Sincerely, Eli Asher Habitat Restoration Project Manager enclosures TO BE KEPT IN THE PARCEL FILE Application for Streamlined Process for FISH HABITAT ENHANCEMENT PROJECTS Addition to the Joint Aquatic Permit Application Form (JARPA) Under recent laws,you may qualify for a streamlined permit process with no fees,if your project is designed to enhance fish habitat. If your project meets the requirements below,you are entitled to the streamlined Hydraulic Project Approval(HPA) process,exemption from the State Environmental Policy Act,and exemption from all local government permits and fees. To apply for the exemption process,the applicant must provide on the same day,the JARPA form and this cover addition to: the Department of Fish and Wildlife(WDFW)and all applicable Local Government planning and permitting departments. Local governments have 15-days to provide comments to WDFW,who will use these comments to aid them in making decisions(see below for details). Residents use the spit for temporary storage of small boats, beach walks, clam digging, and wildlife viewing. b) No permanent structures exist on the spit. A causeway (likely created from native beach material) leads from a gated access road to the northern portion of the spit. Some riprap from the former tidal weir still remains in the eroded mid-section of the spit, but serves no beneficial purpose at this point. c) The spit is an historic barrier spit partially impounding a saltwater lagoon. Feeder bluffs and beaches up-drift supply sediment to the spit, but the construction of the causeway and later failure of the tidal weir constructed to maintain low-tide elevation of the lagoon has interrupted sediment supply to the spit, creating a large gap in the spit. The lagoon likely provides excellent non-natal rearing habitat for Chinook and other salmon, and feeding areas for cutthroat trout and other marine fishes. Project completion will increase the amount of this habitat by restoring the full length of the barrier spit, and remove the causeway that currently is a fish passage barrier. The substrate surrounding the spit supports a variety of shellfish, including Manila clams, native littleneck clams, cockles, horse clams, mussels, Olympia oysters, and Pacific oysters. Sand dollars and geoducks are abundant seaward of the project area, but populations are not expected to be directly impacted by the project. Rock and shore crabs are common. Terrestrial wildlife populations are typical of South Puget Sound, including shorebirds, raptors, raccoons, coyotes, etc. The spit is sparsely vegetated above ordinary high water with pickleweed, silver burweed, gumweed, and beach grasses. The shorelines opposite the spit are developed as residential lots; the slopes in the area appear relatively stable and are forested with bigleaf maple, Douglas fir, western hemlock, and western redcedar. The understory is dominated by evergreen huckleberry, salmonberry, sword fern, and salal. Is the property agricultural land? ❑ YES E] NO M Are you a USDA program participant? ❑ YES 0 NO IM 7a. Proposed work that requires aquatic permits includes the removal of the causeway to restore the historic channel that allows seawater to fill and drain the lagoon and provide fish passage to and from Case Inlet, fill and reshaping of the gap in the spit caused by the failed tidal weir, placement of concrete block mattress material for foot traffic to mitigate the community's shoreline access lost by removing the causeway, shaping the cut and fill areas to match natural conditions, and replanting disturbed and filled areas with native salt-tolerant plants. Onsite construction will involve heavy machinery: causeway removal will be conducted with tracked excavators; material movement from cut areas to fill areas will be conducted with front-end loaders, excavators, or Morooka- style tracked vehicles; material grading will be conducted with bulldozers, excavators, or front-end loaders. Concrete block slope stabilization mats will be placed with a crane or excavator. Construction activities will be timed to maximize working hours during low tides within the allowable fish window; no significant construction phasing is planned. Replanting of disturbed and fill areas will be conducted during fall to ensure high plant survival, and SPSSEG will coordinate local volunteer watering crews to maintain plantings to ensure 80% survival and eventual natural propagation. Access to the site is provided by a gated upland access road. Equipment will be staged on this road (well above ordinary high water) and in a cleared area on the shoulder of Lombard Road when not in use. Please explain any specific needs that have influenced the design. One-Stop-DARPA Beta Test ver.1.5.20060620.1700 2 Restoring pocket estuaries, barrier beaches, and tidal lagoons is a high priority for overall Puget Sound nearshore habitat restoration. Removing the causeway will restore fish passage through the north end of the lagoon that was blocked by the road. Restoring the spit to its historic function will enlarge the lagoon, part of which has been cut off by the causeway, and part of which has filled with fine sediment because of reduced tidal flushing through the north end of the lagoon. Four other options were considered for repairing the damage to the spit: 1) cutting a narrow channel through the causeway and importing fill for repairing the washed out midsection of the spit; 2) constructing a tidal culvert under the causeway and importing fill to repair the washed out midsection; 3) no action, which would probably restore the spit over the course of several decades (assuming continued sediment input to the south), but would be unacceptable to community members and would delay salmon recovery; and 4) removing the causeway and filling the midsection of the spit, and then building a bridge from the shoreline access road to the spit. These options were dismissed because of high cost (options 1, 2, and 4), low certainty of success (options 2 and 3), low or slow restoration value (options 1, 2, and 3), and community interest in maintaining a stable barrier beach to protect shoreline properties from winter storms (option 3). One option that was not considered was rebuilding the tidal weir that precipitated this problem in the first place. In the late 1970s, a similar problem arose, and while the community was advised by a consulting engineer that the tidal weir was unsustainable, the weir was rebuilt and the causeway was maintained. This option will not serve the community in the long term, and further degrades nearshore habitat. m 7c. Describe the potential impacts to characteristic uses of the water body. These uses may include fish and aquatic life,water quality, water supply, recreation and aesthetics. Identify proposed actions to avoid, minimize, and mitigate detrimental impacts and provide proper protection of fish and aquatic life. Identify which guidance documents you have used. Attach a separate sheet if additional space is needed. This project will restore historic fish usage to the Pirate's Cove lagoon and allow natural processes to sustain the spit and lagoon throat and mouth. Community residents have reported lagoon use by adult salmon staging for spawning and sea-run cutthroat or juvenile salmon foraging. Based on nearshore surveys and studies throughout the South Puget Sound region, it is reasonable to assume that the lagoon provides high quality habitat for Chinook and other salmon species that rely on nearshore environments outside their natal streams for juvenile rearing. The lagoon and outer beach provide good to excellent habitat for several clam species, as well as Olympia and some Pacific oysters. Brady Blake, WDFW shellfish biologist, visited the site and predicted that overall, habitat quantity would be increased for Manila, native littleneck, and horse clams, and Olympia oysters. Species distribution will be changed, however, since productive clam beds in the breached spit will be covered by fill during restoration work. This will likely be mitigated by a contract harvest of clams, with market sized clams being sold and undersized clams relocated to other suitable habitat within the community's property to jump-start populations in substrate uncovered by the road removal. The Pirate's Cove community has used the lagoon for decades for swimming, boating, wildlife viewing, and shellfish harvest. Restoring the spit to its original configuration will increase the area of the lagoon during mid- to high tides, and should not interfere with small craft navigation other than creating a longer path from outside waters to the lagoon. Community members currently launch small car-top boats, canoes, and kayaks from the spit accessed by the causeway, and this access would be lost if not mitigated as part of the construction plan. The project engineer has proposed a gently sloped (7 to 1) access path lined with concrete block-mats that allow water percolation without significant sediment transfer interference. This would stabilize a strip of beach to allow foot traffic to the throat of the lagoon at low tide and provide a stabile pathway from which to launce hand-carried small craft at higher tides. L7 7d.
