You wish to log, clear and grade much of your 10-acre site in order to construct a home and establish a pasture and orchard. As we discussed earlier, there are some features of your property that will require addition study before the County can sign off on the Forest Practices Application(FPA)or issue Land Modification and Building permits. The issues are as follows: WETLAND: Based on walking the property, it appears that some type of wetland exist on your property, laying diagonally across Lot 8 from SW to NE. I'm not sure to what extent it also lays on Lot 7. Based on conversations with my colleagues here in the Planning Department, I think the wetland is most likely a Category III which has a 65 foot building setback and needs to be at least 2,500 square feet in size to be jurisdictional under the Mason County Resource Ordinance (Wetland Chapter enclosed). Before Mason County can approve any of your development plans you will need to hire a qualified biologist to determine the wetland's category, size and boundaries. If jurisdictional, you should have the biologist flag the wetland's boundaries on both sides, as I understand that you have plans for the northerly portion of Lot 7. Should this wetland turn out to be jurisdictional, you will need to modify your development plans,which we can discuss in more detail at that time. STEEP SLOPES: The SW corner of your property contains slopes as steep as 55%, and as such is considered a potential landslide hazard under the Mason County Resource Ordinance (chapter enclosed). The ordinance does not specify a building or cutting setback from a steep slope but does require that any such activity requiring a permit within 300 feet of the toe or crest of such a slope be reviewed, conditioned and approved by a qualified professional (see 17.01.100.E.3)who will prepare a Geo-Technical Report for County approval. PILEATED WOODPECKER HABITAT: Under the Fish and Wildlife Habitat chapter(17.01.110)of the Resource Ordinance, Pileated Woodpecker habitat is to be left undisturbed(unless a Habitat Management Plan is approved). In the SW corner of your property I did notice two snags that show evidence of woodpecker foraging. These snags and any other forage snags 10 feet or taller and 12 inched dbh should be left undisturbed. This will be a condition of your SEPA determination. If sediment is deposited, it should be cleaned every day by shoveling or sweeping. Water cleaning should only be done after the area has been shoveled out or swept. WETLANDS: Rick Mraz(360)407-6221 In order to protect the wetland and buffer from construction impacts,Ecology recommends installation and maintenance of a fence at the wetland buffer prior to and during all clearing/construction activities. If a fence is not appropriate,we recommend that the wetland buffer be conspicuously flagged in the field to clearly define the area in which no work should occur. Ecology's comments are based upon the information provided with the SEPA checklist. As such,they do not constitute an exhaustive list of the various authorizations that must be obtained or legal requirements that must be fulfilled in order to carry out the proposed action. In that letter(copy enclosed) I listed the items that would need to be addressed and dealt with before a Forest Practices Application could be approved for your Reller Road property. I realize that you may well have been overwhelmed with number of studies required to log you property however six months have now past since our last correspondence. At this time I am obligated to start the 180-day clock per Mason County Title 15. Please address the issues in my September 9th letter within 180-days of today's date in order to avoid having your case closed and the file disposed of. This is a standard action that the County takes in order to avoid backlogs of inactive applications. I certainly hope that such drastic action will not be necessary.
