document,please reply to the email this document was attached to with the following: "I have
received Ecology's variance decision via email. This email serves as my response that I am the addressee
or their agent, and that the decision has been received and certified mail is not requested."
This letter is in response to your variance request dated January 28,2021 from Knapp Drilling Inc.,
concerning the construction of a water well at the address, listed above. You are requesting a variance to
the Minimum Standards for the Construction and Maintenance of Wells,Chapter 173-160 WAC.
Specifically,your request is to construct a water well less than 100 feet from drainfield on the
neighboring property. Based on additional site information provided,the well site is approximately 80
feet(down gradient)from your neighbors existing drainfield. Most water wells in the area are most likely
completed within the Vashon glacial advanced aquifer, beneath the Vashon glacial till (confining layer).
This variance request is necessary due to the location of the well and the limited land area available to be
developed.
After an investigation,interview,and review of information available,a variance is hereby granted to
Chapter 173-160-171 (3)(b)(iv) WAC. This variance is granted under the following conditions:
1. Well construction must start within 1 year of this variance.
2. Well construction must comply with Mason County rules and regulations.
3. All well construction shall be performed by a licensed driller as set forth by Chapter 173-162
WAC and Revised Code of Washington(RCW) 18.104
4. A notice of intent to construct a water well must be filed and the fee paid at least 72 hours before
starting construction(in accordance with Chapter 173-160-151 WAC).
5. Due to the close proximity of drainfields and potential sources of contamination the surface seal
shall extend continuously from 36 feet deep [or at least six feet into a confining formation,
whichever is deeper]to land surface. A confining formation means a six foot or greater layer of

low hydraulic conductivity material that significantly limits vertical movement of groundwater.
The seal shall provide casing stability and have a minimum diameter of four inches larger than
the nominal size of the permanent casing. During the installation of the surface seal the driller
must use a temporary casing,at least 4-inches larger in diameter than the permanent well casing
diameter.Temporary casing should extend the entire length of the surface seal prior to installation
of any sealing product. Open-hole drilling of the surface seal and sealing without a temporary
surface casing IS NOT APPROVED.
6. As long as condition 5 is met above,the well may be completed within the water bearing
formation beneath the glacial till that produces enough water for the residence.No other
openings in the casing, except a pitless-style adapter, installed as recommended by the
manufacturer, shall be shallower than completed well depth.
7. Bentonite for the surface seal must be installed as required in Chapter 173-160-231 (2)and(3)
WAC.The recent changes to Section-231 require the following: "The annular space must be kept
at least one-half full of sealing material whenever the production casing is advanced."
8. It is also required(per RCW 90.48- Water Pollution Control)to prevent drill cuttings or sealing
material from entering Nahwatzel Lake.
9. The driller must submit a Water Well Report describing the construction to Ecology(Southwest
Regional office)within 30 days after completion of the work. Attach a copy of this variance to
the well report.The well location must be included in decimal degrees(to the 5'h decimal place).
10. The driller must inform Ecology(John Pearch, 360-407-0297)two business days before any well
construction or decommissioning work begins.The driller must make the site accessible to Mr.
Pearch to inspect any and/or all well construction or decommissioning work.
11. The driller must inform Mason County(Wendy Matthews,360-427-9670 ext. 584)
24 hours before any well construction work begins. The driller must make the site accessible to
Mason County to inspect any and/or all well construction work.
12. With the exception of the provisions set forth(above)in this variance,all federal,state,and local
requirements shall apply.
YOUR RIGHT TO APPEAL
You have a right to appeal this variance to the Pollution Control Hearing Board(PCHB)within 30 days
of the date of receipt of this variance. The appeal process is governed by Chapter 43.21 B RCW and
Chapter 371-08 WAC. "Date of receipt" is defined in RCW 43.21 B.001(2).
To appeal you must do the following within 30 days of the date of receipt of this variance:
• File your appeal and a copy of variance with the PCHB(see addresses below). Filing means
actual receipt by the PCHB during regular business hours.
• Serve a copy of your appeal and this variance on Ecology in paper form -by mail or in person.
(See addresses below.) E-mail is not accepted.
You must also comply with other applicable requirements in Chapter 43.21 B RCW and Chapter 371-08
WAC.

WAC173-160-106(1) allows you to request a variance from the Department of Ecology when
strict compliance with state well construction standards is impractical. The variance request must propose
comparable alternative specifications that will provide equal or greater human health and resource
protection than the minimum standards. You must apply for a variance in writing and receive approval
before constructing or decommissioning the well. (All fields must be completed.)

It is only 80 feet away,therefor we are requesting a variance for this project.
I have attached a site map for the property in question and the one next door that impedes the project.
Describe the alternative construction method that will provide equal or greater protections than those

We would put in a 30 bentonite surface seal,there is an aprox 40-50,seam of till and we would like to leave 10'exposed.
We drilled 331 Nahwatzel witch is nearby , I have attached this well log
