Out-of-County Recognition of Mason County Deputy Public Defender Rose Boughton
Background/Executive Summary:
Rose Boughton has been announced as the winner of this year’s WDA President’s Award. This award
represents WDA’s selection of the top overall public defender at a state-wide level. Ms. Boughton, who has
only been licensed since 2020, has made an incredible impression with her extraordinary service to her clients.
For an attorney with only four years’ experience to win this award is virtually unprecedented.
Of a full staff of six attorneys, this makes two winners of this award serving Mason County Public Defense.
This is per capita higher than any other county in the state – indeed, it is simply higher (without respect to
capita) than many much larger counties, including King and Pierce. Ms. Boughton, with this award, has made
sure that Mason County stands out as an example of a county serving its public defense clients right.

Interagency Agreement with Washington State Noxious Weed Control Board – FY24 Class A and B
Designate Noxious Weed Eradication Program.
Background/Executive Summary:
The Mason County Noxious Weed Control Board is submitting a proposal to Washington State Noxious
Weed Control Board for continued funding of perennial pepperweed control, within Mason County. In
2023, Mason County Noxious Weed Control Board was awarded $2,150 from the WSNWCB as part of
their FY24 Class A and B Designate Noxious Weed Eradication Program. This agreement helped fund
control of perennial pepperweed (Lepidium latifolium) along the Hood Canal shoreline.
Budget Impact (amount, funding source, budget amendment):
Provide a maximum of $5,000 for the 2025 budget year. This will assist with funding the extra-help
noxious weed position.

INTERAGENCY AGREEMENT
BETWEEN
THE WASHINGTON STATE DEPARTMENT OF AGRICULTURE
AND
MASON COUNTY
AND ITS AGENT
THE MASON COUNTY NOXIOUS WEED CONTROL BOARD
THIS AGREEMENT is made and entered into by and between the Washington State
Department of Agriculture, hereinafter referred to as “WSDA,” and Mason County Noxious
Weed Control Board, hereinafter referred to as “Mason County.”
IT IS THE PURPOSE OF THIS AGREEMENT to provide funding for eradication and
control of the Class B noxious weed perennial pepperweed (Lepidium latifolium) in Mason
County.
THEREFORE, IT IS MUTUALLY AGREED THAT:
STATEMENT OF WORK
Mason County, through its agent the Mason County Noxious Weed Control Board, shall furnish
the necessary personnel, equipment, material and/or service(s) and otherwise do all things
necessary for or incidental to the performance of the work set forth in Attachment “A and B”
which are attached hereto and incorporated herein.
PERIOD OF PERFORMANCE
Subject to its other provisions, the period of performance of this Agreement shall commence on
July 1, 2023, and be completed on or before June 30, 2024, unless terminated sooner as
provided herein.
COMPENSATION
Compensation for the work provided in accordance with this Agreement has been established
under the terms of RCW 39.34.130. This is a performance-based contract, in which payment to
the recipient (Mason County) is based on the successful completion of expected deliverables.
The parties have determined that the cost of accomplishing the work herein will not exceed
$2,150. WSDA will not authorize reimbursement for administrative overhead charges. Only
reasonable costs incurred directly related to the activities specified in the plan of work
(Attachment A) and proposal (Attachment B) will be reimbursed under this Agreement.
Payment for satisfactory performance of the work shall not exceed this amount unless the
parties mutually agree in writing to a higher amount prior to the commencement of any work that
will cause the maximum payment to be exceeded.
BILLING PROCEDURE
Mason County shall submit a properly completed invoice to the WSDA Agreement
administrator. Reference WSDA Contract number [K4795] on each invoice. Payment to Mason
County for approved and completed work will be made by warrant or account transfer by WSDA
within 30 days of receipt of the properly completed invoice. Upon expiration of the Agreement,
any claim for payment not already made shall be submitted within 10 days after the expiration
date or the end of the fiscal year (June 30th, 2024) whichever is earlier.
BILLING DETAIL
Each invoice voucher submitted to Agency by the Contractor shall include such information as is
necessary for the Agency to determine the exact nature of all expenditures. At a minimum, the
Contractor shall specify the following:

a. WSDA Agreement Number K4795_________________.
b. The cost for each deliverable, service provided, task completed, or item purchased.
c. The total number of hours worked for each employee or contracted labor.
d. The total amount of taxes. (If applicable)
e. Any other applicable information.
f. The total invoice charge.
DUPLICATION OF BILLED COSTS
The Contractor shall not bill the Agency for services performed under this contract, and the
Agency shall not pay the Contractor, if the Contractor is entitled to payment or has been or will
be paid by any other source, including grants, for that service.
FUNDING CONTINGENCY
In the event funding from state, federal, or other sources is withdrawn, reduced, or limited in any
way after the effective date of this Agreement and prior to completion of the work in this
Agreement, the Agency may:
a. Terminate this Agreement with 30 days advance notice. If this Agreement is
terminated, the parties shall be liable only for performance rendered or costs
incurred in accordance with the terms of this Agreement prior to the effective date of
termination;
b. Renegotiate the terms of the Agreement under those new funding limitations and
conditions;
c. After a review of project expenditures and deliverable status, extend the end date of
this Agreement and postpone deliverables or portions of deliverables; or,
d. Pursue such other alternative as the parties mutually agree to writing.
MAINTENANCE OF RECORDS
The parties to this Agreement shall each maintain books, records, documents and other
evidence that sufficiently and properly reflect all direct and indirect costs expended by either
party in the performance of the services described herein. Documents must also support
performance and costs of any nature expended in the performance of this Agreement. These
records shall be subject to inspection, review or audit by personnel of both parties, other
personnel duly authorized by either party, the Office of the State Auditor, and federal officials so
authorized by law. All books, records, documents and other material relevant to this Agreement
will be retained for six years after expiration of the Agreement and the Office of the State
Auditor, federal auditors and any persons duly authorized by the parties shall have full access
and the right to examine any of these materials during this period.

If any litigation, claim or audit is started before the expiration of the six (6) year period, the
records shall be retained until all litigation, claims, or audit findings involving the records have
been resolved.
Records and other documents, in any medium, furnished by one party to this Agreement to the
other party, will remain the property of the furnishing party, unless otherwise agreed. The
receiving party will not disclose or make available this material to any third parties without first
giving notice to the furnishing party and giving it a reasonable opportunity to respond, consistent
with applicable laws. Each party will utilize reasonable security procedures and protections to
assure that records and documents provided by the other party are not erroneously disclosed to
third parties. However, the parties acknowledge that State Agencies are subject to chapter
42.56 RCW, the Public Records Act.
SITE SECURITY
While on Agency premises, Mason County, its agents, employees, or Subcontractors shall
comply with the Agency security policies and regulations.
RIGHTS IN DATA
Unless otherwise provided, data that originates from this Agreement shall be “works for hire” as
defined by the U.S. Copyright Act of 1976 and shall be owned by WSDA. Data shall include,
but not be limited to, reports, documents, pamphlets, advertisements, books, magazines,
surveys, studies, computer programs, films, tapes and/or sound reproductions. Ownership
includes the right to copyright, patent, register, and the ability to transfer these rights.
INDEPENDENT CAPACITY
The employees or agents of each party who are engaged in the performance of this Agreement
shall continue to be employees or agents of that party and shall not be considered for any
purpose to be employees or agents of the other party.
AGREEMENT ALTERATIONS AND AMENDMENTS
This Agreement may be amended by mutual agreement of the parties. Such amendments shall
not be binding unless they are in writing and signed by personnel authorized to bind each of the
parties.
TERMINATION
Either party may terminate this Agreement upon 30 days’ prior written notification to the other
party. If this Agreement is so terminated, the parties shall be liable only for performance
rendered or costs incurred in accordance with the terms of the Agreement prior to the effective
date of termination.
TERMINATION FOR CAUSE
If for any cause, either party does not fulfill in a timely and proper manner its obligations under
this Agreement, or if either party violates any of these terms and conditions, the aggrieved party
will give the other party written notice of such failure or violation. The responsible party will be
given the opportunity to correct the violation or failure within 15 working days of receipt of
written notice. If the failure or violation is not corrected, this Agreement may be terminated
immediately upon receipt of written notice of the aggrieved party to the other.
CONFLICT OF INTEREST
WSDA may, by written notice to Mason County, terminate this Agreement if it is found after due
notice and examination by the Director of the Department of Agriculture, and/or the designee
authorized in writing to act on the Director’s behalf, that there is a violation of the State Ethics
Law, chapter 42.52 RCW; or any similar statute involving Mason County in the procurement of

