Therefore the current determination is withdrawn pending revision. SEP2008-00146 was issued for a project submitted by Sims - Limbsaver as follows: Modify existing building at Port of Shelton for use as a Water Transfer Paint Facility. This will include a parts washing machine, a paint transfer dipping station, a small spray paint booth, and area for hot air drying of painted parts. Includes engineering controls for air ventilation/filtration, secondary containment for all wet operations. Comments affecting this proposed revision include: • Comments from City of Shelton expressing concerns over the adequacy of information provided by the applicant in the original SEPA checklist and associated materials,particularly in relation to the quantity, use and storage of Class 1B and 1C hazardous materials. There is insufficient data on the materials or how they will be used or contained. • Department of Ecology has indicated this will need review by Olympic Regional Clean Air Agency,however no information has been provided. It is not clear if they have been contacted • Port of Shelton concurs with the SEPA determination, however requests updates to the Best Management Practices Plan. • Based on Mason County's review of these comments in relation to the submitted materials, and recently received revisions --there is still a need for clarification from the applicant and consultant related to: the use and containment of materials, further revisions to the Best Management Practices Plan, and additional detail on how impact to groundwater and the air will be prevented. All comments are provided to the applicant. Mason County will notify agencies at such time as the SEPA can be re-issued. I will try to answer your questions so you can comment. I called Drew Stephens because of all the discrepancies and this is what I could come up with. 1. 1 changed the applicant to Sims Vibration in computer system and maybe Pam will want to re-send SEPA when she gets back. The in-take at the Permit Assistance Center entered it incorrectly and it had not been corrected for SEPA by Pam, so it carried over in system. 2. The location of the proposed activity"Water Transfer Printing Paint Shop"or"Spray Booth and Additional Permanent Appliances" is within an existing 2,000 square foot older building located at 121 W Development RD. They changed the buildings that they were going to use mid-application and did not change all the paperwork to reflect final application. 3. He is referring to 121 Development RD and it is within the older, 2000 sf, existing building at that location. Drew Stephens said that the facilities within the building are all proposed and not existing. The permit triggering the environmental review is a Mechanical Permit. He thought they had canceled the "Change in Tenant"application that I have in the file to the" Mechanical Permit'only. I still am not sure if that is correct and will try to clarify with Bldg Dept. (11/7/2008) Grace Miller- COM2008-00109 Page 1 From: Grace Miller To: Charell Holcomb; Debbera Coker Subject: COM2008-00109 am trying to figure out some issues on this SEPA checklist and determination that Pam issued for this permit and need some help. Not sure which of you to ask?? I spoke with applicant, Drew Stephens, and Drew said that this Permit was supposed to be cancelled. It is for a"Change in Tenant" review. It should be a"Mechanical Permit' If this is true, do we get a copy of the Mechanical permit to sign off? Maybe it has the actual thing he is applying for because he said this application is all wrong. He has some really conflicting facts on the COM2008-00109 application and the SEPA checklist. I have found Four different project descriptions throughout the submitted paperwork so far. There are two different building sizes, ages, wrong applicant (I fixed that one in TM), etc.. and I just want to make sure the SEPA was issued for what he is really planning to do. Port of Shelton is identified on the MDNS as the proponent. We are not. I assume the proponent is Steve Sims, Inc. % •: a, �t�..TM 2. The MDNS identifies the site address as 301 Business Park Loop. P. 2 references 121 W. Development Road and a 2,000 square foot building but page 8 references a 5,000 sf building. Is this in addition to the 2,000 sf building? Since page 2 information appears to have been whitened out and re-written by hand, should page 8 building size have also been changed? The attached Best Management Practices Report is for a building that the report states is located adjacent to 301 W. Business Park Loop. This in itself is a bit confusing because there is no old steel building (194e's era) that I would call adjacent to the 301 address. I am assuming that he is actually referring to 121 Development but don't really know. Drawing dimensions make me think it is in the IMG 0847.jpg attached. The report also refers to existing paint facilities and best management practices. It is unclear whether the plan is to utilize these for the proposed dipping or if the checklist is for a facility that is already in operation and this is a case of obtaining an "after the fact" permit. What permit is triggering this environmental review? Alternately, I wondered if perhaps the facilities are mentioned to show that they are operating currently in compliance with all applicable regulations and standards. Sims Vibration Laboratory meeting,January 7,2009—9am, Mason County Building 1 Permit: COM2008-00109 Environmental Review: SEPA SEP2008-00146 (determination withdrawn December 12, 2008). Outstanding