Applicant. The applicant is Jayson Miller of TN Miller Remodeling, LLC 23 (1670 E. Benson Lake, Grapeview, WA 98546) on behalf of the North Bay Lutheran 24 Church located at 221 E.Lakeland Way,Allyn, Washington 98524. 25 2• Hearing. A hearing was held on the application on May 8,2019,at 1:00 pm in the Mason County Board of Commissioners Meeting Chambers. Substantive: SUP P. 1 Findings,Conclusions and Decision w 1 3. Site/Proposal Description. The applicant seeks a special use permit(SUP) 2 to add a two-floor addition(2,400sf total)to an existing church in the Allyn UGA—R- 3 (High Density Multi-Family Residential Zone). The addition will add 1,200sf to the 3 exiting footprint of the church. The existing church is already two stories tall. The church is located on Lakeland Way in Allyn. 4 There are no critical areas on or near the site. Slopes are mild with an approximate 10% 5 grade. The site is outside of the shoreline jurisdiction. The addition will remove eight 6 of the existing pages. The applicant plans to add seven spaces, for a loss of one space overall. 7 There are 51 existing parking stalls and a small section of lawn and landscaping on the 8 property. 9 4. Characteristics of the Area. The area is characterized by a mix of 10 commercial and residential uses. Surrounding properties either share the subject's zoning(Allyn UGA -High Density Multi-Family Residential Zone (R-3) zone)or are 1 1 zoned Residential R-2 or R-1P. 12 5. Adverse Impacts of Proposed Use. According to the information provided by staff in its report and testimony, there does not appear to be an impact on I' surrounding properties for traffic,parking,or drainage.The attendance numbers for the 14 church are expected to stay the same after the addition given the changes are meant to make the existing building more functional without adding seating capacity. The 15 addition would be shielded from adjacent properties by the bulk of the existing church building(Ex.3).The addition only results in the loss of one parking space. Staff reports 16 that the proposal will not lower level of service standards below adopted minimums for 17 transportation facilities. Given these factors, the proposal creates. no discernable adverse impacts. The proposal is SEPA exempt. 18 CONCLUSIONS OF LAW 19 Procedural: 20 21 1 Authority of Hearing Examiner. MCC 15.03.050(J) and 17.05.42 provide the Examiner with the authority to review and act upon Special Use Permits. 22 23 Substantive: 24 2. Zoniniz. The area is zoned Allyn UGA—R-3 (High Density Multi-Family Residential). 25 3. Review Criteria and Application. MCC 17.11.540 governs churches in the R-3 district. Under MCC 17.11.540(a), churches in the R-3 zone shall be subject to a Special Use Permit. The review criteria for the Special Use Permit application are SUP p. 2 Findings,Conclusions and Decision t governed by MCC 17.05.044. These criteria, in addition to miscellaneous criteria for 1 all Hearing Examiner decisions, are quoted and addressed below. 2 3 4 MCC 17.05.044 SPECIAL USE REVIEW CRITERIA: 5 (1) That the proposed use will not be detrimental to the public health, safety and 6 welf ire. 7 4. There are no significant adverse impacts associated with the proposal as determined in Finding of Fact No. 5. Given these factors,there will be no detrimental 8 impact to the public health, safety, and welfare as a result of the proposed church addition. 9 10 (2) That the proposed use is consistent and compatible with the intent of the Comprehensive Plan. 11 5. The proposal is consistent and compatible with the intent of the 12 Comprehensive Plan as described in Section VII of the Staff Report (Ex. 1), herein 13 adopted as if set forth in full. 14 (3) That the proposed use will not introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and 15 the community at large. 16 6. No hazardous conditions are expected, nor have any been identified as a 17 result of the proposed church addition. No adjacent properties, nor the community at large, will be impacted by the introduction of hazardous conditions from the church 18 addition. 19 (4) That the proposed use is served by adequate public facilities which are in place, or planned as a condition of approval or as an identified item in the County's Capital 20 Facilities Plan. 21 7. As noted in the Staff Report(Ex. 1),the church is currently served by public 22 facilities.The new addition is not expected to impact the availability of public facilities. This criterion is met. 23 (5) That the proposed use will not have a significant impact upon existing uses on 24 adjacent lands. 25 8. As determined in Findings of Fact No. 5, no significant impacts are expected to result from this proposal, including impacts on adjoining properties. SUP p. 3 Findings, Conclusions and Decision (6) If located outside an Urban Growth Area, that the proposed use will not result in 1 the need to extend urban services. 9. The proposal is located within the Allyn Urban Growth Area. 4 MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW: 5 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review proposed 6 development according to the following criteria: 7 1. The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 8 2. Development does not impact the public health, safety and welfare and is in 9 the public interest. 