11.05.060 have been made if applicable. The Port recently harvested timber in this vicinity to clear obstructions from our temporary runway and inadvertently removed trees from the property of Mrs. Nye. As previously agreed, the Port of Shelton hired Jim Frost of Lusignan Forestry, Inc. to perforun a stumpage cruise along the southwest of parcel number 420122300000, owned by Mrs. Rose Nye. The Port and Mrs. Nye agreed that the Port will pay the value of the harvested trees, based the stumpage cruise, which established a lump surn value of$1,924.00, in order for the Port to provide just compensation to Mrs. Nye. In addition to the financial compensation,the Port and Mrs. Nye agreed that the Port will remove the stumps, grade smooth the area where tree harvesting occurred, move the stacked log pile up next to the house, and spread grass seed to revegetate the disturbed area. Please note that stumping and grading will not occur in the WSDOT right-of-way due to concerns over steep slopes and potential erosion that could result. I have now reached your submittal in my permit backlog and am starting off by reviewing for completeness.Here is a list of items that I need before FPA 19-11 can be approved: A complete FPA application(no application was found in the submittal).A fresh copy is being provided with this letter.Please be aware that the landowner needs to sign as well,which in this case includes Rose Nye for the small amount of her property that this application covers. As for the stormwater and erosion control narrative, limiting the narrative to just Minimum Requirement#2 is acceptable,if there is no more than 7,000 sq.ft of ground disturbance and no more than 2,000 sq.ft of new impervious surfaces,provided that the narrative,address all 12 criteria,not just the four provided:This is so even when the other eight criteria are not applicable. In recent weeks,forester Joe Staley has been in touch with me and it sounds like an engineered stormwater and erosion control plan is being prepared for the 3-acre site.My suggestion is that approval of the FPA follow approval of the engineered stormwater plan(which will be reviewed by Fred Perryman in MCPW). The project involves runway pavement milling,asphalt pavement overlay, replacement of runway edge lighting and runway signage,and paint striping. Since the project will require closing the active runway for approximately forty five days,beginning around August 5`h,the Port intends to activate the parallel taxiway("Taxiway A")as a temporary runway("Temporary Runway 5/23")to minimize impact to airport users/tenants. The Port's engineering consultant, Century West Engineering,and the FAA have determined that approximately three acres of trees located along US101 are currently obstructions to the approach end of Temporary Runway 23 and have been declared an "airport hazard". The obstructions in question are trees located along US Highway 101 and south of Airview Road,as shown on the attached Exhibit A Temporary Runway Obstructions(aerial sketch). RCW 14.12.010 defines"Airport Hazards"as any". . .tree . . .which obstructs the airspace required for flight of aircraft in landing or taking-off at an airport or is otherwise hazardous to such landing or taking- off of aircraft". RCW 14.12.020 further defines Airport Hazards contrary to public interest, ". . . if of the obstruction type in effect reduces the size of the area available for the landing,taking-off and maneuvering of aircraft thus tending to destroy or impair the utility of the airport and the public investment therein." Mason County code allows for the removal of trees that create a hazard when there is an imminent danger to public health and safety without requiring an Environmental Permit,or a Forest Practice Permit.These hazard trees have been determined to be obstructions to the Airport Flight Pattern.The trees will be cut down at the base using a mechanized timber harvester(aka "shovel")by the successful bidder for this emergency timber sale. There are no wetlands or significant steep slopes located in this area and the timber harvest will be quick and of minimal impact. The fact that these trees present an eminent hazard to the flight operations at the Airport warrants immediate action.Your timely attention to this request would be much appreciated. Sincerely, ^A .
