Archaeological or historical resources, such as ruins, sites, buildings, artifacts, fossils, or other objects of antiquity that may have significance from an historical or scientific standpoint,which may be encountered by the developer/contractor, shall not be further disturbed. If the developer/contractor encounters any such artifacts, he/she shall immediately stop work and notify Mason County and the Washington State Department of Archaeology and Historic Preservation. Failure to do so may result in civil penalties. " 2. STORM WATER& EROSION CONTROL. Escape of silty water or mud from this property shall be considered a violation of County and State storm water management regulations and could subject the applicant(s)to civil fines or penalties. A stormwater and erosion control Minimum Requirements 1-5 narrative shall be submitted to Mason County and approved as complete prior issuance of this permit. During the logging period, the erosion &sediment control facilities shall be upgraded as needed for unexpected storm events and to ensure that sediment and sediment-laden water do not leave the site. 3. HOURS OF OPERATION. Noise associated with this application shall not exceed what is allowed under Mason County Code 9.36. Harvest operations shall start no earlier than 7:00 AM and shall end before 8:00 PM on a daily basis. SLASH ABATEMENT. This Forest Practice Application indicates that forest debris resulting from the proposed logging operation may create an extreme fire hazard under RCW 76.04.600 and WAC 332-24-650.An extreme fire hazard could be created if one or more of the conditions found in WAC 332-24-650 is located within 100 feet of the running surface of a public road; or is within 500 of an existing structure and/or designated public use area, which is not owned by the owner of the fire hazard area. The land owner is fully liable in the event of fire, if he or she fails to appropriately abate the hazard. Extreme fire hazards shall be abated by removing the forest debris, or by other means approved by the Washington State Department of Natural Resources (DNR). * 5. STREAM SETBACKS. Cutting setbacks as documented in the Delineation Report, prepared by prepared by Ecological Land Services, dated November 18, 2020, shall be adhered to. The minimum vegetative buffer for the Type Ns stream (non- fish, perennial), is 75'from the edge of the stream channel. This buffer shall be flagged and observed. * 6. WETLAND SETBACKS. Cutting setbacks as documented in the Delineation Report, prepared by prepared by Ecological Land Services, dated November 18,2020, shall be adhered to. The minimum vegetative buffer for Wetland A (classified as a Category III wetland)is 150'. The minimum vegetative buffer for Wetland B (classified as a Category IV wetland) is 40'. These buffers shall be flagged and observed. * 7. LANDSLIDE HAZARD SETBACK. All tree cutting will be setback a minimum of 200'from slopes of 40% or greater. * 8. CLEARING LIMITS. The boundaries of the clearing limits shown on the submitted site plan shall be clearly flagged in the field prior to logging. During the logging period, no disturbance beyond the flagged clearing limits shall be permitted. The flagging shall be maintained by the applicant/contractor for the duration of construction. * 9. MAINTAIN BMP'S.All temporary and permanent erosion &sediment control BMP's shall be maintained and repaired as needed to assure continued performance of their intended function.All temporary erosion and sediment control BMP's shall be removed within 30 days after the final site stabilization is achieved or after the temporary BMP's are no longer needed. APPLICANT: Clyde Corbin APPLICATION DATE: July 7, 2023 PARCEL#'S: 32212-75-00110 TOTAL ACERAGE OF CLEARING: 0.28 Acres Mason County has reviewed the above referenced application for Class IV General Forest Practices and finds it in conformance with all applicable County land use regulations in effect at the time of application. FINDINGS The proponent has paid the prescribed fees. Yes. The proponent has filed a complete,signed application. Yes. A map has been received that complies with the requirements of 11.05.120: a) Harvest boundaries and tree retention areas. Yes. b) The approximate location of any structures. N A no development has occurred on the site yet. 1 FPA2023-00009, SEP2023-00044 Corbin c) The location of all existing and proposed streets, right-of-ways, easements, skid roads, haul roads, and landings within the proposal. Yes. d) The location of future