Introduction. This report evaluates a proposal for the conversion of space above the garage to an accessory dwelling unit (ADU). The completed unit will be 896 square feet. References to County Ordinances are as approved. Staff recommends approval of the Special Use Permit. II. Applicant. Giles & Ronda Durano (owners). III. Property Location. 131 W. Meadows Place, Shelton, WA 98584. Lot 2 of short subdivision No. 2340—portion of the N.W. quarter of the N.W. quarter of Section 8, Township 20 North, Range 4 West, W.M., Mason County. Parcel # 42008-78-90022. IV. Project Description. The proposal is to convert 896 square feet of space above a newly constructed garage to an Accessory Dwelling Unit. The current residence on site is 1,900 square feet and the distance between the primary residence and the proposal is 72 feet. See site plan (Attachment B). V. Evaluations. A. Characteristics of the site. The parcel is located in a rural residential development. The lot dimensions are approximately 330 feet by 330 feet. The property is located just west Highway 101 off the Dayton-Airport Road. Currently there is a 1,900 square foot single family residence, storage shed, and a newly constructed 2-story garage on the subject lot. Photographs of the site are marked Exhibit 4. B. Characteristics of the area. The site is located in an area zoned as Rural Residential 5. The parcels in the area have retained some smaller Douglas Fir trees. The properties around this parcel contain single family residences. &6t3t� � C. Shoreline Designation. Not Applicable. D. Comprehensive Plan Designation / Zoning. The Mason County Comprehensive Plan designation for the site is Rural Residential 5. VI. SEPA Compliance. Project is SEPA exempt per WAC 197-11-800 (1)(b)(i). VII. Other Permits/Approvals. The proposal will require Mason County Building Permit for the residential (ADU) construction. A Notice of Application and Public Hearing (Exhibit 3) was posted in the Mason County Journal on October 21 , 2004. No public comment has been received. Vill. Analysis. This proposal requires a Special Use Permit due to the requirements of the Mason County Development Regulations, dated June 15, 2004, section 1 .03.029 A. The parcel currently contains a newly constructed garage with space above, of which 896 square feet will be converted to an Accessory Dwelling Unit. Applicable Development Regulations as listed under section 1.03.029 A. are: A. The ADU shall be subject to a special use permit, unless in the shoreline jurisdiction it is subject to a shoreline permit. B. The owner of the ADU must reside on the lot in either the principal residence or ADU. C. The ADU shall be located within 150 feet of the principal residence or shall be a conversion of an existing detached structure (i.e. garage). D. The ADU shall not exceed 50% of the square footage of the habitable area of the primary residence or 1,000 square feet, whichever is smaller. E. All setback requirements must be met by the ADU. F. All applicable health district standards for water and sewer must be met by the ADU. G. No recreational vehicles shall be allowed as ADUs. H. Only one ADU is allowed on any property. I. An additional off-street parking space must be provided for the ADU. Staff Respone: The ADU as proposed meets all of the above criteria A — I. Applicable Special Use review criteria: See the applicant's answers to these criteria, marked Attachment A. 1 . Will the proposed use be detrimental to the public health, safety and welfare? Staff Respone: The proposed ADU is for use by family members. No potential detrimental effects have been identified. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? Staff Response: There do not appear to be any conflicts with the County Comprehensive Plan. The ADU is even allowed by the community covenants for Dayton Trails, and the unit will also meet those guidelines. 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? Staff Response: No hazardous conditions would be expected as a result of the proposal. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Staff Response: The ADU will be served by a separate, private on-site septic system. The applicants have recently applied for a permit to install a separate septic system (SWG2004-00165). 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? Staff Response: There will be no significant impact upon existing, adjacent land uses. Adjacent land uses are residential. 6. If located outside an Urban Growth Area, will the proposal result in the need to extend urban services? Staff Response: The addition of a single family residence would not result in a need to extend urban services. Project Analysis: Based upon these policies and regulations, the project conforms to the policies and use regulations of the Mason County Development Regulations with regards to Accessory Dwelling Units. IX. Conclusions. As designed, the project is consistent with the Mason County Development Regulations. Staff recommends approval. X. Choices of Action. 1 . Approval of the SUP request. 2. Denial of the SUP request. 3. Conditional approval of the SUP request. 4. Postpone the decision for further information. The purpose of this Section is to provide for adequate oversight and review of such development proposals,in order to assure that such uses are developed in harmony with surrounding land uses,and in a manner consistent with the intent of this Ordinance and the Comprehensive Plan. 1.05.042 Authority The Board shall have authority to hear and decide all applications for Special Use permit. The Board may approve,approve with conditions,or deny any application for Special Use permit,based upon the Decision Criteria set forth in Section 1.05.044. The Board shall have the authority to attach such conditions as may be appropriate to accommodate the Decision Criteria set forth in Section 1.05.044. 