You should be aware that all development applications are subject to an order of invalidity issued by the Western Washington Growth Management Hearings Board, effective January 14, 1999 . The effect of this order is that Mason County will not be able to issue some types of permits until the invalidity is removed. Enclosed is a pubic notice that explains the situation in more detail . You are proposing to convert an existing vacant commercial structure into a convenience store. According to the Mason County Comprehensive Plan your facility is located in a portion of the county that has been designated as Shelton Urban Growth Area. According to the recently invalidated Mason County land use matrix (Development Regulations figure 1 . 03 . 020) a facility such as yours would be classified as a conforming land use. I understand that you have already scheduled a Pre-Submission meeting for your project. At that meeting, representatives of the various county departments will explain their regulations to you. After the meeting, you may submit your permit application, understanding that such application is subject to the order as described in the Notice to Applicant.
