The Washington State Shoreline Management Act (RCW 90.58) requires that substantial developments within designated
shorelines of the state comply with its administrative procedures (WAC 173-14) and the provisions of the Mason County
Shoreline Management Master Program. The purpose of this Act and local program is to protect the state's shoreline
resources. The program requires that substantial development (any development of which the total cost or fair market
value exceeds $7,047.00 or materially interferes with the normal public use of the water or shorelines of the State be
reviewed with the goals, polices, and performance standards established in the Master Program.
Answer all questions completely. Attach any additional information that may further describe the proposed development.
Incomplete applications will be returned.
*Shoreline Variances and Conditional uses require public hearings and have additional pages that shall be

Reason for requesting development:
This dock project will provide access to opportunities for the enjoyment of water dependent
activities such as fishing, swimming, boating.
The applicant shall provide, at a minimum, the following information:
a. SITE PLAN -drawn to scale and including:
i. The boundary of the parcel(s)of land upon which the development is proposed;
ii. The ordinary high water mark (OHWM). This may be an approximate location provided, that for
any development where a determination of consistency with the applicable regulations requires a
precise location of the OHWM the mark shall be located precisely and the biological and
hydrological basis for the location as indicated on the plans shall be included in the development
plan. Where the OHWM is neither adjacent to or within the boundary of the project, the plan shall
indicate the distance and direction to the nearest OHWM of a shoreline;
iii. Where appropriate, the proposed land contours using five-foot intervals in water area and ten-foot
intervals on areas landward of OHWM, if development involves grading, cutting, filling, or other
alteration of land contours;
iv. The dimensions and location of existing structures which will be maintained;
V. The dimensions and locations of proposed structures; parking and landscaping;
vi. The location of proposed utilities, such as sewer, septic tanks and drain fields, water, gas and
electricity;
vii. The location, source, composition, and volume of fill material;
viii. The location, composition and volume of any extracted materials, and proposed disposal area;
b. CROSS SECTION, drawn to scale including:
i. The existing ground elevations;
ii. The proposed ground elevations;
iii. The location and height of existing structures;
iv. The location and height of proposed structures;
V. The OHWM.
c. VICINITY MAP, including:
i. The location of subject parcel using natural points of reference (roads, state highways, prominent
landmarks, etc.).
ii. If the development involves the removal of any soils by dredging or otherwise, identify the
proposed disposal site on the map. If disposal site is beyond the confines of the vicinity map,
provide another vicinity map showing the precise location of the disposal site and its distance to
nearest city or town.
iii. On the map, or separately, give a brief narrative description of the vicinity of the proposed project
including identification of the adjacent uses, structures and improvements, intensity of
development and physical characteristics.
d. ADJACENT LANDOWNERS. Provide names and mailing addresses of all real property owners
within 300 feet of property line boundaries where development is proposed as mailing labels or
pre-addressed envelopes.

As one of the closest neighbors to Mr. Ratterree and Mr. Morris, we are writing this letter in
support of their application to build a joint use dock.
We have lived at this address since 1996 and we do not believe that the dock will interfere or
impact any water sports of others. Also, we are all affected by the NoWake Buoy in front of our
homes.

GROUNDS FOR APPEAL:
The position and length of the proposed dock will create a significant hazard to recreational boating
activities in Fair Harbor. The tip of the proposed dock extends 130 feet into the bay and approximately
85 yards from the "NO WAKE ZONE" buoy that is positioned just north of the Stretch Island Bridge as the
bay constricts in size going south. Recreational boating consists of water skiing and tubing as just two
examples where power boats are pulling participants behind their boat with tow ropes averaging
approximately 75 feet in length. As boaters are turning prior to the NO WAKE ZONE the position of this
proposed dock will make it very difficult to make the turn and presents the possibility of catastrophic
harm to the participants.
It is important to note that there are no other permanent docks in the entire Fair Harbor Bay positioned
south of Fair Harbor Marina. This bay is one of the most active recreational bays in the entire South
Sound. The shoreline is marked by moorage buoys throughout the bay. These buoys do not represent
any hazards to recreational activities. The addition of a permanent dock within the bay will create a
change of behavior for boaters. It will also create the necessity for kayakers, paddle boaters, and all
other non-motorized water craft to be pushed out in the main power boat lanes of the bay in order to
pass this permanent dock at many tide levels.
In summary,the approval of this dock will create the following:
• Boating Hazard at the SW corner of the bay where the NO WAKE ZONE buoy exists
• Creating hazards where none exist today for kayakers and paddle boaters who will be pushed
out into the main boating lanes where today they enjoy the tranquility of the shoreline.
• The proposed dock will in essence shrink the available recreational waters of Fair Harbor by
forcing recreational boating activities to the NE and away from the SW corner.
• Lastly,the approval and build out of this proposed dock will set a precedent for future permits
changing the activities in the bay forever.
SUSTAINING STATEMENT:
An Administrative Shoreline Substantial Development Permit should not be granted where the impacts
are both hazardous to the community and force change to activities and habits that have been enjoyed
and relied on for decades.
RELIEF SOUGHT:
Both Applicants, Mr Morris and Mr Ratterree, currently have moorage buoys for their perspective boats
as others do within the bay. There will be no negative impacts to either party by the reversal of this
decision. There is also the Fair Harbor Marina where many homeowners in and around the bay moor
there boats if that is preferred. So options are abundant for the applicants to have access to their boats.
We therefore request the reversal of this application and deny the permit for the permanent dock
system as proposed.

Notice is hereby given that Marc Morris and Gary Ratterree, who is the applicant for the above
referenced Shoreline Substantial Development request, has been granted the Permit. The request was
approved pursuant to the Mason County Shoreline Master Program, specifically for the construction of a
new joint use dock on Case Inlet. The dock comprises of a pier measuring 61 feet long by 6 feet wide, a
ramp 40 feet long by 3 feet wide, and float, 30 feet long by 8 feet wide. The new project exceeds
$11,200 fair market value allowed for exemption for new residential docks, thus requiring Shoreline
Substantial Development Permit.
A SEPA DNS was issued on November 9, 2022, with a comment period extending to November 23, 2022.
There is a 14-day appeal period following the issuance date of said decision. Timely appeals shall be filed
with the Mason County Planning Department, Attn:Julie Lewis, 615 W. Alder Street, Shelton, WA 98584,
by May 30, 2023 @ 4:30 p.m., in accordance with the requirements stipulated in MCC 15.09 and 15.11.
There is a concurrent 21-day appeal period with the Department of Ecology.Timely appeals shall be filed
with Washington State Shoreline Hearings Board as governed by Chapter 90.58 RCW by June 6, 2023.
Time Limit for Action. Per the Mason County Code 17.50 -Shoreline Master Program - No permit
authorizing construction shall extend for a term of more than five years. If actual construction of a
development for which a permit has been granted has not begun within two years after the approval,
the administrator shall review the permit and upon a showing of good cause, may extend the initial two-
year period by permit for one year. Otherwise, the permit terminates; PROVIDED that no permit shall be
extended unless the applicant has requested such review and extension before the administrator PRIOR
to the expiration date.