or performance under this Agreement. Unless stated otherwise, the signatory of this Agreement
is the Director’s designee.
In the event this Agreement is terminated as provided above, WSDA shall be entitled to pursue
the same remedies against Mason County and its agent the Mason County Noxious Weed
Control Board as it could pursue in the event of a breach of the Agreement by Mason County.
The rights and remedies of WSDA provided for in this clause shall not be exclusive and are in
addition to any other rights and remedies provided by law.
FUNDING CONTINGENCY
WSDA may unilaterally terminate all or part of this contract, or may reduce its plan of work and
budget, if there is a reduction in funds by the source of those funds, and if such funds are the
basis for this Agreement.
DISPUTES
In the event that a dispute arises under this Agreement, either of the parties may request
intervention by the Governor, as provided by RCW 43.17.330, in which event the Governor's
process will control.
LICENSING, BONDING, INDUSTRIAL INSURANCE AND OTHER INSURANCE COVERAGE
Mason County and its agent the Mason County Noxious Weed Control Board shall ensure that
all contractors hired to perform services under this Agreement shall comply with all applicable
licensing and bonding requirements for the type of service to be performed, and with the
provisions of Title 51, Industrial Insurance. Mason County and its agent the Mason County
Noxious Weed Control Board shall also ensure that all contractors provide proof of an adequate
amount of commercial general liability insurance coverage for the activities to be performed
under any subcontract.
GOVERNANCE
This Agreement is entered into pursuant to and under the authority granted by the laws of the
state of Washington and any applicable federal laws. The provisions of this Agreement shall be
construed to conform to those laws. In the event of a lawsuit involving this contract, venue shall
be proper only in Thurston County, Washington.
In the event of an inconsistency in the terms of this Agreement, or between its terms and any
applicable statute or rule, the inconsistency shall be resolved by giving precedence in the
following order:
a. Applicable state and federal statutes and rules;
b. The Terms and Conditions of this Agreement;
c. Plan of work (Attachment A);
d. Proposal (Attachment B); and
e. Any other provisions of the Agreement, including material incorporated by
reference.
ASSIGNMENT
The work to be provided under this Agreement, and any claim arising thereunder, is not
assignable or delegable by either party in whole or in part, without the express prior written
consent of the other party, which consent shall not be unreasonably withheld.
WAIVER
A failure by either party to exercise its rights under this Agreement shall not preclude that party
from subsequent exercise of such rights and shall not constitute a waiver of any other rights
under this Agreement. Waiver of any default or breach shall not be deemed to be a waiver of
any subsequent default or breach. Any waiver shall not be construed to be a modification of the

terms of this Agreement unless stated to be such in writing and signed by personnel authorized
to bind each of the parties.
SEVERABILITY
If any term or condition of this Agreement is held invalid, such invalidity shall not affect the
validity of the other terms or conditions of this Agreement.
ALL WRITINGS CONTAINED HEREIN
This Agreement contains all the terms and conditions agreed upon by the parties. No other
understandings, oral or otherwise, regarding the subject matter of this Agreement shall be
deemed to exist or to bind any of the parties hereto.
CONTRACT MANAGEMENT
The Agreement administrator for each of the parties shall be responsible for and shall be the
contact person for all communications and billings regarding the performance of this Agreement.

ATTACHMENT A
Plan of Work

Perennial Pepperweed Control
Ending June 30, 2024
The Mason County Noxious Weed Control Board will treat the class B noxious weed, perennial
pepperweed (Lepidium latifolium) with the goal of eradication and/or control.
Reimbursement for travel expenditures shall not exceed allowable costs as set forth in
Washington State travel regulations, contained in the Office of Financial Management State
Administrative and Accounting Manual, Chapter 10, Section 90.
DELIVERABLES
The Mason County Noxious Weed Control Board will accomplish all proposed tasks as stated in
the proposal (Attachment B). The Mason County Noxious Weed Control Board shall submit a
final written report to the Washington State Noxious Weed Control Board, on or before June 30,
2024. The report shall include, at a minimum, the following information:
1. Details of herbicide use including application methods, rates and equipment.
2. Flower and seed head control details.
3. Copies of spray records where applicable.
4. Digital and hard copy photos of the infestation before, during and after treatment.
5. Details of communication with landowners where applicable.
6. Future plan for follow-up treatments and infestation monitoring.

