Critical Areas Report iii April 4,2022 INTRODUCTION Ecological Land Services, Inc. (ELS) was contracted by Kings Homes to complete a wetland delineation and ordinary high water determination for the property on Old Belfair Highway,Mason County Parcel Number 123174300070, within a portion of Section 17, Township 23 North, Range 1 West of the Willamette Meridian, in Belfair, Washington(figure 1). The property is within 200 feet of the Union River,which is a shoreline of the state.This report summarizes the findings of the wetland delineation according to the Mason County Code (MCC) Section 8.52.110 - Wetlands for delineation methodology,wetland categorization, and required buffer widths,which is incorporated into Chapter 17.50 Shoreline Master Program. METHODOLOGY WETLAND DELINEATION The wetland delineation followed the Routine Determination Method according to the U.S. Army Corps of Engineers, Wetland Delineation Manual (Environmental Laboratory 1987) and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Western Mountains, Valleys and Coast Region, Version 2.0 (U.S. Army Engineer Research and Development Center 2010). The Routine Determination Method examines three parameters—vegetation,soils,and hydrology— to determine if wetlands exist in a given area. Hydrology is critical in determining what is a wetland but is often difficult to assess because hydrologic conditions can change periodically(hourly, daily, or seasonally). Consequently,it is necessary to determine if hydrophytic vegetation and hydric soils are present, which would indicate that water is present for a long enough duration to support a wetland plant community. By definition,wetlands are those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands are regulated as "Waters of the United States" by the U.S. Army Corps of Engineers(USACE),as"Waters of the State"by the Washington Department of Ecology(Ecology), and locally by Mason County. To verify the wetland boundary onsite, ELS biologists collected data at six test plots on vegetation, hydrology,and soils(Appendix A). The site visit was conducted on January 28,2022,during which one onsite wetland(Wetland A)and two offsite wetlands(Offsite Wetlands 1 and 2)were identified. The boundary of the wetlands was delineated using consecutively numbered fluorescent flags labeled"WETLAND DELINEATION." The offsite wetlands were not flagged but their boundaries were determined using offsite delineation methodology to show them on the project figures. Wetland boundaries were determined through breaks in topography, changes in vegetation, and evidence of surface hydrology. OHWM DETERMINATION The ordinary high water mark (OHWM) of the two onsite streams was determined according to guidance from the Washington State Department of Ecology document,Determining the Ordinary High Water Mark for Shoreline Management Act Compliance in Washington State(Anderson et.al. 2016). The OHWM is defined as a mark "on all lakes, streams, and tidal waters . . .found by Kings Homes—Old Belfair HWY Ecological Land Services,Inc. Critical Areas Report 1 April 4,2022 examining the bed and banks and ascertaining where the presence and action of waters are so common and usual, and so long continued in all ordinary years, as to mark upon the soil a character distinct from that of the abutting upland, in respect to vegetation" (Anderson et. al. 2016). In essence, the OHWM is determined by assessing three main criteria: 1)the presence or evidence of hydrology, 2) the soil, substrate, and/or geomorphological changes, and 3) changes in vegetation. Indicators for each criterion differ depending on the environment (lake, stream, tidal). The main indicators used to discern the OHWM onsite were change in vegetation from salt tolerant vegetation to salt sensitive species,tidal channels,breaks in topography,and changes in soil and substrate. PROPERTY DESCRIPTION The 4.05-acre irregularly shaped property is located in Belfair,Mason County,Washington,east of Old Belfair Highway (Figure 1). Topography generally slopes down from north to south and west to east. The access to the property is located near the southwest corner and extends east from Old Belfair Highway (Figure 2). A garage is located near the mid-way point of the south property boundary and is