10 3. Development does not lower the level of service of transportation and/or 11 neighborhood park facilities below the minimum standards established within the Comprehensive Plan. 12 10. According to staff, the proposed development complies with the Mason 13 County Code, including Title 6 and 8.The project is not subject to Title 16 which only 14 governs subdivisions. As confirmed by staff in the staff report, the proposed church expansion should not lower the level of service of transportation and/or neighborhood 15 park facilities below the minimum standards established within the Comprehensive Plan.The project will also have no adverse impact upon health,safety and welfare since 16 it will not create any significant adverse impacts as determined in Finding of Fact No. 5. 17 18 DECISION 19 The proposed Special Use Permit is consistent with all applicable SUP standards as outlined above and is approved. 20 21 Dated this 9th day of May 2019. 22 - 23 Hearing E finer Pro Tern Mason County 24 25 APPEAL The decision of the Hearing Examiner is final and may be appealed to superior court as outlined by the Washington State Land Use Petition Act, Chapter 36.70C RCW. STAFF REPORT I. Introduction. This report evaluates a proposal in Allyn UGA—R-3 (High Density Multi-Family Residential Zone) for a proposed two floor addition of approximately 2,400 square feet(consisting of an approximate 1,200 sq. ft. expansion to the existing building footprint of a church). Per MCC 17.11.540, churches and any associated expansions are allowed in the R-3 zone pursuant to obtaining an approved Special Use Permit. The existing church and the proposed addition is located on parcel#122202460040. Staff is recommending approval of the Special Use Permit. II. Applicant. Jason Miller III. Property Location. 221 E.Lakeland Way,Allyn, WA 98524 IV. Date of Complete Application: January 25, 2019 V. Evaluations. A. Characteristics of the site.The property is located on Lakeland Way within the Allyn Urban Growth Area. The site is pre-developed with an existing two-story building serving the North Bay Lutheran Church. See site plan(Exhibit 3) and aerial maps (Exhibit 4). There are no critical areas present on or near the site. The site contains a mild slope with an approximate 10%grade. The site also contains 51 existing parking stalls and a small section of lawn and landscaping within the back portion of the property. North Bay Lutheran Church DDR2019-00008 Page 1 of 4 B. Characteristics of the area. The subject parcel is located within the Allyn UGA-High Density Multi-Family Residential Zone(R-3)zone. The site is surrounded by Residential R-2 and R-1P to the north;Residential R-3 to the west and south; and Village Commercial (VC)to the east. The general surrounding area consists of a mix of existing commercial and residential uses. C. Shoreline Designation. Not Applicable. D. Comprehensive Plan Designation/Zoning. The Mason County Comprehensive Plan designation for the site is Urban Growth Area,known as the Allyn UGA. The implementing zoning designation for this site is High Density Multi-Family Residential Zone (R-3). VI. SEPA Compliance and other public notice requirements. The proposal is exempt from SEPA per WAC 197-11-800 (1)(c). The proposal involves a two floor, approximate 2,400 sq. ft. addition to a pre-existing church building. The building footprint will be increased by approximately 1,200 sq. ft. Notice of Application and Notice of Public Hearing for a Special Use Permit were posted in the Mason County Journal on April 18, 2019; and at two public places(the subject property and the Mason County Commissioners Building)on April 15, 2019. In addition,the Notice of Application and Notice of Public Hearing were mailed to all property owners within 300' of the proposal. VII. Analysis. A Comprehensive Plan Review: Type III review for permit applications require that the Hearing Examiner evaluates the proposal for consistency with the County's Development Code,adopted plans and regulations. The Hearing Examiner shall review the proposal according to the following criteria: 1) The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 15 and 17. The development does not conflict with the Comprehensive Plan and meets all the requirements and intent of the Mason County Code. 2) The development does not impact the public health, safety and welfare. The development proposal will not introduce hazardous conditions nor impact the adjacent lands,public health, safety or welfare, as the proposal is intended to improve the floor plan and functionality of an existing church building. 3) The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. The project is located within the Allyn Urban Growth Area and will be served by adequate public facilities. The development proposal will not lower the LOS for transportation or neighborhood parkfacilities, as the subject addition is to an existing church and is not intended to increase occupancy capacity. The addition is intended to improve the floor plan and functionality of the building with a safer entrance, larger foyer, and increased office and classroom space. This proposal requires a Special Use Permit due to the requirements of the Mason County Development Regulations(MCDR)—Allyn UGA-High Density Multi-Family North Bay Lutheran Church DDR2019-00008 Page 2 of 4 Residential Zone(R-3) 17.11.540 (a). Churches and any associated additions are permitted with an obtained Special Use Permit within this zone. Special Use Permit review criteria: See applicant's statements in Exhibit 2. 