The property does contain some steep slopes and a Class 3 wetland. The wetland was delineated by Agua Tierra Land & Water Services and a geo-technical report was prepared by the same company. An Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed Environmental Checklist and other information on file with the Lead Agency. This information is available to the public upon request. Also, that trees and vegetation on slope and buffer on crest slope west of the proposed home site be left, if slope is to remain intact. (This applies to if hill and slope are not going to be reduced and used as fill). Escape of silty water or mud from the timber harvest area shall be considered a violation of County and State stormwater management regulations, and could subject the applicant(s) to civil fines or penalties. 2) WETLAND SETBACKS A 50- foot vegetative buffer and an additional 15- foot building setback shall be observed on a Class III wetland as documented by Celina Abercrombie of Agua Tierra Land & Water Services, March 2006. PO Box 47775• Olympia,Washington 98504-7775• (360) 407-6300 August 14,2006 Your address Mr. Michael MacSems is in the Department of Community Development Kennedy- Mason County Planning Division Goldsborough PO Box 279 watershed Shelton, WA 98584 tA Dear Mr.MacSems: Thank you for the opportunity to comment on the mitigated determination of nonsignificance for the Lawrence Logging project for the construction of a Homesite and Pasture(SEP2005-00119), located at 100 West Reller Road in Shelton,as proposed by James Lawrence. The Department of Ecology (Ecology)reviewed the environmental checklist and has the following comment(s): WATER QUALITY: Roberta Woods(360)407-6269 Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48 RCW, Water Pollution Control,and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent stormwater runoff from carrying soil and other pollutants into surface water or storm drains that lead to waters of the state. Sand, silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants. Proper disposal of construction debris must be on land in such a manner that debris cannot enter the wetlands,natural stormwater drainage systems or cause water quality degradation of state waters. During construction,all releases of oils,hydraulic fluids, fuels,other petroleum products,paints, solvents,and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state. The cleanup of spills should take precedence over other work on the site. Coverage under the National Pollution Discharge Elimination System(NPDES)and State Waste Discharge General Permit for Stormwater Discharges Associated with Construction Activities is required for construction sites which disturb an area of one acre or more and which have or will have a discharge of stormwater to surface water or a storm sewer. Clearing limits and/or any easements or required buffers should be identified and marked in the field, prior to the start of any clearing,grading, or construction. Some suggested methods are staking and flagging or high visibility fencing. to
