Dear Ms. Clark:
Thank you for the opportunity to comment on the mitigated determination of nonsignificance for the
Shelton Regional Water and Wastewater System—Conveyance/Reclaimed Water Pipelines project
(SEP2007-00062)located at 12001 North US Highway 101 in Shelton as proposed by City of Shelton.
The Department of Ecology(Ecology)reviewed the environmental checklist and has the following
comment(s):

If contamination is currently known or observed during construction or soil removal(placement),
sampling of the potentially contaminated media must be conducted. If contamination of soil or
groundwater is readily visible,or is revealed by sampling,Ecology must be notified. Contact the
Environmental Report Tracking System Coordinator at the Southwest Regional Office at(360)407-
6300. For assistance and information about subsequent cleanup and to identify the type of testing that
will be required contact Mr. Chuck Cline. If contamination is identified,this issue may be referred to
your jurisdictional health department as a solid waste concern.

Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of
Chapter 90.48 RCW,Water Pollution Control,and WAC 173-201A,Water Quality Standards for
Surface Waters of the State of Washington,and is subject to enforcement action.
Erosion control measures must be in place prior to any clearing,grading,or construction. These
control measures must be effective to prevent stormwater runoff from carrying soil and other
pollutants into surface water or storm drains that lead to waters of the state. Sand,silt,clay particles,
and soil will damage aquatic habitat and are considered to be pollutants.
Proper disposal of construction debris must be on land in such a manner that debris cannot enter the
North Fork of Goldsborough Creek or cause water quality degradation of state waters.
This project may require coverage under a Construction Stormwater National Pollution Discharge
Elimination System(NPDES)permit. The site has pre-construction potential to discharge offsite to
waters of the state(Goldsborough Creek or stormdrains draining to waters of the state). IF one acre
or more of land surface area will be disturbed,the NPDES permit will be necessary. The permit must

be obtained before the start of any clearing, grading or construction activities and the permit
application form,called a Notice of Intent,is available on Ecology's website at:

encourage the applicant to submit a completed application form and to publish public notices more
than 60 days before the planned start of the project.
Ecology's comments are based upon the information provided with the SEPA checklist. As such,they do
not constitute an exhaustive list of the various authorizations that must be obtained or legal requirements
that must be fulfilled in order to carry out the proposed action.
