Parcel b is Rural Shoreline Designation; standard shore setback is 25 feet from Ordinary High Water Mark and standard sideyard setback is 10 feet. Critical areas present: Category 1 wetlands are present along the North Bay Case Inlet shoreline; these consist of saltwater and freshwater wetlands with estuarine plants species; the vegetation buffer between the edge of the wetland and the proposed development needs to be 125 feet and the building setback needs to be an additional 15 feet. Category 4 wetlands are present at the center and rear of these properties; the vegetation buffer between the edge of the wetland and the proposed development needs to be 25 feet and the building setback needs to be an additional 15 feet; the presence of water from shallow soils and from surface and subsurface drainage from the west has permitted wetland plants to grow; the old fill that has been placed near to the saltwater shoreline on both of these parcels (from driveways and from past attempts to place a residence on each property) has contributed to retention of water on the properties; a ditch has been dug along the north property line of parcel b and outlets next to the old fill on this parcel. Potential development of these parcels will be affected by these wetlands. The boundaries of these wetlands shall be delineated/marked by a qualified wetland biologist. When the proper vegetation buffer and building setbacks are measured from these boundaries, the area for development will be established. Some plan of water management (ditching and filling of some areas and establishing wetlands in other areas of the properties) may be considered as part of a development proposal. This plan can take the form of a Mason Environmental Permit that allows an approved site plan and conditions of development. Excavation and fill within 200 feet of the edge of the category 1 wetlands will need a Shoreline Substantial Development and Conditional Use Permit. Close coordination with the county shoreline planner will assist in reviewing any proposal.
