I am taking this opportunity to contact both of you regarding the
Island Lake gravel project. As you are aware we have received
phone calls and letters regarding this issue . The Board has also
been contacted. It is my understanding that as the project
currently exists there is not much we can do. A grading and
excavation permit has been issued and that conditions attached
thereto are being met.
It is now my understanding that a DNR permit has been applied for
which would allow the property owner to expand this operation. I
believe the Board also has this understanding.
We need to be working with the DNR on this project. I have
attached letters of concern from property owners regarding their
concern for this project and future proposals . Send copies of
these letters along with any others we have in the file to the DNR
for their consideration when processing the permit. We need to
send a letter to DNR expressing our concerns in addition to
pointing out that they should take into consideration where the
proposal is located and that we have had public input.
Contact is to be made with the DNR to determine where the permit is
in the process and if a SEPA determination has been made . Are we
on the mailing list?
Also, I have requested that contact be made with other county' s to
determine how they are handling similar situations . Have we made
any contacts? Please take the necessary steps to contact other
County' s and get with me .

RE : BURNETT LAND MODIFICATION PERMIT
The Mason County Department of Community Development is taking this
opportunity to follow up on our November 30 , 1993 meeting with John
A. Burnett (property owner ) and Wayne Brown(Quigg Bros. McDonald ) .
Others in attendance included Don Brush and Grace Miller.
The meeting was held to discuss the recent Land Modification Permit
issued to Mr. Burnett for removal of 20,000 cu. yds . of material on
property located in SE1/4 , NE1/4 , of Sect. 1 , T . 20, R4 W. ( parcel
no . 42001-41-00040 ) .
Numerous issues and concerns were discussed with both Mr. Burnett
and Mr. Brown. Mr. Brown informed those in attendance that it now
appeared that additional yardage was needed beyond the original
amount approved. Mr. Byrne and Mr. Yando informed him that if this
was indeed the case it would be necessary to either process a new
permit or seek an amendment to the existing permit. In either case
it would be necessary to process a environmental checklist and go
through the required review time .
The County pointed out that concerns for the project had been
received from some residents in the area who had also come to the
Board of County Commissioners meeting on November 30, 1993 to
express their concerns and to discuss the issues . The Department
of Community Development had been informed by thes citizens that
they intended to appeal the issuance and processing of the original
permit.
After discussing the operation Mr. Brown and Mr. Burnett informed
Mr. Byrne and Mr. Yando that they would be discontinuing any
further removal of material from the site until a Department of
Natural Resources Permit was issued. They felt that this would be
the best process available because it eliminated going through the
permit and environmental process twice . Mr. Yando pointed out that
as he understood their decision they would no longer use the site
for removal of material nor would any additional material be
deposited on site . This was agreed to by Mr. Brown and Mr.
Burnett. Mr. Byrne and Mr. Yando informed Mr. Brown and Mr.
Burnett that based on this agreement the existing permit was now
void and no further action is allowed.
Mr. Yando also pointed out that testing results of the material
being brought to the site need to be completed and forwarded to the
County for their review. Mr. Brown agreed to this .

I have the following comments regarding the above permit :
1. The permit states 35000 cubic yards is to be excavated. It
should be clear how much is being excavated from the Burnett site
and the amount being taken from Walmart and back hauled. The
permit must include all materials being moved from both sites .
2 . The check list indicates also that up to 30 acres could be
mined. It should be clear that this permit is for 35000 cubic
yards and this material should be specified at the site and be
limited to 35000 cubic yards .
3 . We will require complete engineering for current site activity
and for addtional excavation of site. This permit application will
go to Public Works for comment, proecessing and inspections.

Attached is a copy of the grading permit submitted 12/21/93 to mine
another 35, 000 cubic yards of gravel from the Burnett site. Also
attached is the submitted environmental checklist .
I would like to submit one letter to the applicant specifying
further information they will need to provide. I can write the
letter if you provide me a memo with your concerns/questions, or,
if you prefer we can write separate letters from each department.
At this point we will be requesting the following:
1 . Submission of the test results from the excavated soil taken
from the Walmart site.
2 . Detailed site plan (as per your recommendation) specifying the
exact dimensions of the size of the already excavated area, the
area proposed for excavation under this permit and the current and
planned depths of excavation. We could also require that the site
be flagged reflecting these areas. The site plan should also
identify the exact location of existing and proposed roads and
accesses to the site.
3 . More specific information regarding the "best management
practices" to be followed with regard to truck and equipment
maintenance and clean-up procedures and materials .
4 . Proof that the Mason County Noise Ordinance is being adhered
to.
5 . Any Building Department requirements/questions .
6 . Notification that it may be necessary for the applicant to
enter into a haul route agreement with the County Engineer.
7. An Public Works Department

