Public Works has received and reviewed the materials relating to the Port of Shelton(Port)
development and grading activities located on the Port property at the northerly end of Sanderson
Field.
The field reports submitted by Mr. David Spiller, P.E., indicate that the majority of the grading is
complete and acceptable,but that the stormwater pond proposed in the plans is not intended to be
constructed until some later date. It appears that the Port may be exploring relocating the
stormwater plan to a different location. Relocation of the pond is an option which will be
reviewed if and when such a plan is delivered to the County for review and comments.
Attached please find a copy of a Performance Bond/Frozen Fund account the Port has delivered
to the County to provide for approval of the grading,though it has not actually been 100%
completed. The reports submitted by Mr. Spiller indicate that for the temporary time the Frozen
Fund account will be in effect, stormwater runoff will be accommodated in the undeveloped
areas of the construction area(s). Given the extent of the Port property, I do not see any potential
for stormwater runoff to leave the Port property and adversely impact any neighboring properties,
and recommend acceptance of the bond for the purpose of considering the grading complete..
Mr. William Tabor, the County Engineer has reviewed the Frozen Fund Account and signified
his acceptance with his signature. The original frozen fund document will be retained by Public
Works until the grading/stormwater pond is complete.
The Port should notify Public Works when the pond has been completed, at which time an
inspection will be performed by Public Works, and a letter releasing the frozen funds will be
dispensed.

Dear Ms. Griffey:
Attached are copies of my two visits to the site. In addition to the site visits, I have been
in contact with the contractor, survey crew and the Port of Shelton Capital Improvement
Staff throughout construction. Based on my site visits, contact with those involved, the
grade, surface drainage and infiltration system were constructed in general accordance
with the plans.
The only exception is the proposed storm pond located on the southern portion of the
site. Correspondence with the Port of Shelton, indicates that this portion of the project
will be constructed this summer.

With reference to the above-identified matter, this will certify that this institution has a savings account
(or loan) for the above-referenced owner/developer/contractor for the project so identified. In
consideration of the permitted improvement, and in lieu of a performance bond, this institution hereby
agrees that it will freeze the following sums of money for the indicated improvement pending written
authorization for release of said funds by the County of Mason in the amount
of$4,800.00 (four thousand eight hundred dollars and 00/100).
The total sum indicated will be withheld by this institution from any disbursements of any kind until
written authorization has been received by the institution for the County of Mason to release the sum of
money indicated by the written authorization from the County.
The design, location, materials and other specifications for the indicated improvement are those required
by the County of Mason as appears in the above-referenced document/permit, and shall be in
compliance with Mason County Title 16 and/or Ordinance No. 3-93, Accommodation of Utilities on
County Road Right-of-Way.
These funds shall be held by the institution for a period of 12 months/ 1 year(s). In the event the
Contractor does not comply to the aforementioned requirements, the County of Mason may demand,
and the institution shall make, payment to the County of Mason of said funds so that the necessary
repairs can be performed immediately to Mason County standards. The institution shall not be liable to
the owner for any disbursement of said funds to the County of Mason.

It is hereby specifically agreed by and between the parties hereto that in the event that any legal action
must be taken to enforce the provisions of this bond or to collect said bond, that the prevailing party
shall be entitled to collect its cost and reasonable attorneys'fees as a part of the reasonable costs of
securing the obligation hereunder. In the event of settlement or resolution of these issues, prior to the
filing of any suit, the actual costs incurred by the County, including reasonable attorneys'fees, shall be
considered a part of the obligation hereunder secured. Said costs and reasonable legal fees shall be
recoverable by the prevailing party, not only from the proceeds of this bond, but also over and above
said body as a part of any recovery in any judicial proceeding, in addition to recovery on the bond.

Erosion control fencing was installed per plan.
Contractor was rough grading site and installing underground utilities including storms stem. Jack pointed out two conflicts
On-site.
1 The existin2 under ground power was much shallower than originally anticipated. Fred Cool'said-that he had contacted the
PUD. The port and the-PUD were working on'a relocation of the existing power.,
2)The existing piping was found on the site in several locations. The pipes appeared to be parts of the old sewer and water
System installed by the air force. Fred directed the contractor to remove all portions found. The existing sewer was found in
Two locations centered on the proposed new road,and drive access for the back of the buildings.
The contractor had on site a bulldozer,vibrating compactor,and a'backhoe. In addition dump trucks were haulin2 material from

Soils on-site were consistent with other soils found in the larea. Very gravelly.

PRESENT AT SITE: Fred Cool, Port of Shelton
Project construction was complete for the grading portion of the project. No equipment was on site.
Fred and I met on-site to perform a punch list. The site appeared to be constructed to grade,except the future building pads and
the area around the existing building. We checked the drainage and grades around the existing building. A ditch had been
constructed on the south side of the building to direct runoff to the future building pads.
A small pile of construction debris had been piled up near the south entrance to the service area. Fred stated that the port
agreed to haul off the pile.
The top soil had not been placed and the site appeared not to have been seeded. Fred said that the port would be installing the
top soil and seeding the ditches per the plan. The top soil and seeding were not made part the contract with the contractor.
The storm ponds were also removed from the contract. The Port plans to construct the pond in the near future. I pointed out
that the service area will ultimately drain into the ponds. Fred explained that the port does not plan to pave the service area for
sometime. Fred asked if the area remains unpaved, could the construction of the ponds be delayed. I stated that the sub grade
could infiltrate the storm water, but the county expects a completed storm pond. Fred and l also discussed the possibility of
relocating the pond,the port is interested in moving the pond farther south and placing building in the area of the ponds.