Implementation of TEGRIS Inspection Management System
Background/Executive Summary:
The County adopts the International Fire Code (IFC) as part of our Municipal Code Title 14. Part of that code
requires building owners to have their life safety systems such as fire alarms, sprinkler systems and other
equipment inspected on a regular basis. Those reports are then sent to the County Fire Marshal for approval
and records retention which has been a standard practice for decades.
The current system in place is not efficient as current reports are being sent in multiple ways. Some are mailed
while others are emailed to the Community Development Department. Every report has its own format and
ways to identify deficiencies. The result is a current system that takes an exorbitant amount of time to review
and maintain a filing system given these variations in reporting.
This program will help the Community Development Department better manage reporting, more easily follow
up on systems that have deficiencies, and retain our required reporting records. It is a cloud-based system that
allows the office to access the system remotely. Although not adopted, many companies in Mason County
already use this system and fifty businesses are using TEGRIS Fire for their reporting needs.
Budget Impact (amount, funding source, budget amendment):
There is no charge to the County for using the reporting system. Inspection companies pay a fee when they
upload their reports. The maximum charge to the inspection company is up to $15.
Public Outreach (news release, community meeting, etc.):
The IFC currently requires reporting; this system is a preferred reporting method. TEGRIS Fire will notify all
contractors on the county's behalf that this is the way to report to Mason County. As the current system used
by Shelton, inspection companies are already in the practice of using this reporting. It is my opinion that our
office will realize a more efficient operation should it be approved.
A letter explaining the reporting will also be included with all notices that go out for the first year. See the
attached example.
Requested Action:
As per IFC [A] 108.1 Maintenance of safeguards, [A] 108.2 Testing and operation, [A] 108.3 Recordkeeping
make TEGRIS Fire the reporting system inspectors are required to report to as of May 1st, 2024.

Dear Business/Building Owner:
The Mason County Fire Marshal’s office has entered into an agreement with Tegris Incorporated to employ an
electronic Inspection Management System within our service area. The purpose of this program is to ensure that the
fire protection systems are functional and ready for use if needed.
The Tegris system allows your existing fire protection system company or inspector to submit an electronic report on
the functionality of your fire alarm system, fire sprinkler system, commercial hood suppression system and or any
other fire and life safety system that is installed or exists in your facility.
The purpose of this program is to assist the Mason County Fire Marshal with inspecting, testing and maintenance of
all Fire and Life Safety systems within the county. This periodic testing is required by state and local ordinance and
is to be conducted by a state licensed and certified inspector. The program will populate and maintain a database
for easy access to fire and life safety inspection information.
Through the use of a secure web site, property owners, testing companies and the fire marshal can all view and edit
property information and fire protection system status. The Tegris system will automatically send reminders to
property owners or manages when systems are due for testing. This service will ensure that you are aware of the
status of your fire protection system, as well as the maintenance and testing responsibilities required under the
International Fire Code.

information on this letter (due date, system type, and contact information) may or may not be accurate and is not a
refiection on the quality of the service you received from the company providing your inspections. If this information

Johnson & Johnson Opioid Settlement
Background/Executive Summary:
The Johnson & Johnson opioid settlement deadline is May 11, 2024. The Attorney General’s Office
strongly encourages counties to join the settlement. If all eligible cities and counties join as they did for
the prior opioid settlements, cities and counties will receive $61.67 million in the June/July 2024
timeframe from the Johnson & Johnson settlement.