Mason County Planning department issues—the list is based on review of the updated SEPA submission, discussion at today's'meeting, and questions raised by other agencies thus far. Present at the meeting were:Jason Dose& Tracy Farrell— City of Shelton; Roy Glass —Northwest Envirometrics;Drew Stephens and Charles Netzel—Sims Vibration Lab; Gordon Lance— Olympic Region Clean Air Agency; Pam Bennett-Cumming—Mason County Planning. SEPA&other documents: Project description: from the description it is unclear what a Water Transfer Painting facility is. An outside reader does not know the process, the amount of chemical material floating on the water at any given time, or the scale of the process. This needs to be very explicitly described including quantities on hand at any one time, as well as quatities used in a given time. Methods to reduce or control emissions or other impacts to air: section does not address the topic specifically enough. Describe process,equipment that will control emissions. The respiratory protection plan is important,but it does not tell the reader how OUTSIDE air quality will be protected. Could waste materials enter ground or surface waters: if so, generally describe: Answering "none"does not provide the outside reader with enough information to understand how this will not happen. Descriptions of the containment, slab drainage and process to ensure adequate containment. Describe how waste materials are removed,transported—methods to ensure containment at those times. Threatened or endangered species: Shelton Pocket Gopher(State candidate and local species of importance). Habitat is managed through Port Habitat Management Plan. Environmental Health Hazards: be specific about the materials and quantities. Proposed measures to reduce or control...: Also include information on filtration that will ensure air quality. Hazardous materials stored/used on site: There needs to be consistency between documents about the amounts of hazardous materials proposed to be stored and/or used on site at any given time. Right now the"plan notes,"the BMP Plan and the SEPA revision are inconsistent with each other or unclear. The"plan notes"indicate quantities that would be unacceptable on the Critical Aquifer Recharge Area. Supplemental information: again, describe WHY there would be no increased emissions resulting from this project. (filtration system design, use). What will be the frequency of monitoring of the site by Northwest Envirometrics? ORCAA? DOE? The BMP plan is written as though the ORCAA approval has been completed. It is currently under way,not completed. County approval would require that all reviewing departments have signed off on your project. Status of other issues: Respiration protection plan now included in BMP plan,but still needs to be clear about mitigation of impacts to air. Revised SEPA now indicates presence of CARA,but still needs to be more explicit on containment in the event of e.g. catastrophic failure of secondary containment. Olympic Region Clean Air Agency will provide a copy of their permit document to the County, for inclusion in the updated SEPA documents. (est. 1999) is a fully certified environmental consulting firm consisting of eight environmental professionals who each, have over 25 years of field experience in Environmental Health and Safety. (see attachments) Mr. Roy C. Glass,President/C.E.O. holds a B.A. Degree in Political Science from Washington State University, and is a Certified Hazardous Materials Manager(CH11i M#6825) by the Academy of Hazardous Materials Managers, and the Institute of Hazardous Materials Management(II MN4). On Site Inspection: On October 20,2008, an on-site assessment was done at the LIMBSAVER "Bow Dipping Facility"adjacent to 301 W. Business Park Loop. Mr. Drew Stephens represented LIMBSAVER. Facili : The building is an old(1940s) steel building with concrete floors. The building is 100 feet long and 20 feet wide(2,000 sq/ft). There are no existing, exterior storm drains or interior, sanitary drains. The building has been divided into two sections: 1)containing a self contained spray paint booth with a filtered 24 inch exhaust fan/vent, and a paint drying room. 2) The second half of the facility contains a self contained washer/conveyor, and a 500 gallon water transfer printing tank. Note* floor plan attached 1 The spray paint booth was in full compliance of the Clean Air Act(40-CFR 126 f) and approved by the Department of Ecology, Olympic Region Clean Air Agency, and the Mason County Fire Marshal. The washer/conveyor is a stainless steel, self contained unit that utilizes hot water and a<5 %phosphoric acid solution to wash parts prior to painting. It holds a maximum of 200 gallons of water that is captured, filtered and re-used during the wash process. There is no floor drain or discharge from this equipment. In the event of a spill or release of process water,the washer/conveyor is fully enclosed in a urethane enclosure that will provide secondary containment for 100%of the process water. Note* Material Safety Data Sheets attached cleaner/etcher(Chem Cote 3406) Not regulated under SARA 313 CERCLA RQ.