Subject: Shelton Auto Parts/Wrecking
The above-referenced vehicle wrecke (WA wrecker license number
1213) is attempting to change addre ses from 1501 Dayton Airport
Road to W 151 Pine Acres Way (both S elton addresses) .
On November 18 , 1993 the owners, Daniel and Rebecca Walters,
submitted an application to this department for the new address. By
the way, they are also changing the business name to Shelton's Best
Auto Dismantling.
Since the Washington State Patrol inspector had told us that the
new location was between two new homes ,and also was not fenced, I
called your office and spoke with Eugenia Pettit. She said she had
signed the change of address but did not realize that the Walters
were intending to set up a wrecking yard there. Based on Ms.
Pettit's comment we refused to accept the application for that
address.
The vehicle wrecker license administrative laws, RCW 46.80. 010 (2) ,
require that the place of business conform with zoning regulations.

Dear Mr. Yando:
To follow up on my letter of October 6 , 1993 , thank you very much
for making the file available to me so quickly. I have just had
the chance to review the Mason County Interim Resource ordinance,
Ordinance number 77-93 . According to Section 17 .01. 120 (E) (2) (b)
Grant and Tammy Long who live next door to the proposed project by
Ms Walters, seek public review of the application of Ms Walters.
This project contains substantial inherent risk due to the nature
of various hazardous materials which will be involved, the
proximity of two wells, one of them a community well and the
location of the project within a highly critical aquifer per the
attached map.

I have been contacted by people who live in the neighborhood where
Ms. Walters intends to locate her business. They are concerned
about the impact that the business will have and they wish to
comment about the Determination of Nonsignificance which was issued
on approximately September 30, 1993. I understand that Comments
can be made through October 15, 1993 .
According to RCW 42 .17.250 et. seq. I request copies of all matters
in the file. According to the Statutes the documents must be
provided within 5 days. Since there is such a short period for
comments, I would appreciate any accommodation you can make about
providing the documents as soon as possible.
If there are any questions or if I am wrong about any of the
matters I have stated, please contact me.

RESPONSE TO PROPOSED Sheltons Best Auto Dismantling
W. 151 Pine [acres Way
We feel Pine Acres Way is more of 'a residential area
than business-we moved here becau e it was peaceful
and quite .
Several families plan to live on Dine Acres Way-2 families
are already in residence .
As map shows 7families will be living here.
At this point our borne is connected to the community
well ,that, is located on W. 151 Pine Acres Way.
WE are concerned about the future health of our children.
Also,W. 91 Pine Acres Way has a private well ,adjacent
to the proposed site .
We also uderstand there is a critical aquifer recharge
area under us . They will try to keep all spills contained,
'ut with several people working and dismantling several
autos , is it really possible?
In Mrs . Walters application for permit she stated:

State Patrol Academy is across the highway from Pine
Acres Way,we can't see or hear them.
Aero Controls Warehouse ,has its own access road off
highway 102, we dont even know they are there.
Loggers Home & Business Site-that must be us .
We are truckers- we have 1 truck parked on our 5 acres
that we use for our livelihood,also 1 tiltbed trailer.
We drive 5 miles an hour down the road,in respect for
our neighbors , and to save wear on the road.Will the
clientele for the auto dismantling have the same respect?
Residential-that must be W. 91 they arent the only resident ,
there will be 7 .
Pending Warehouse Site-is this the electrical warehouse? ,
they wont draw as much traffic ,or the same kind as the
auto dismantling.
Pending Business Location-Dismantling?
Pending Fraternal Order Building-They will probably
have access off 102 ,and wont have daily traffic .
The families here and the future families have children
and pets that are used to the freedom of a quiet road
they walk to and from the school bus ,ride bikes ,play,
we are concerned for their safety,with the increased
traffic flow.
We also don' t want our children around a lot of strangers ,
that would be coming around.Already one really strange
guy came to our door, looking for the "junk yard" ,
even though he had to have driven past it and it is clearly
marked,also our house is way in the back of our property,
so he drove all the way into our private drive,knocked
on our door, asked alot of questions about said "junk
yard'" (his words ) and didn"t want to leave ,even though
we knew nothing about it ,and made it plain we wanted
him to leave !

