Referencing Mason County Code, Section 14.08.030 (4), a permit shall be required for commercial use buildings when there is a change in tenant prior to occupancy whether or not construction or alterations are performed or proposed and regardless of the use or occupancy classification. Work and/or occupancy without required permits is considered a violation of Mason County Code Chapter 14 and subject to violation penalties outlined in Chapter 14.12. On June 21, 2013 a Mason county Building Inspector posted the site with a correction notice as a warning that permits are required. A copy of the correction notice is enclosed. ❑ In addition this appears to be a business related to regulations for a Collective Gardens. The Change of Use permit would be approvable only after the Collective Garden regulations have been met. See enclosed Collective Garden regulations. According to the Mason County Assessor records, parties named above hold legal interest in the parcel and are therefore subject to enforcement action for failure to comply. The parties shall respond to the county within twenty days of the postmark of this notice. Order YOU ARE HEREBY ORDERED to abate violation by the following options below- 1. Apply for a Change in Tenant permit. A complete permit application shall contain all information requested in the application form. A Change in Tenant Application is enclosed. 2. Apply for permits for 10 ft required fence and fire protection as required in Mason County code section 17.09 3. Abandon tenant changes and notify me that the building will not be occupied. Remember that permits shall be required for all future tenants. Penalties This notice is to inform you that in the event that you fail to comply, we will pursue additional enforcement action against you, including but not limited to recording against the parcel, civil infractions, liens against the property through the Mason County Hearings Examiner process and/or criminal prosecution as allowed under Title 15.13 of the Mason County Code.
