Regarding the enclosed TRAIL UPDATE newsletter,this date Corazon and I met with Malissa
Paulsen, Planner, Mason County Community Services (Tel: 1-360-427-9670 ext. 282) in Shelton
to discuss measures to improve utilization of the boat storage facility under the Shoreline
Management Act.
The original ramp to the beach from the boat storage facility approved by the Hearing Examiner
under the Mason County permit number BLD 2005-01398 dated 24 January 2008 was washed
away by tidal action in 2009 and replaced with the wooden beam and large stone/crushed rock
ramp that you see in the enclosed PHOTO# 1.This repaired ramp has done an excellent job of
withstanding tidal action but the community now has the responsibility of maintaining it.
I recommend an effort be made to gather those rocks which have been washed out by the tide
and replaced back in the wooden crib as a community project during our next Annual Meeting
this year.
In order to remove the tree which, you describe as an "impediment"for use of the boat storage
facility requires the filing of two permits by the owner of the property.
The two permits are:
1. Mason Environmental Permit
2. Geotechnical Report
and both will be expensive to pursue and approval for the removal of the tree cannot be
assumed or guaranteed.
Since I own the property, I personally do not favor removal of the tree as it is still alive and it
contributes to the stability of the embarkment. Therefore,the appropriate decision is to leave
"mother nature alone", let the tree live and get used to hunkering down as you slide under the
tree either alone or"wiggling" your kayak after you. Both would be an environmentally friendly
act.
The Hearing Examiner in his approval of permit BD 2005-01398 for the boat storage facility
specified that "association members will periodically sweep the concrete pad to keep the
facility in a clean condition".The current members (Sutherland, Dodson and Wasserman)who

have their boats stored as shown on the recent enclosed PHOTO#2 have not cooperated in
maintaining the facility,yet all have signed a "Utilization Agreement" saying they would.
Therefore,this letter serves as notification that these three members have to develop a plan to
please maintain the facility in a clean condition as they promised in writing they would do. If
no action is taken then their"Utilization Agreement" will not be renewed in 2023 and new
members who will honor their signature on the Utilization Agreement will be permitted to do
so. For your information I enclose a blank "Utilization Agreement" whose purpose is to reflect
the "terms "established by The Hearing Examiner in 2008. Please communicate this agreement
to our new members who may want to store their boat but with the understanding they will
help keep the facility in a "clean condition".
I thank you for serving as our President and providing the membership with the guidance
needed to allow correct use of Willard's community easement trail and boat storage facility.

Utilization Agreement
Harstine Passage Maintenance Association (HPMA)
Community Boat Storage Facility
1.This agreement beween HPMA association member and
Brad Willard who owns the Community Boat Storage Facility located on his property at
41 E Tamarack Lane allows to store small water craft
consisting of under the following terms:
A. Association member(s)shall have use of one half of the boat storage facility on a space available
basis as determined by Brad Willard.
B. Association member(s)will comply with conditions of the Mason County Building Permit
approved 23 April 2008 which specifies that the facility be available for recreation and emergency
use by the community; storage of fuel, lubricants,chemicals or hazardous substances is not
allowed; no further removal of native vegetation around the boat storage is permitted; the use
of all-terrain vehicles (but not golf carts) on the trail or in the shoreline is prohibited; all waste
and debris must be removed and properly disposed of each day; and no additional landings and
stairs may be constructed without county approval.
C.Association member(s) may use a chain or cable to secure their small water craft to the metal
railing.
D. Association member(s)will use the combination lock with current code of for
access and will ensure metal gate is locked at the end of each day.
E. Association member(s)will periodically sweep the concrete pad to keep the facility in clean
condition.
2.Association member(s) agree(s)to hold Brad Willard
harmless for any damage which may occur to his/her small craft which is/are stored at the facility or
for any personal injuries or accidents which may result from using the facility.
3.Association member(s) understand (s)that failure to
comply with the terms of this agreement will result in its cancellation and upon written notification
by Brad Willard will cooperate by removing his/her small craft from the facility.
4.This agreement is valid from until after which other
association members will be afforded the opportunity to store their small craft on a space available
basis as determined by Brad Willard.