the only development onsite (Photoplate 1). The rest of the property is vegetated with a mix of deciduous trees in the canopy and shrubs in the understory (Photoplates 1 and 2). Trash is scattered throughout the shrubs(Photoplate 1). Wetland A was identified onsite and makes up the north end of the property(Figure 2). Wetland A is a depressional wetland with a Type Ns stream that serves as an outlet (Photoplate 2). The Type Ns stream runs west to east along the southern wetland boundary and connects to the Type F stream that runs north to south near the east property boundary (Photoplate 2). The Type F stream flows offsite to the southeast and is a tributary of the Union River. The Union River is located offsite to the east(Figure 2). Two offsite wetlands,Offsite Wetland 1 and 2,were identified during the site visit. Offsite Wetland I is a depressional wetland located south of the property and outlets to the Union River. Offsite Wetland 2 is a slope wetland located west of Old Belfair Highway and outlets through a culvert onto the property(Figure 2). DEVELOPMENT PROPOSAL The property is zoned Rural Residential 5(RR5),allowing for one single-family home per five acres. The surrounding properties are zoned similarly and developed with single family homes.The project proposes to develop the property with a single-family residence and associated septic drainfield. The residence is proposed slightly north of the existing garage in the only feasible location onsite given the buffer and yard setback constraints(Figure 3)(Photoplate 1). In addition to developing a single-family home the project proposes to clean up the property by removing invasive Himalayan blackberry and the trash scattered around the property(Photoplate 1). VEGETATION WETLAND VEGETATION Wetland A is a forested system with a canopy dominated by red alder (Alnus rubra, FAC). The shrub layer was dominated by salmonberry (Rubus spectabilis, FAC), and Himalayan blackberry (Rubus armeniacus, FAC). Cover by emergent species was dense in some portions of the wetland Kings Homes—Old Belfair HWY Ecological Land Services,Inc. Critical Areas Report 2 April 4,2022 and sparse in others; this stratum was dominated by slough sedge (Carex obnupta, OBL), water parsley(Oenanthe sarmentosa,OBL)horsetail(Equisetum arvense,FAQ. Offsite Wetlands 1 and 2 were dominated by multi-layer forested communities including red alder, western red cedar in the canopy; salmonberry and Himalayan blackberry in the shrub layer and a sparse herbaceous layer that could not be identified through observations from the subject property. UPLAND VEGETATION The upland vegetation onsite consisted of mixed deciduous and coniferous forest dominated by red alder and western red cedar in the canopy; Himalayan blackberry dominating the shrub layer; and scattered sword fern(Polystichum munitum,FACU)and creeping buttercup in the herbaceous layer. The dominant vegetation found onsite is recorded on the attached wetland determination data forms (Appendix A).The indicator status,following the common and scientific names,indicates how likely a species is to be found in wetlands. Listed from most likely to least likely to be found in wetlands, the indicator status categories are: ■ OBL (obligate wetland)—Almost always occur in wetlands. ■ FACW(facultative wetland)—Usually occur in wetlands but may occur in non-wetlands. ■ FAC(facultative)—Occur in wetlands and non-wetlands. ■ FACU(facultative upland)—Usually occur in non-wetlands but may occur in wetlands. ■ UPL (obligate upland)—Almost never occur in wetlands. ■ NI(no indicator)—Status not yet determined. SOILS As referenced on the Natural Resources Conservation Service(NRCS 2022b)website,Belfast sandy loam, 0 to 3 percent slopes(BA),Norma silt loam, 0 to 3 percent slopes (Ne),and Saxon silt loam, 5 to 15 percent slopes(Sa),are mapped on the property(Figure 4). Belfast soils are deep,moderately well drained soils formed in alluvium with seasonally high water tables between November and March. Norma soils are deep,poorly drained soils formed in old alluvium with a high water table year round,particularly high between November and April. Norma soils are hydric. Saxon soils are deep, moderately well drained soils formed in glacio-lacustrine sediments and do not have a