You have brought up several issues that I would like clarified:
1) Where in the codes and regulation does it require the property owner to prove/demonstrate to the
Planning Dept. that site constraints can't be overcame by an administrative setback variance?As I
stated in earlier emails they don't want one. If and when the road is built in the easement they do not
want their house closer to the road!
I think it is ultimately the director's call if a lot is subject to site constraints to the degree that 17.03.030.0
contemplates.You will have to work this out with Barbara and Allan. I have nothing more to add to
that discussion.
2) You keep bringing up that the lots are un-platted, where in the codes and regulations does it
differentiate between platted and un-platted lots?According to 16.18.100 a lot is a lot.
16.40.045.c is very clear on this. For the purposes of lot combining, 16.18.100 does not over ride
16.40.045.
3) How does it serve the property owner by the Planning Dept. requiring the lots to be combined with a
'BLA' (a very expensive process) compared to a 'Declaration of Parcel Combination' (a very simple and
inexpensive process)?
When DPCs were introduced back in the mid '90's the intent was to grant relief to people with platted lots
(example Lake Land Village Div X,Lots Y and Z) and as I understand it the DPC was only available to
unmodified platted lots (later expanded to include short plats and large lot plats) due to the simplicity
of the legal descriptions. Personally I would not be opposed to differentiating the "lot combination
BLA" from the standard BLA, perhaps with a lower review fee. But that isn't the way our code is
currently structured so we have to live with the code we have.
All awhile as the Planning dept. preventing what the Smith's want to build on their property, keep in mind
their permit is being delayed.
Allan Borden can tell you the status of the building permit review. I don't know that this discussion is

affecting the status of your permit in Allan's case load. As far as I can tell, he hasn't yet made a
determination of"completeness" on this case. -- Michael

I agree that per 16.08.100 your lots are "lots." But that was never in question.
Today I again discussed you situation with Barbara Adkins and Allan Borden. As for the exception
contained in 17.03.030.C,we don't see that you have demonstrated that the site constraints can't be
overcome with an administrative front yard setback variance.
Until you can satisfy the County (really Barbara and Allan as I shouldn't be directly involved in that
question)that the site constraints make 10' front yard setbacks unachievable,the question of whether a
"declaration of parcel combination" or "lot combination boundary line adjustment" as described in
16.40.045.(3) is moot. However there is no mystery to this. If you can convince the County that your
site constraints justify the combining of these two lots,the lot combination boundary line adjustment
(which for practical purposes is the same as any other kind of BLA) is the only way to combine these
lots as they are unplatted.
One other thing. As you know, surveys are not required for BLA's of any sort,but are you aware that
per 17.10.0460.e, a survey is required for most building permits in the Allyn UGA?Certainly
something to be aware of.
17.10.460 - Setbacks.

Proof of survey is required for any building permit for a new building or expansion of the building
footprint. The survey shall be no older than ten years unless the relevant survey monuments are visible.
I will be out of the office next week.I hope that these questions can be worked out with Barbara and
Allan while I am away.
