Determination of the need for repair and the extent of restoration should remain under the County' s authority. Reimbursement for County expenses associated with their operation's impact would be a better way of assuring the continued present condition of the haul route. The excavation of 35,000 yds of material and backhaul of 10,000 yds of topsoil would create approximately 4,500 ten yard truck loads of material . This number of truck trips over a relatively short time will use up a significant portion of the road's useful design life. Identification of a source of water to be utilized for dust control, if needed. Water rights for irrigation generally cannot be used for dust control . 4 . We will require more specific information as to the "best management practices" being followed with regard to truck and equipment maintenance and clean-up procedures and materials. This should include information regarding any storage on-site of fuel and .oil and information regarding truck and equipment wash water run-off disposal (if any) . (On-site truck and equipment wash run- off shall be routed to a retention facilities equipped with an .oil- water separator prior to its release to settling ponds) . 5 . If the proposal calls for the in-hauling of soils from the Wal- Mart site, a letter of approval regarding the testing methodology and results of the soils analysis performed by RZA AGRA, Inc. must be received from the Washington State Department of Ecology (WDOE) . To date this notice has not yet been received. Concurrence with WDOE' s findings by our Health Services Department will be required. Also, specific quantities of materials to be hauled in must be provided. That quantity can be either separate from or in addition to the 35, 000 cubic yard figure but the submitted application form will need to be altered. 6 . MCDCD will require that this operation be in compliance with the Mason County Noise Ordinance #54-89 . The noise cannot exceed 65 dBA at any residential receiving property. At any hour of the day or night the applicable noise limitation may be exceeded for any receiving property by no more than: a. 5 dBA for a total of 15 minutes in any one-hour period; or b. 10 . dBA for a total of 5 minutes in any one-hour period; or c. 15 dBA for a total of 1.5 minutes in any one-hour period. The County/Municipality Recommendations form SM-6 was not included in the package you provided. The application process cannot continue without the completed form. The Standard Reclamation Plan SM-8A, page one, does Quigg Brothers plan on disturbing (including stripping) the entire 20 acres in three years, as indicated? Regarding SM-8A, page three, the permit and mining boundaries are not marked on the ground and are required before mining can occur. The 100-foot-wide permanent setback, adjacent to Island Lake Drive and other abutting ownerships, is a positive measure to buffer the proposed mining operation. SM-8A, page four, refers to a 150-foot-wide reclamation setback. The previous page referred to a 100-foot-wide setback, which figure is correct? Again, these setbacks must be marked on the ground before mining commences. SM-8A, page four, refers to a stream setback. The edge of the wetland, and not the flowing stream to the west, is the point where water related setbacks begin. Please revise the form accordingly. The Department of Ecology (DOE) will respond to your proposal when you clarify the situation. Please provide a written plan and an engineered drawing of the proposed segments. SM-8A, page five, the synthesizing of topsoil requires local permits from Mason County before the topsoil operation can commence. SM-8A, page 6, Reclamation Topography - is unclear in that you did not include an engineering drawing of what the site will look like when completed. Please provide these drawings in both plan and profile and include two cross-sections in cardinal directions to further define the ultimate configuration of the site. SM-8A, page 7, the policy and rules of the DNR do not allow backfilling to accomplish the reclamation without a backfilling plan. In the absence of an approved backfilling plan the site can only be mined to the ultimate slopes indicated on the reclamation plan. This is known as mining to reclaim and will be the intent of the reclamation plan for this site without the backfilling plan. As a point of information, the backfilling also requires that the material being imported onto the site be monitored and authorized for the backfilling operation by the local health department. This can be a major obstacle in the permitting process and in most cases not worth the effort. The DNR does not support this type of reclamation plan without detailed information and planning. SM-8A, page 9, - revegetation is addressed as a wet site, which indicates there is water in the area to be mined, please clarify this point. SM-8A, page 11, the maps provided are not adequate for the purpose of securing a Surface Mine Reclamation Pe."...it. Mason County will not sign off the project until you have provided certain specific information required for environmental review. The Department of Natural Resources cannot issue its permit until the county has signed the approval and they will not do that until you provide them with the additional materials. Also, I have received no information from Mr. Brown of Quigg Brothers McDonald, the applicant of the mining permit. From the DNR's perspective there are two options available at this time. -(hey are: * Continue with the current application and eventually issue a Reclamation Permit. McDonald) on November 30, 1993. This meeting was held to discuss the issues and concerns as they pertain to the removal of material and the spreading of material on your property in Sect. 1 , T. 20N. , Rg. 4 ( parcel 42001-41- 00040 ) . First let say that we appreciate you and Mr. Brown taking time out of your busy schedules to meet with us. During our meetingnumerous issues and concerns were discussed. b The outcome of this discussion was that it was agreed to y Mr. Brown and yourself that it would not be of any benefit to go through the County permit system and then the Department of Natural Resources permit system. It would be a duplication of effort and would be time consuming. Because of this Mr. Brown and yourself felt that instead of proceding with a new County permit or requesting a permit amendment to the existing permit that you would proceed with securing the required DNR permit. After further discussion it was agreed to that no further material would be removed from your site until a DNR permit was secured. This department pointed out that based on this decision the existing permit for removal of 20,000 cu. yds . was now null and void. This was agreed to. Any further activity is nbt permitted until the applicable permits are secured. It was also pointed out that there is concern for the material being brought to the site . Mr. Brown informed us that the material is currently being tested and that he will furnish us with a copy of the results . Until the material is confirmed it was agreed to that no further placement of such would be undertaken. This department suggests that once the testing is completed and confirmed that you contact Mr. Byrne regarding any permits that may be required.
