DESCRIPTION OF VIOLATION(S): 1) Garage over 200 square feet built without permits.
STATE LAW OR MASON COUNTY CODE(MCC)SECTION(S)IN VIOLATION:
1. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish,
or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair,
remove, convert or replace any required impact-resistant coverings, electrical,gas, mechanical
or plumbing system, the installation of which is regulated by this code, or to cause any such
work to be done, shall first make application to the building official and obtain the required
permit. (MCC14.04.010 and IRC R105.1)
ACTIONS REQUIRED TO CORRECT:
1. Seek permits for Garage built that is over 200 square feet (MCC 14.04.010 and IRC R105.1)
In order to correct this violation; seek proper permits for garage on property. Contact Mason
County Community Services Department for guidance at 360-427-9670 Ext. 363 or in person at
our office building 8 located at 615 W. Alder St. Shelton,WA.

MONETARY PENALTY
A monetary penalty will be assessed against you for each and every day, or portion thereof during which
subsequent violations of Mason County Code 14.04.010 and IRC R105.1 continue beyond May 15, 2018.
The amount of the penalty per day, or portion thereof for each day the violation continues beyond May
15, 2018 accrues at the following rate:
*** First violation: $500 per day or portion thereof
Penalties cease to accrue only when the violation is corrected and the issuing compliance officer has
certified compliance. Inspections must be completed to verify compliance and cease accrual of
monetary penalties.
PAYMENT OF PENALTY;APPEAL PROCESS;CONTINUED DUTY TO CORRECT
You are required to correct the violation; or Negotiate a Voluntary Correction Agreement with County
Staff; or pay the imposed civil penalty to the County Auditor if the violation is not corrected; or you may
appeal this Notice and Order to the Mason County Hearing Examiner by filing a written notice of appeal
with the County Clerk in County building 1 located at 411 N 5th Street Shelton, WA 98584 within 14
calendar days from the date of service of this Notice of Violation. The appropriate appeal fee ($660.00)
must accompany all appeals; refundable in the event the appellant prevails.

Met with the owners on site(Randy and Carol Morris).They hoped to wait until spring to start work.The cut is not protected,but appears to be stable.No sign of sluffing.After meeting with the owners the
only way to resolve the complaint is to build a retaining wall.The owners agree to apply for a permit by November 06, 1998,however they may require an extention,so work does not start until spring.I
informed them not to delay action for over 180 days.Owner would like to build a six foot fence on top of the wall,so I informed them that it must not exceed 6 feet in height above grade measured from the
applicaints property.If the retaining wall is on the line then the measurment is an average of low and high side. 10/29/98 contacted owner and informed them on the height constraints.

Returned Carols call. She said that she called and was told she had 180 days from approval date to issue and then 180 from that to first inspection. I explained that staff did not notice it was an ENF case
however,as long as no further complaints are received or damage done,I will extend it to May.

The woods constructed a rock retaining wall along the cut from O'feet to 5'.The rock wall may or may not be adequate,but appears to be protecting the bank.Thier is no sign of failure.The Wood's also
constructed a fence independent of the wall.The woods are in the process of trying to buy the lot above the steeper cut.The lower 5'-6'feet is well cemented and appears to be stable at this time.I informed the
Woods that if the retaining wall failed it would be their responsability to correct the situation.