THIS LETTER IS IN RESPONSE TO THE PROPOSED AUTO DISMANT-
LING WAREHOUSE TO BE LOCATED AT WEST 151 PINE ACRES WAY,UNDER
THE NAME OF"SHELTONS BEST AUTO DISMANTLING" OWNED BY REBECCA
WALTERS AND HER HUSBAND.
FOLLOWING ARE THE CONCERNS AND JUSTIFIABLE ARGUMENTS
AGAINST SAID PROPOSED AUTO DISMANTLING WAREHOUSE .
1 . UNDER THE MASON COUNTY IN'T'ERIM RESOURCE ORDINANCE, WHICH
IS EFFECTIVE THIS DAY OF OCTOBER 1 , 1993 , WE BELIEVE OUR AREA OF
PINE ACRES WAY TO BE A CRITICAL AQUIFER RECHARGE AREA. COMMUNITY
WATER IS DERIVED FROM A COMMON WELL LOCATED ON PROPOSED SITE,
AS WELL AS WATER BEING PUMPED FROM A PRIVATE WELL OWNED BY OUR
FAMILY AT WEST 91 PINE ACRES WAY, WHICH IS DIRECTLY ADJACENT
TO PROPOSED WAREHOUSE SITE .THE WATER LEVEL OF OUR PRIVATE WELL
IS ONLY 60 FEET DOWN, VERY CRITICAL INDEED IF EVER THERE WERE
TO BE ANY HAZARDOUS CHEMICALS SPILLED OVER THE AQUIFER AREA.
AS STATED ON PAGE 24 SECTION D. UNDER DEVELOPMENT STANDARDS
OF THE MASON COUNTY INTERIM ORDINANCE, "DEVELOPMENT WITHIN CRITICAL
RECHARGE AREAS SHALL BE IN COMPLIANCE WITH THE MASON COUNTY
HAZARDOUS WASTE TREATMENT AND STORAGE FACILITIES SITING ORDINANCE,
THE STATE OF WASHINGTON DANGEROUS AND HAZARDOUS WASTE REGULATIONS
( INCLUDING RCA 70 . 105 AND WAC 173-303 ) , SEPA, MASON COUNTY
HEALTH CODES AND ANY OTHER APPLICABLE COUNTY, STATE, AND
FEDERAL REGULATIONS. " WE BELIEVE FURTHER STUDIES ARE NEEDED
TO VERIFY COMPLIANCE WITH THESE REGULATIONS .
IF OUR AREA AT PINE ACRES WAY IS IDENTIFIED AS A CLASS 1
EXTREMELY CRITICAL AQUIFER RECHARGE AREA, THEN AS STATED ON
PAGE 25 SECTION E. AN ENVIRONMENTAL GEOLOGIC REPORT SHALL BE
REQUIRED FOR ANY ACTIVITY.
UNDER SECTION 17 .01 . 150 VARIANCES FROM STANDARDS, PAGE 50 ,
AND PAGE 51 E. #4 . , IT IS STATED THAT ANY GRANTING OF VARIANCES
SHALL NOT IMPAIR OR SUBSTANTIALLY DIMINISH PROPERTY VALUES OF
SURROUNDING NEIGHBORHOOD PROPERTIES . SOMETHING WHICH WE BELIEVE
WILL OCCUR IF SAID PROPOSED DISMANTLING BUSINESS WERE TO BE
ALLOWED TO OPERATE IN THIS COMMUNITY.
( 1 )
CONCERN #2 : THE INCREASED TRAFFICIPRODUCED BY SAID BUSINESS ,
WILL CREATE ENVIRONMENTAL AND PERSONAL DANGERS TO OUR COMMUN-
ITY BECAUSE OF THE INCREASED DUST 'FROM THE PRIVATE ROADWAY,
THE NOISE POLLUTION CAUSED BY THE AIR WRENCHES, THE USE OF A
CAR PARTS COMPACTOR, AND THE DANGER TO OUR CHILDREN AND PETS
DUE TO ALL THE BUSINESS TRAFFIC .WE HAVE A TRANQUIL AND PEACEFUL
COMMUNITY AND WISH TO KEEP IT AS SUCH.
3 . PINE ACRES WAY IS A PRIVATE ROAD WHEREBY PROPERTY
OWNERS ARE ASSESSED AN ANUAL MAINTENANCE FEE ACCORDING TO THE
AMOUNT OF PROPERTY FRONTING SAID ROADWAY. WE DO NOT DEEM IT
AS FAIR TO HAVE COMMERCIAL BUSINESSES USE THIS PRIVATE ROAD
AND STILL BE EXPECTED TO PAY FEES TO MAINTAIN IT WHEN OUR
PRIVATE USEAGE DOES NOT HAVE THE DAME DAMAGING IMPACT AS
WOULD OCCUR FROM TOW TRUCKS, FLAT BEDS, CUSTOMERS, etc.FROM
SHELTONS BEST AUTO DISMANTLING BUSINESS .
IF COMMERCIAL BUSINESSES OF ANY SORT ARE PERMITTED INTO
OUR PINE ACRES COMMUNITY, WE BELIEVE IT ONLY REASONABLE TO
EXPECT SAID BUSINESSES TO BLACKTOP OR PAVE PINE ACRES WAY ROAD.
4 . HISTORY HAS SHOWN THAT OTHER AUTO DISMANTLING PLACES
WHO ONCE STARTED OUT IN AN ENCLOSED FACILITY, EVENTUALLY STARTED
TO SPREAD THEIR REFUSE OUTSIDE OF THEIR CONTAINED "WAREHOUSES"
ONTO ADJOINING LAND. THE SCRAP METAL PARTS THAT WILL BE TRUCKED
ELSEWHERE WILL BECOME SUCH AS THEY WILL EVENTUALLY PLACE SAID
MATERIALS AND BODY PARTS OUTSIDE OF THE WAREHOUSE.
WE AT PINE ACRES WAY HAVE PROTECTIVE COVENANTS STATING
AT #6 , THAT "NO DUMPING OF ANY REFUSE,GARBAGE OR AUTOMOBILES
OR LIKE VEHICLES WILL BE ALLOWED" . WILL MASON COUNTY BE WILLING
TO ACCEPT THE RESPONSIBILITY OF ENFORCING SAID COVENANTS WHEN
THEY BECOME BROKEN IN THE FUTURE?
5 . THE MAJORITY OF THE PROPERTY OWNERS OF PINE ACRES WAY
PURCHASED SAID RESPECTING ACREAGE DUE TO THE VERY FACT OF
HAVING PROTECTIVE COVENANTS AVAILABLE FOR OUR PROTECTION OF
OUR PROPERTY VALUES AS WELL AS OUR PERSONAL ENJOYMENT OF
THIS COUNTRY SETTING. THE TYPE OF BUSINESS PROPOSED FOR THIS
NEIGHBORHOOD IN THE FORM OF AN AUTOMOBILE DISMANTLING BUSINESS,
EVOKES FEAR INTO ANYONE WHO SEES OR HEARS OF SUCH BUSINESSES
IN A HOMEOWNING AREA.WHEN THE RESALE VALUE OF OUR HOMES ARE
DEVALUATED BECAUSE OF THE ESTABLISHMENT OF SAID BUSINESS,
WILL OUR PROPERTY VALUES ACCORDING TO THE TAX ASSESSOR BE
LOWERED ALSO TO COMPENSATE OUR FAMILIES?
THERE ARE MANY AREAS IN MASON COUNTY WHERE SAID BUSINESS
COULD BE OPERATED WITHOUT THE DETRIMENTAL IMPACT THAT SUCH
BUSINESS WILL HAVE ON PINE ACRES WAY. THE PORT OF SHELTON
PROPERTY WOULD BE SUITABLE FOR THEM, AS WELL AS THE JOHNS
PRAIRIE INDUSTRIAL AREA. WE FEEL VERY ANGRY THAT RH AND L
REALTY DID NOT TAKE THE OTHER HOMEOWNERS INTO CONSIDERATION
WHEN TELLING MRS . WALTERS AND HER HUSBAND THAT THEY COULD SET

