In order for Ecology to confirm you received this document, please reply to the email this document was attached to with the following: "I have received Ecology's variance decision via email. This email serves as my response that I am the addressee or their agent, and that the decision has been received and certified mail is not requested." This letter is in response to your request for a variance (dated July 2, 2022) from Davis Drilling concerning the construction of a well located at 11033 NE North Shore Dr, in Mason County. You are requesting a variance to the Minimum Standards for the Construction and Maintenance of Wells, Chapter 173-160 WAC. Specifically, your request is to construct a water well that is located less than 100 feet, (approximately 65 feet) from saltwater (Hood Canal). It was also determined that proposed well site B is greater than 100 feet from your septic drainiield and the neighboring drainfield. Thus, this variance does not allow proposed well site A in your variance request. This variance request is necessary due to the location of drainfields on your property and roadways, driveways, buildings, and the limited land area available to be developed. After an investigation, interview and review of information available, a variance is hereby granted to Chapter 173-160 WAC. Ecology will allow the well to be constructed as soon as workers and equipment are available and using the method you have proposed. This variance is granted under the following conditions: 1. This variance is only valid for a period of 1 year after the date of mailing from Ecology. 2. A notice of intent to construct a water well must be filed and the fee paid in accordance with Section 173-160-151. 3. Well construction must comply with Mason County rules and regulations. 4. Due to the close proximity to saltwater, the surface seal shall extend continuously from 30 feet deep to land surface. The seal shall provide casing stability and have a minimum diameter of four inches larger than the nominal size of the permanent casing. During the installation of the surface seal, the driller must use a temporary casing, at least 4-inches larger in diameter than the permanent well casing diameter. Temporary casing should extend the entire length of the surface seal prior to installation of any sealing product. Open-hole drilling in an unconsolidated formation without a tem! orary surface casing IS NOT APPROVED. 5. The well shall have no other openings in the casing, except a pitless-style adapter, installed as recommended by the manufacture and shall be shallower than the completed casing well depth. This completed casing well depth is up to the driller to determine based on the formation that supplies usable water that is not subjact to saltwater intrusion. The driller must use chloride field test strips to determinw c:iloride levels while drilling. 6. If chloride field test strips are greater than 1500 mg/L in the upper 30 feet, neat cement must be used to seal off any saltwater bearing formation. 7. The well water must be sampled upon completion of the well and sent to an _culogy accredited lab for chloride analysis. 8. Surface seal must be installed as required in Chapter 173-160-231 (2) and (3). The recent changes to Section -231 require the following: "The annular space must be kept at least one-half full of sealing material whenever the production casing is advanced." 9. Due to the close proximity of North Shore Road, the well must be protected using the existing jersey barriers to protect from vehicular damage. 10. The driller must submit Water Well Reports describing the construction of the well to Ecology (Southwest Regional office) within 30 days after completion of the work, one report per well constructed. The well location latitude/longitude coordinates must be included in decimal degrees (to the 5th decimal place) along with the Public Land Survey System location on the well report. Attach a copy of this variance with the well report. t.t 11. With the exception of the provisions set forth (above) in this variance, all federal, state, and local requirements shall apply. 12. The driller must inform Ecology (John Pearch, 360-407-0297) two business days before any construction work or surface seal installation begins. The driller must make th' site accessible to Mr. Pearch to inspect any and/or all construction work. 13. The driller must inform Mason County (Wendy Matthews, 360-427-9670) two business days before any construction work or surface seal installation begins. The driller must make the site accessible to Mason County to inspect any and/or all construction w ork. YOUR RIGHT TO APPEA You have a right to appeal this variance to the Pollution Control Hearing Board (PCHB) within 30 days of the date of receipt of this variance. The appeal process is governed by Chapter 43.21E RCW and Chapter 371-08 WAC. "Date of receipt" is defined in RCW 43.21B.001(2). To appeal you must do the following within 30 days of the date of receipt of this varlarwe: • File your appeal and a copy of variance with the PCHB (see addresses below). Filing means actual receipt by the PCHB during regular business hours. • Serve a copy of your appeal and this variance on Ecology in paper form - by mail or in person. (See addresses below.) E-mail is not accepted. You must also comply with other applicable requirements in Chapter 43.21E RCW and Chapter 371-08 WAC.