1. Will the proposed use be detrimental to the public health, safety and welfare? No, staff concurs with applicant's response. The proposed expansion does not increase the foot print of the common areas of the sanctuary and fellowship hall, subsequently, not increasing the occupancy capacity of the existing structure. The proposed expansion does improve the floor plan and functionality of the building by increasing the size of the foyer, classrooms and offices, etc. No new impacts to the community of Allyn will be created. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? The proposed use is consistent and compatible with the Comprehensive Plan Chapter III Allyn UGA, goals and objectives relating to economic commercial growth and by providing recreational, educational and community event and outreach opportunities. Comprehensive Plan General Land Use Goal, GLU 12, states, "Ensure commercial uses in the urban growth areas that serve a regional market as well as citizens of the UGA's, and include retail, service,financial, and institutional uses of a small, medium and large size". 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? The facility will be used to operate a pre-existing church. Based on the existing church use and the subject proposed addition, there will not be a need to introduce any hazardous conditions or materials. No hazardous conditions are expected as a result of the proposal. The building provides restrooms that are hooked up to the sanitary sewer. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Public facilities, which are in place, are currently adequate to serve the proposal in terms of water, sanitary sewer and stormwater. Transit service and bus stops are located within proximity, along State Route 3. 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? Staff concurs with applicant's response. There will be no significant impact upon existing uses on adjacent lands. The building occupancy is not being increased. The site provides for 52 off-street parking stalls. Churches typically necessitate 1 stall for every 3 seats within the largest assembly area, in accordance with current MCC 17.14.050 parking standards. According to the site plan provided, the church with the proposed addition, would require 52 parking stalls (154 seats divided by 3 = 51.3), therefore, the site is in conformance with parking regulations. Staff does not find that the subject building addition will be detrimental to the general public, as the proposed addition will not intensify the use of the existing church occupying the subject site. No. The project site is located within the Allyn UGA. VH1. Conclusions: The project in its entirety conforms to the minimum requirements and standards set forth in the Mason County Development Regulations 17.11. The Special Use Permit review criteria have all been met satisfactorily. Staff recommends approval. IX. Choices of Action. 1. Approve. 2. Approve with conditions. 3. Deny with prejudice (reapplication of resubmittal is not allowed for one year). 4. Remand for further proceedings and/or evidentiary hearing in accordance with Section 15.09.090 of Title 15. No. The existing Community Church has not and will not pose a detrimental effect to the public health, safety and welfare. The proposed expansion does not increase the foot print of the common areas of the sanctuary and fellowship hall thus not increasing the occupancy of the existing structure. The proposed expansion does improve the functionality of the building be increasing the size of the foyer and rearranging the stairs to create a safer entrance into the church. It also upgrades the bathrooms to more efficient water saving fixtures. Some of the office and classroom spaces will be slightly enlarged as well. There will be no new impacts on the community of Allyn. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? The Community Church and its proposed expansion is consistent and compatible with the Allyn Urban Growth Area Plan, which allows for places of assembly in the multi family zones with an approved Special Use Permit. 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? No hazardous conditions are expected as a result of the existing Community Church or its proposed expansion. The nearly three (3) acre parcel is large enough to accommodate any necessary additional parking and adequate traffic circulation. The property slopes downward from the northwest to the southeast and is mapped as stable. Stormwater will be adequately addressed and will not impact neighboring properties. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Public facilities, which are in place, are currently adequate to serve the Community Church and its expansion. 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? Lakeland Way, Allyn, WA 98524 IV. Date of Complete Application: January 25, 2019 V. Evaluations. A. Characteristics of the site. The property is located on Lakeland Way within the Allyn Urban Growth Area. The site is pre-developed with an existing two-story building serving the North Bay Lutheran Church. See site plan(Exhibit 3)and aerial maps (Exhibit 4). There are no critical areas present on or near the site. The site contains a mild slope with an approximate 10%grade. Characteristics of the area. The subject parcel is located within the Allyn UGA-High Density Multi-Family Residential Zone (R-3)zone. The site is surrounded by Residential R-2 and R-lP to the north; Residential R-3 to the west and south; and Village Commercial (VC)to the east. The general surrounding area consists of a mix of existing commercial and residential uses. C. Shoreline