Item: County Road Closure -- Satsop Cloquallum Road for the Comfort Creek
Culvert Replacement Project
Background/Executive Summary:
Public Works will be replacing a culvert on the Satsop Cloquallum Road at MP 5.20. Comfort Creek culvert
replacement project that will remove a restricted flow path under Satsop Cloquallum Road. The existing 30” pipe is
failing and prevents debris from passing under the roadway and causes aggradations, restricting the culvert and
causing the creek to flow over the road and flood neighboring properties. The project will reduce the maintenance
costs and environmental impacts associated with the existing culvert. We are requesting the road to be closed in order
to install the new culvert.
Closure scheduled to begin at approximately 7:00am Monday, August 19, 2024 and reopen at 4:00pm Friday,
August 30, 2024.
Budget Impact:
The culvert was purchased and delivered in 2023 for $96,444.35. County force work is estimated to cost
$90,000.00.
Public Outreach:
1. Notice of closures will be published in the Shelton Journal.
2. Closure information will be posted on County Facebook page, TV Channel 3 and County webpage under
“Road Closures, Restrictions and Conditions”.
3. Reader boards will alert drivers at least 3-days prior to the start of each closure.
4. Notices will be posted in a conspicuous place at each end of the portions of roadway to be closed.
Requested Action:
Requesting the Board approve the county road closure on Satsop Cloquallum Road from August 19, 2024 to
August 30, 2024 at approximate M.P. 5.2 for the culvert replacement project.

NOTICE IS HEREBY GIVEN that pursuant to RCW 47.48.010, the Satsop Cloquallum Road shall be
closed to all traffic at approximate milepost 5.2 for a culvert replacement project. The road closure is
scheduled to begin at approximately 7:00am on Monday, August 19, 2024 and reopen at approximately
4:00pm on Friday, August 30, 2024.
Detour signs will be in place to guide local residence and emergency vehicles around on the closure.

INCREASING GRINDER PUMP FEES FOR
NORTH BAY/CASE INLET AND BELFAIR SANITARY SEWER SYSTEM
WHEREAS, the provisions of water and wastewater utility services and activities within Mason County requires
collection of fees to operate and maintain these facilities; and,
WHEREAS, it is the role and responsibility of Mason County Board of Commissioners to set policy for Water and
Sewer Utility Systems, including monthly service rates, connection and permit fees and other related charges sufficient to cover
the cost of utility operation, debt, and capital improvements; and,
WHEREAS, Commissioners adopted 2022-092 establishing 2023 rates and fees for the County water and sewer
facilities; and,
WHEREAS, the Board of Mason County Commissioners, by this resolution. desire to amend the current fee to increase
the grinder pump fee to cover current cost to the County; and,
NOW THEREFORE, IT IS ESTABLISHED that the new fee schedule shall become effective immediately.
BE OT FURTHER RESOLVED the Board of Mason County Commissioners hereby adopt the new Public Works
utilities rates and fee schedule as shown in Exhibit A.

RE: Mason County Civil Service Commission Vacancy
The Board of Mason County Commissioners is seeking applications to fill a position on
the Mason County Civil Service Commission. This is for a six-year term that will end
December 31,2028.
To qualify,the individual must be a United States citizen,a resident of Mason County for
at least the past two years, and an elector in Mason County. This person cannot be
employed by Mason County and shall serve without compensation. At the time of
appointment, not more than two commissioners shall be adherents of the same political
party.
The general purpose of the Civil Service Commission is to establish a merit system of
employment for County Deputy Sheriffs and other employees of the Office of County
Sheriff.
The Mason County Civil Service Commission meets on the third Thursday of each month
at 5:00 p.m. at Mason County Building 9 located at 423 North 5th Street in Shelton.
Interested parties may obtain an application at the Mason County Commissioners' Office

The insurer that provides coverage for the County’s underground fuel tank systems has decided not to
renew another year and the policy ends on April 20, 2024. The broker, Arthur J Gallagher, is working
expeditiously to lock in a new policy.
Background/Executive Summary:
One of Public Works’ underground tanks was temporarily shut down since the last policy renewal. The
insurer did not want to insure that tank that is temporarily closed. However, the tank is required to have
coverage, even while temporarily closed. Because of this reason, the County needs to seek coverage from
a different provider.

Unknown at this time
Requested Action:
No action needed at this time. If premium is less than $50,000, the County Administrator’s signature is
acceptable.