land development including stormwater management facilities and vegetation to be retained for site landscaping, open space, wildlife habitat, screening, and/or buffers. Yes. e) Site topography at contour intervals of 40 feet. NIA. f) Critical areas and critical area buffers regulated pursuant to the Critical Areas Ordinance. Yes. g) Drainage ways and culverts. None. h) Site area targeted for further harvest including proposed timing. NIA. i) North arrow and scale shall be shown on all site plans.The scale shall be no smaller than one inch to 200 feet. Yes. That this FPA is in conformance with the following Mason County ordinances 11.05: a) That the proposed FPA involves 0.28-acres of the 5.23-acre site. Yes, the site plan shows the 0.28-acre area(12,000 sgft) that will be cleared. b) That the notifications required by 11.05.060 have been made if applicable. The Skokomish Tribe was notified through the SEPA process. Note: Harvest unit is greater than 500 ft from a State Park. c) Granting project approval will not be detrimental to public health, safety and general welfare. Yes. 2 FPA2023-00009, SEP2023-00044 Corbin d) Granting project approval will not be injurious to the property or improvements adjacent to and in the vicinity of the proposal. Yes. e) Granting project approval will not result in significant adverse environmental impacts. Yes. f) The project meets Mason County's submittal standards checklist and is consistent with the development standards. Yes. g) The project is consistent and compatible with the goals, objectives, and policies of the comprehensive plan, appropriate community plan, and the provisions of this chapter. Yes. Mason County Resource Ordinance The issuance of this permit will not result in a violation of the Mason County Resource Lands and Critical Areas Ordinance. The site was inspected by Michael MacSems of the Mason County Planning Department, who determined that any critical area buffer and/or steep slope issues have been sufficiently documented in the Delineation Report, prepared by Ecological Land Services, dated November 18, 2020. All project activities are outside of wetland, stream, and landslide hazard area buffers. The project is also located within a Highly Critical Aquifer Recharge Area, but there are no Mason County requirements for clearing vegetation within Critical Aquifer Recharge Areas. Geo-Technical Report/Assessment Review N/A, it was estimated that the east side of the harvest unit is about 250 feet from the top of slope. The Site Pre-Inspection Report for SP12019-00082 states that, "If the proposed project will be located within 200'of slopes greater than 405vo, a Geotechnical Report will be required..."Therefore, the requirement for a Geotechnical Report was waived for this permit. A Limited Geological Evaluation letter, prepared by Cobalt Geosciences, LLC, dated May 11, 2021, was submitted with the application, but does not satisfy any regulatory requirements. Washington State Department of Transportation A DOT Access Permit is not required for this proposal. Date Approved by DOT: NIA Mason County Road Access Permit N A there is existing road access. 3 FPA2023-00009, SEP2023-00044 Corbin Shoreline Master Program A portion of the site is within the Conservancy shoreline environmental designation. The proposed clearing limits are outside of the shoreline jurisdiction (200 feet from OHWM). All activities under this application are in conformance with the Mason County Shoreline Master Program. State Environmental Policy Act This application for FPA2023-00009 has been reviewed for SEPA compliance under case #:SEP2023-00044. a) Is SEPA exempt. No b) DNS Yes, issued by Kell Rowen of the Mason County Planning Department on August 29, 2023. The SEPA Determination of Non-Significance was emailed to the appropriate entities and posted on-site on August 29, 2023. The SEPA record number is 202304135. No comments were submitted. c) MDNS No Stormwater Management An engineered stormwoter plan for Mason County Public Works is NIA due to ground disturbance of less than %of an acre (32,670 sqft). The site plan shows that land- disturbance will be 12,000 sqft. The project requires Minimum Requirements#1 through #5 of the 2014 Stormwater Management Manual for Western Washington due to land- disturbing activities greater than 7,000 sqft. Narratives for Minimum Requirements#1 through#5 were submitted and meet the standards of the Manual. Permission from Underlying Property Owners: Yes. Permit Signed by Operator: Same as owner.