high water table. Neither Belfast or Saxon soils are classified as hydric(MRCS 2022a)I. WETLAND SOILS Soil data in Wetland A could not be collected because of the standing water throughout the wetland. When the shovel was placed into the soil below the standing water a hydrogen sulfide smell released meeting hydric soil indicator Hydrogen Sulfide (A4). Soil profiles were not observed in either of the offsite wetlands. UPLAND SOILS Test Plots 1, 2, 3, 5, and 6 were conducted in the upland. Test Plots 1 and 2 consisted of single- layer, l6 inch deep,profiles of very dark grayish brown(1 OYR 3/2)sandy loam. Test Plot 3 revealed r Areas mapped as hydric soils do not necessarily mean that an area is or is not a wetland—hydrology,hydrophytic vegetation,and hydric soils must all be present to classify an area as a wetland. Critical Areas Report 3 April 4,2022 a multilayer soil profile with dark brown(1 OYR 3/3) silt loam to 8 inches depth and dark yellowish brown (1 OYR 3/4) silt loam subsurface layer to 16 inches of depth with charcoal throughout. Test Plot 5 revealed a multilayer and mixed matrix soil profile. The surface layer was to 10 inches of depth and consisted of dark brown(1 OYR 3/3)silt loam. The subsurface layer consisted of a mixed matrix of 80 percent dark yellowish brown (10YR 4/3) silt loam, 15 percent gray (10YR 511) silt loam, and 5 percent yellow(I OYR 5/6) silt loam. Test Plot 6 revealed a multilayer soil profile with dark grayish brown(1 OYR 3/2)gravelly sandy loam to 6 inches of depth. The first subsurface layer to 14 inches of depth was dark brown (10YR 3/3) gravelly sandy loam and the second subsurface layer was grey (10YR 5/1) silty clay with 2 percent yellowish brown (7.5YR 5/6) redoximorphic concentrations. Test Plots 1, 2, 3, and 5 did not meet hydric soil indicators because their matrix chromas were too high. Test Plot 6 did not meet hydric soil indicators because the depleted layer began too deep in the soil profile. HYDROLOGY Wetland A is a depressional system with seasonally flooded, saturated only, and seasonally flowing stream hydroperiods. Hydrology was observed in Wetland A as standing water, saturation to the soil surface, and a high water table. The primary source of water for Wetland A is a seasonally high water table but it also receives water from direct precipitation and from discharge from the culvert on the west side(Figure 2). Water leaves Wetland A along the south boundary and southeast corner where it discharges through a Type Ns stream and then into the Type F stream. The wetland may also lose some water via evapotranspiration. Offsite Wetland 1 is a depressional system with a seasonally flooded hydroperiod and receives its water primarily through a seasonally high water table and direct precipitation. Water leaves the wetland through an intermittently flowing outlet to the southeast and into the Union River. Offsite Wetland 2 is a slope system with a saturated only hydroperiod. The primary source of hydrology to Offsite Wetland 2 is groundwater discharge and direct precipitation. Water leaves Offsite Wetland 2 through a culvert at the east end and flows under Old Belfair Highway and into Wetland A. Water also leaves through evapotranspiration. Two streams were identified onsite. A Type Ns stream flows west to east along the south boundary of Wetland A and serves as an outlet for Wetland A. The stream flows east into the Type F stream which flows north to south across the property. The Type F stream flows offsite to the southeast and empties into the Union River. CRITICAL AREAS INVENTORY NATIONAL WETLANDS INVENTORY The National Wetland Inventory (NWI) maps a riverine wetland (R3UBH) offsite to the east and crossing the property at the southeast corner and a freshwater forested/shrub(PSSC)wetland offsite to the west(Figure 5)(USFWS 2022). The NWI does not map Wetland A. ELS biologists identified a Type F stream onsite in a similar orientation to the NWI mapped riverine wetland. The NWI does z The NWI and MC maps should be used with discretion because they are used to gather general wetland information about a regional area and therefore are limited in accuracy for smaller areas because of their large scale. Critical Areas Report 4 April 4,2022 not map Offsite Wetland 1, but ELS