1.05.044 Decision Criteria The Board shall review Special Use permit applications in accordance with the following criteria. The Board shall not approve any application for a Special Use permit unless it makes an affirmative finding with regard to each of these criteria. A. That the proposed use will not be detrimental to the public health,safety and welfare; B. That the proposed use is consistent and compatible with the intent of the Comprehensive Plan; C. That the proposed use will not introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large; D. That the proposed use is served by adequate public facilities which are in place,or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan; E. That the proposed use will not have a significant impact upon existing uses on adjacent lands;and F. If located outside an Urban Growth Area,that the proposed use will not result in the need to extend urban services. 1.05.046 Procedural Requirements for a Special Use Permit A. Application for a Special Use Permit shall be made to the Department of Community Development,on forms furnished by the County. B. Any application for a Special Use Permit shall include an application fee as established by the Board. C. We are looking to convert the upstairs above the detached garage into a living space as a"mother-in-law unit". Recent situations,including a job layoff and the death of our father, have made it necessary for our mother to relocate from Eastern Washington and retire near us. She is looking forward to becon kw an active retired person in the Shelton/Mason County community. Please find the enclosed site plan which addresses the eleven items in criteria#7 on the Application for Special Use. The following is in response to criteria #1-6 on the application. 1. To the best of our knowledge,the proposed accessory dwelling unit will not be detrimental to public health, safety or welfare. Our residence in located in a quiet community. A grandmother's presence will be beneficial to our family, neighbors and friends. 2. To the best of our knowledge, the proposed accessory dwelling unit is consistent and compatible with the intent of the Comprehensive Plan. Our community covenants even allow for such a unit to be constructed, and this unit will also meet those guidelines. S. To the best of our knowledge, this accessory dwelling unit will not produce hazardous conditions at the site, or cause harm in any way to adjacent properties or community in general. 4. To the best of our knowledge,the proposed accessory dwelling unit is served by the same public facilities as those of our principal residence, which are adequate at this time for private residences. No additional public facilities are necessary to add. 5. The proposed accessory dwelling unit will have no significant impact upon our adjacent landowners. It is well within the setback requirements for our community and will in no way change or alter adjacent land use. 6. The proposed accessory dwelling unit will not result in the need for an extension of urban services. Thank you for your consideration of our application. The request was approved pursuant to the Mason County Development Regulations Ordinance No. 82-96, specifically for the construction of an accessory dwelling unit. The proposal was exempt from SEPA review per WAC 197-11-800 (1), (b), (i). This is a final County decision. No further appeals to the County are available. Appeal may be made to Superior Court or the appropriate administrative agency as regulations apply. It is the appellant's responsibility to meet all legal requirements of any appeal process. Applicant. The applicants submitted their application on or about October 18 7, 2004. 19 2. Hearing. The Hearing Examiner conducted a hearing on the application on November 9, 2004, at 1:00 p.m., in the Mason County Board of Commissioners 20 Meeting Chambers. 21 Substantive: 22 3. Site/Proposal Description. The applicants propose to convert 896 square 23 feet of space above a garage to an accessory dwelling unit (ADU). The subject parcel 24 is located in a rural residential development. The parcel is 330 feet by 330 feet. There is currently a 1,900 square foot home on the parcel, a storage and a newly 25 constructed 2-story garage. The home is 72 feet from the garage. 4. Characteristics of the Area. Surrounding parcels contain single-family residences. The parcels in the area have retained some smaller Douglas Fir trees. The ADU is located on a parcel 2 over two acres in size surrounded by large lots. There is plenty of buffering between the ADU and adjoining uses. 4 CONCLUSIONS OF LAW 5 Procedural: 6 1. Authority of Hearing Examiner. MCC 15.03.050(J)provides the Examiner with the authority to review and act upon special use permit applications. 7 8 Substantive: 9 2. Zoning_Designation. The area is designated as "Rural Area" in the Mason County Comprehensive Plan and Rural Residential 5 in the Mason County Zoning 10 Code. 11 3. Review Criteria and Application. MCC 1.03.029, which governs 12 accessory dwelling units in rural lands, provides that such accessory dwelling units are subject to a special use permit. Since the proposed ADU is proposed in an area 13 that is zoned for rural use, a special use permit is required. The review criteria for a special use permit application are governed by MCC 1.05.044, which are laid out 14 below with applicable conclusions of law. 15 MCC 1.05.044(A): That the proposed use will not be detrimental to public health, 16 safety and welfare. 17 4. The proposed accessory dwelling unit is located on a lot exceeding two acres in size in an area characterized by large lots. The added use should not be 18 noticeable to adjoining properties. No detrimental impacts are discernable. 19 MCC 1.05.044(B): That the proposed use is consistent and compatible with the 2 0 intent of the comprehensive plan. 21 5. As indicated by staff, there do no appear to be any conflicts to the comprehensive plan and given the compatibility of the use with adjoining uses, the 22 proposal is consistent with the general intent of the comprehensive plan. �' MCC 1.05.044(C): That the proposed used will not introduce hazardous conditions 24 at the site that cannot be mitigated through appropriate measures to protect adjacent properties in the community at large. 25 6. As indicated in the staff report and application, no hazardous conditions will be expected as a result of the proposal. As indicated in the staff report, the ADU will be served by a private on- site septic system subject to approval from the Environmental Health Department. 4 Approval of the septic system shall serve as a condition of approval. 5 MCC 1.05.044(E): That the proposed use will not have a significant impact upon 6 existing uses on adjacent lands. 7 8.