Dear Mr. Burnett:
The Mason County Department of Community Development is taking this
opportunity to contact you regarding the results of our meeting
with you and Mr. Wayne Brown(Quigg Bros. McDonald ) on November 30,
1993. This meeting was held to discuss the issues and concerns as
they pertain to the removal of material and the spreading of
material on your property in Sect. 1 , T. 20N. , Rg. 4 ( parcel 42001-41-
00040 ) .
First let say that we appreciate you and Mr. Brown taking time out
of your busy schedules to meet with us.
During our meeting numerous issues and concerns were discussed.
The outcome of this discussion was that it was agreed to by Mr.
Brown and yourself that it would not be of any benefit to go
through the County permit system and then the Department of Natural
Resources permit system. It would be a duplication of effort and
would be time consuming. Because of this Mr. Brown and yourself
felt that instead of proceding with a new County permit or
requesting a permit amendment to the existing permit that you would
proceed with securing the required DNR permit.
After further discussion it was agreed to that no further material
would be removed from your site until a DNR permit was secured.
This department pointed out that based on this decision the
existing permit for removal of 20,000 cu. yds. was now null and
void. This was agreed to. Any further activity is not permitted
until the applicable permits are secured.
I.t was also pointed out that there is concern for the material
being brought to the site . Mr. Brown informed us that the material
is currently being tested and that he will furnish us with a copy
of the results . Until the material is confirmed it was agreed to
that no further placement of such would be undertaken. This
department suggests that once the testing is completed and
confirmed that you contact Mr. Byrne regarding any permits that may
be required.

BROS. REGARDING THE BURNETT PIT PERMIT APPLICATION. I WAS INFORMED
BY MR. BROWN THAT THE PERMIT APPLICATION HAD BEEN TURNED INTO THE
BUILDING DEPARTMENT ON THURSDAY, DECEMBER 23, 1993 . I POINTED OUT
THAT WE WOULD BECOME INVOLVED THROUGH THE PROCESSING OF THE PERMIT.
ANOTHER ISSUE DISCUSSED WAS THAT WHICH PERTAINED TO THE TESTING OF
THE MATERIAL BEING PLACED ON MR. BURNETT 'S PROPERTY. I INFORMED
MR. BROWN THAT THE COUNTY HAD STILL NOT RECEIVED ANY TEST RESULTS .
HE SAID THAT THEY HAD BEEN TURNED INTO THE DOE. I INFORMED HIM OF
MY CONCERN FOR NOT PROVIDING THE COUNTY WITH WHAT WE REQUESTED. HE
SAID HE WOULD FORWARD THE RESULTS TO US . I POINTED OUT THAT THESE
TEST RESULTS HAD BEEN PROMISED THE COUNTY FOR SOME TIME NOW.

Jerry, I am not sure whether your department is aware of this
project or not . Quigg Brothers/McDonald recently completed mining
20, 000 cubic yards from the John Burnett site adjacent to Island
Lake. They have now applied for a new, separate permit to mine
another 35, 000 cubic yards . We will be processing the SEPA
checklist.
There is much public concern in the area with regard to this mine.
If and when the mine reaches a size of 3 acres, the State
Department of Natural Resources will take over responsibility for
the permitting process (we have petitioned DNR to allow Mason
County to be the Lead Agency for SEPA at that time) . In the
meantime the Building Department feels a Land Modification Permit
is required.
The area overlies a "highly critical aquifer recharge area" and
will be regulated via our Interim Resource Ordinance. Several
provisions in that ordinance relate to your department.
I have attached the permit application and checklist for your
review and input .

RE: Burnett Mine Site: Haul-In
Following is our understanding of the Building Department' s
position regarding the possibility of exempting the haul-in of
material to the Burnett Mine Site.
1. Material is to be brought to a separate parcel from the one
identified in the current land modification permit application and
which is undergoing review under SEPA.
2 . Material is to be brought to this parcel via a route other than
Island Lake Drive.
3 . The Mason County Health Department must receive verification
from the state Department of Ecology that the soil testing re
sults
are satisfactory. A letter of concurrence will be required to be
submitted to Mason County Planning from either WDOE or Mason County
Health.
Providing the above three items have been met to Mason County
Building Department and Planning Department satisfaction, an
exemption to UBC Chapter 70 may be granted by the Building
Department . This would eliminate the need for SEPA review.
This does not apply to the taking of material off the Burnett site.
We would appreciate a clarification as to whether you wish to
pursue permitting the removal of 35, 000 cubic yards from the
Burnett mine site.