UP BUSINESS AT PINE ACRES WAY. MR. MARLEY YOUNGjHAVING BEEN
PREVIOUSLY INVOLVED WITH MASON COUNTY PLANNING, SHOULD HAVE
HAD MORE INSIGHT AND CONSIDERATION FOR THE REST OF US LAND-
OWNERS ON PINE ACRES WAY.
WE HAVE NOTHING PERSONAL AGAINST MR. AND MRS . WALTERS
AND HAVE NO OBJECTIONS TO THEM RESIDING ON PINE ACRES WAY
AS HOMEOWNERS BOUND BY THE SAME COVENANTS AND BILAWS AS THE
REST OF US ARE UNDER OBLIGATION TO KEEP ALSO.
WE HAVE HAD MANY INQUIRIES FROM PEOPLE DRIVING DOWN OUR
ROAD AS TO THE LOCATION OF THE NEW "WRECKING YARD" TO BE RUN
BY THE WALTERS ' MANY OF WHOM APPARENTLY KNOW AND OR WORKED
FOR THEM WHEN THEY LEASED THE AUTO WRECKING YARD FACILITY
FURTHER DOWN THE DAYTON AIRPORT ROAD TOWARDS THE CORRECTIONS
CENTER. ONE GENTLEMAN MADE THE COMMENT THAT THE WALTERS WILL
BE ABLE TO PUT QUITE A FEW CARS ON THEIR SIX ACRES OF PROPERTY !
WHEN ASKED HOW MANY CARS THAT HE WAS ABLE TO DISMANTLE IN A
DAY, THE REPLY WAS "EASILY AROUND 100" . HAS THERE EVER BEEN

IMPRESSION THAT PINE ACRES WAY IS FOR RESIDENTIAL USE ONLY,
AND MUST BE NOTIFIED OF THE INTENT OF A COMMERCIAL BUSINESS
WANTING TO GAIN ACCESS TO AND FROM PINE ACRES WAY VIA STATE 102 .
AEROCONTROLS GAINED THEIR OWN PRIVATE ACCESS TO 102 AND

ON THE PORT OF SHELTON PROPERTY WHICH THEY ARE LEASING, AND
WHERE PROPER CONDITIONS EXIST FOR THIS PROCEDURE OF DIS -
MANTLING THE AIRPLANE PARTS.
WE SINCERELY HOPE THAT OUR CONCERNS AND ARGUMENTS AGAINST
THE ESTABLISHMENT OF THE PROPOSED AUTO DISMANTLING WAREHOUSE
ARE TAKEN INTO EARNEST CONSIDERATION, AND THAT WE WERE ABLE TO