Designation. Not Applicable. D. Comprehensive Plan Desi n�/Zoning. The Mason County Comprehensive Plan designation for the site is Urban Growth Area, known as the Allyn UGA. The implementing zoning designation for this site is High Density Multi-Family Residential Zone (R-3). VI. SEPA Compliance and other public notice requirements. The proposal is exempt from SEPA per WAC 197-11-800 (1)(c). The proposal involves a two floor,approximate 2,400 sq. ft. addition to a pre-existing church building. The building footprint will be increased by approximately 1,200 sq. ft. Notice of Application and Notice of Public Hearing for a Special Use Permit were posted in the Mason County Journal on April 18, 2019; and at two public places (the subject property and the Mason County Commissioners Building) on April 15, 2019. In addition, the Notice of Application and Notice of Public Hearing were mailed to all property owners within 300' of the proposal. VII. Analysis. A Comprehensive Plan Review: Type III review for permit applications require that the Hearing Examiner evaluates the proposal for consistency with the County's Development Code, adopted plans and regulations. The Hearing Examiner shall review the proposal according to the following criteria: 1) The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 15 and 17. The development does not conflict with the Comprehensive Plan and meets all the requirements and intent of the Mason County Code. 2) The development does not impact the public health, safety and welfare. The development proposal will not introduce hazardous conditions nor impact the adjacent lands,public health, safety or welfare, as the proposal is intended to improve the floor plan and functionality of an existing church building. 3) The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. The project is located within the Allyn Urban Growth Area and will be served by adequate public facilities. The development proposal will not lower the LOS for transportation or neighborhood park facilities, as the subject addition is to an existing church and is not intended to increase occupancy capacity. The addition is intended to improve the floor plan and functionality of the building with a safer entrance, larger foyer, and increased office and classroom space. This proposal requires a Special Use Permit due to the requirements of the Mason County Development Regulations(MCDR)—Allyn UGA- High.Density Multi-Family North Bay Lutheran Church DDR2019-00008 Page 2 of 4 Residential Zone (R-3) 17.11.540 (a). Churches and any associated additions are permitted with an obtained Special Use Permit within this zone. Special Use Permit review criteria: See applicant's statements in Exhibit 2. 1. Will the proposed use be detrimental to the public health, safety and welfare? No, staff concurs with applicant's response. The proposed expansion does not increase the foot print of the common areas of the sanctuary and fellowship hall, subsequently, not increasing the occupancy capacity of the existing structure. The proposed expansion does improve the floor plan and functionality of the building by increasing the size of the foyer, classrooms and offices, etc. No new impacts to the community of Allyn will be created. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? The proposed use is consistent and compatible with the Comprehensive Plan Chapter III Allyn VGA, goals and objectives relating to economic commercial growth and by providing recreational, educational and community event and outreach opportunities. Comprehensive Plan General Land Use Goal, GL U 12, states, "Ensure commercial uses in the urban growth areas that serve a regional market as well as citizens of the UGA's, and include retail, service,financial, and institutional uses of a small, medium and large size". 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? The facility will be used to operate a pre-existing church. Based on the existing church use and the subject proposed addition, there will not be a need to introduce any hazardous conditions or materials. No hazardous conditions are expected as a result of the proposal. The building provides restrooms that are hooked up to the sanitary sewer. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Public facilities, which are in place, are currently adequate to serve the proposal in terms of water, sanitary sewer and stormwater. Transit service and bus stops are located within proximity, along State Route 3. 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? Staff concurs with applicant's response. There will be no significant impact upon existing uses on adjacent lands. The building occupancy is not being increased. The site provides for 52 off-street parking stalls. Churches typically necessitate I stall for every 3 seats within the largest assembly area, in accordance with current MCC 17.14.050 parking standards. According to the site plan provided, the church with the proposed addition, would require 52 parking stalls (154 seats divided by 3 = 51.3), therefore, the site is in conformance with parking regulations. Staff does not find that the subject building addition will be detrimental to the general public, as the proposed addition will not intensify the use of the existing church occupying the subject site. No. The project site is located within the Allyn UGA. VIII. Conclusions: The project in its entirety conforms to the minimum requirements and standards set forth in the Mason County Development Regulations 17.11.