= 5,000 pounds Total process water+ 1,600 pounds The water transfer printing tank is a stainless steel tank that holds a maximum of 500 gallons of process water. In addition,this tank is also fully enclosed in a urethane for 100%secondary containment. The CHEM-COTE products used in this process are painting products(flammable liquids) contained under hooded 10 inch ventilation system. (est. 1999) is a fully certified environmental consulting firm consisting of eight environmental professionals who each,have over 25 years of field experience in Environmental Health and Safety. (see attachments) Mr. Roy C. Glass, President/C.E.O. holds a B.A. Degree in Political Science from Washington State University, and is a Certified Hazardous Materials Manager(CHMM#6825) by the Academy of Hazardous Materials Managers, and the Institute of Hazardous Materials Management(IHNIM). These credentials are internationally recognized and accepted by;the World Safety Organization,and the State of Washington(Department of Ecology). B. On Site Inspection: On October 20, 2008, an on-site assessment was done at the LIMBSAVER "Bow Dipping Facility"adjacent to 301 W. Business Park Loop. Mr. Drew Stephens represented LIMBSAVER. Facili : The building is an old(1940s) steel building with concrete floors. The building is 100 feet long and 20 feet wide (2,000 sq/ft). There are no existing, exterior storm drains or interior, sanitary drains. The building has been divided into two sections: 1)containing a self contained spray paint booth with a filtered 24 inch exhaust fan/vent, and a paint drying room. 2) The second half of the facility contains a self contained washer/conveyor, and a 500 gallon water transfer printing tank. Note* floor plan attached 1 The spray paint booth was in full compliance of the Clean Air Act(40-CFR 126 f) and approved by the Department of Ecology, Olympic Region Clean Air Agency, and the Mason County Fire Marshal. The washer/conveyor is a stainless steel, self contained unit that utilizes hot water and a< 5 %phosphoric acid solution to wash parts prior to painting. It holds a maximum of 200 gallons of water that is captured, filtered and re-used during the wash process. There is no floor drain or discharge from this equipment. In the event of a spill or release of process water,the washer/conveyor is fully enclosed in a urethane enclosure that will provide secondary containment for 100%of the process water. Note* Material Safety Data Sheets attached cleaner/etcher(Chem Cote 3406) Not regulated under SARA 313 CERCLA RQ.= 5,000 pounds Total process water+ 1,600 pounds The water transfer printing tank is a stainless steel tank that holds a maximum of 500 gallons of process water. The water is used to float a transfer film that is bonded to the parts being treated. The tank has a stainless steel collection tray and filter,to catch water as the parts are removed from the tank. In addition,this tank is also fully enclosed in a urethane for 100%secondary containment. The CHEM-COTE products used in this process are painting products(flammable liquids) contained under hooded 10 inch ventilation system. Construction and application are in compliance with article 80 of the Uniform Fire Code as approved by the Mason County Fire Marshal, Note* MSDS Sheets attached(painting products) All process water,for both systems is scheduled to be removed for, treatment, and disposal at 90 day intervals by: American Petroleum Environmental Services 2117 River St. Tacoma,Wa. 98421 (253) 538-5252 In the event of a spill or release, American Petroleum Environmental Services would be called to remove the process water from the secondary containment systems. 2 * processes are exempt from additional Spill Prevention Note Both of the above p P Countermeasures and Control Planning(40 CFR 112) SPCC Oil Spill Response Plans. This facility was designed and constructed to meet those requirements. Training: LIMBSAVER is compliant with 29CFR 1910-1200"Hazard Communication Standard"and has provided initial and recurrent training for all employees. LIMBSAVER has developed a Facility Response Plan(FRP as required under(29 CFR 1910— 120) Prior to operating the Bow Dipping Paint Facility, LIMBSAVER will provide additional training for employees (4) assigned to that process that will include spill response protocols, application of absorbent materials(spill kits), and personal protective equipment. (respirators, eye protection, splash protection). LIMBSAVERS has retained NorthWest Envirometrics Inc. to provide them with a written Respiratory Protection Plan as required under 29 CFR 1910— 134. (This plan will be completed November 1, 2008.) C. WAC 173-303 Compliance: LIMBSAVERS has agreed to comply with WAC 173-3-303-145 "Spills and Discharges into the Environment". Protocols will include immediate notification to local authorities(911) and immediate notification to the Department of Ecology Northwest Regional Office 407-6300. LIMBSAVER employees will provide spill control countermeasures per their protocols and training. American Petroleum Environmental Services will provide personnel and equipment for cleanup and post emergency response (WAC 296-62- 824) Engineering controls (secondary containment, absorbent pads/booms and ventilation)will confine all releases to the interior of the facility. D. Findings: LIMBSAVER is utilizing a new"state of the art"process in the application,design and construction in painting in the"Bow Dipping Facility". This process is more environmentally friendly and generates less hazardous wastes,than traditional methodologies. They have implemented additional safety measures by integrating additional engineering controls, and have addressed worker health and safety issues. 3 It is the opinion of NorthWest Envirometrics Inc. that LIMBSAVER has employed the best possible current site management practices in: planning, constructing,training, and implementation for this facility.