RE: HAULING FILL TO JOHN BURNETT SITE, ISLAND LAKE
The Mason County Building Department has placed a STOP WORK
ORDER on the property and project located at the John Burnett
property on Island Lake. The STOP WORK ORDER was placed at
approximetaly 2 : 00 pm today. All work at the site must stop
immediately.
Filling and grading of materials requires a Land Modification
permit issued by the Building Department unless the activity is
exempt under UBC Chapter 70, Section 7003 , Permits Required.
The activity at this site was a topic of a long discussion
with Wayne Brown on Wednesday, January 12 , 1994 here at the
Building Department . At that time Mr. Brown was informed of the
current permit status and options outside the current permit status
that could be persued in order to move the top soil from the Wal-
Mart site to the Burnett Site. We have not received any of the
information necessary to process a permit for the current activity
or to consider an exemption if that is applicable.
A copy of this memo will be filed with the Mason County
Prosecuting Attorney' s office today if further action is necessary.

The Mason County Department of Community Development has received
your letter of November 17 , 1993 regarding the removal of gravel on
Island Lake Drive . We are taking this opportunity to respond to
your concerns .
Currently there is a grading and excavation permit issued by the
Mason County Department of General Services. This permit was
issued subject to conditions which are being complied with as we
understand it. Conditions included use of loop road to lessen
impact on adjacent wetland area, silt fencing on upper edge of
wetland to prevent silt from entering associated biological
wetland, the project must be consistent with all applicable
policies and other provisions of the Shoreline Management Act and
temporary erosion control measures must be implemented to prevent
water quality degradation of adjacent waters or wetlands .
The Department of Natural Resources recognized this same site as a
mine since January 1992 . Because it is under 3 acres in size and
has less than a 30ft. cut bank, a mining permit was not required by
DNR.
This department has met with DNR representatives regarding the
existing project and possible future proposals. Copies of citizen
letters are being forwarded to DNR for their consideration when
processing any applicable permits . We are also requesting that we
be informed of any environmental determinations applicable .
Contact is also being made with other Counties to determine how
they are handling similar situations . Upon receipt of this
information we will look at possible alternatives . One item we
have to remember is that Mason County has no zoning rules and
regulation as do other Counties .

Dear Sir:
I am a resident of Island Lake and also a neighbor of Diane Hanson
from whom you have probably already received some communication. I
am writing because of my concern about the gravel mining operation
that Mr. Burnett has started on his property which is adjacent to
Island Lake . My understanding is that he plans to mine several
acres of gravel from his property and transport it to the Walmart
Development on Highway 101 . I am concerned about this development
for a number of reasons . First I am concerned that there may be
disturbance of well water supply for the residents on that side of
Island Lake . Secondly, my concern is whether or not the springs
feeding Island Lake may be disturbed by this project and thirdly,
I am concerned about the environmental impact, especially on nearby
Johns Creek and what effect the mining plus subsequent filling with
topsoil may have on Johns Creek. Finally, I am concerned about the
impact of such an operation adjacent to a residential community
such as which surrounds Island Lake .
When Mr. Burnett was operating his gravel pit earlier this month,
gravel trucks were rolling every few minutes on Island Lake Road.
Now I have learned from Diane Hanson that he is not only
considering resuming the gravel mining but is also planning to put
in a rock crusher which I think would be in violation of a county
noise ordinance with regard to the residential character of the
neighborhood.
I would hope all of these problems will be addressed in detail
before allowing Mr. Burnett to proceed with the gravel pit
operation.

Dear Mr. Yando.:
1 am writing about the removal of gravel which is
taking place on island Lake Drive by john Burnett. At the
present time 7: 35a. m. there are huge dump trucks going by
every three to four minutes. The noise level is very
annoying to me. I have somewhat of a hearing problem and
the extra traffic rumbling by is unpleasant for me. One of
my neighbors has bronchitis which came on just at the time
that the hauling began. Although she has a history of lung
problems, 1 think that the air pollution which the trucking
run is creating has intensified her distress.
I know that the county is planning for the future and
would like to see some effort and thinking put into avoiding
what we are dealing with now on Island Lake. There should
be some kind of zoning ordinances which would limit mining
to certain areas. We homeowners who bought our homes in a
rather residential setting need assurances - in as much as
is humanly possible - that the areas surrounding our homes
will not be upset by gravel mining and other polluting
influences.
Thank you for your time in reading this letter and also
in explaining the situation to me during this past week.
Ms. Miller was also very helpful in bringing some light on
this difficulty.

our neighborhood is a residential area, and we object strongly to having
these large dump trucks coming in continuously to remove gravel from
Island Lake Drive. We object to the noise, the air pollution, the
traffic hazards, and the damage to the landscape. Can you do anything to
put a stop to this, and also to prevent something like this from
happening again in the future?

We are year-round Mason County residents. Our family lives at Island Lake.
We are concerned about John Burnett's gravel mining within one quarter of a
mile of our home. Our concerns are the water quality of Island Lake and
John's Creek; noise of gravel mining near the community of Island Lake, and
safety issues of gravel trucks moving through a long established residential
community,
We understand Mr. Burnett has applied for another permit through the
county. Please decide in favor of Island Lake residents; don't allow gravel
mining at Island Lake.