biologists identified Offsite Wetland 2 where the freshwater forested/shrub wetland was mapped. MASON COUNTY CRITICAL AREAS MAP The Mason County Critical Areas map (MC 2022)is based on the NRCS hydric soils map and the NWI map. The MC map identifies FEMA floodplain, the NWI mapped wetlands, and the Union River,offsite to the east(Figure 6). MC does not map Wetland A. ELS did not directly observe the Union River east of the property,but it appears to be present based on contour mapping. CONCLUSIONS WETLAND CATEGORIZATION Wetland A and Offsite Wetlands 1 and 2 were rated by functions according to Washington State Wetlands Rating System for Western Washington-2014 Update (Rating System) (Hruby 2014, Appendix B). Wetland A is Category II forested with three layers depressional system with seasonally flooded, saturated only,and seasonally flowing stream hydroperiods. Offsite Wetland 1 is a Category H forested with three layers, depressional system with a seasonally flooded hydroperiod. Offsite Wetland 2 is a Category III forested, forested with three layers slope system with a saturated only hydroperiod. The ratings are shown in Table 1. WETLAND AND SHORELINE BUFFER REGULATIONS The MCC Chapter 8.52.1 10(E)(2)specifies wetland buffers based on wetland category and proposed land-use intensity. Wetland A and Mite Wetland 1 are Category II wetlands, and the proposed land use is moderate,resulting in 110-foot buffers (Table 8.52.110(D)) for each. Offsite Wetland 2 is a Category III wetland with a 110-foot buffer. The buffer for Offsite Wetland 2 is functionally isolated at Old Belfair Highway and does not extend onsite(Figure 2). The property is within 200 feet of the Union River,which is a shoreline of the state. The shoreline designation for this area is Shoreline Residential(Figure 6),which requires 150-foot buffer from the OHWM per MCC Table 17.50.110 A (Figure 2). Critical Areas Report 5 April 4,2022 feet and the stream buffer for the Type Ns stream is 75 feet(Figure 2). A structural setback line of 15 feet is required from the edge of the wetland, stream,and shoreline buffers. Should buffer reductions be required to construct the proposed residence=,the MCC Chapter 8.52.110(E)(2)(c) allows for wetland buffer averaging,whereby the buffer is reduced in one location and the same area added in another location. Buffer averaging is allowed if there are no other feasible alternatives for reasonable use of the properties and if the proposed buffer modification will not degrade the wetlands' functions. Additionally, the total buffer areas must be equal to the area of the standard buffer before averaging. The narrowest point of the buffer cannot be below three-fourths of the required standard buffer width. A Mason Environmental Permit Application is required to utilize buffer averaging. If buffer averaging does not provide buildable area, a variance or RUE may be required(see the section below). Shoreline The property is within 200 feet of the Union River,which is a shoreline of the state. The shoreline designation for this area is Shoreline Residential (Figure 6), which requires a 150-foot buffer from the OHWM plus a 15-foot structural setback for freshwater streams(Figure 2). The shoreline buffer extends west across the majority of the property. The shoreline buffer may be reduced via the RUE process(described below). Reasonable Use Exception If there is not enough buildable area for a single-family home on the property outside of the shoreline and wetland buffers, the applicant may proceed through the variance or reasonable use exception (RUE)process. The applicant must demonstrate that the variance criteria in MCC 15.09.057 are met and mitigation will be required to ensure no net loss of functions for the wetland. The RUE process typically requires a public hearing and comment period, however, depending on the proposal some applications may be reviewed administratively. It is highly recommended that early communication is established with the county if it does not appear there is a buildable area outside of the buffers and setbacks. The county will also require a habitat management plan for shoreline or wetland buffer reductions. 3 Offsite Wetland 2's buffer is functionally isolated at Old Belfair Highway and does not extend onsite.
