FINDINGS FOR
MASON ENVIRONMENTAL PERMIT

PROPOSED ACTION: David and Nancy Bayley
Constructior of thirteen duplexes (twenty-six dwelling
units) , recreation hall, septic systems, parking, and
water syste on 6 . 78 acre lot on Island Lake Road.
DEPARTMENT OF COMMUNITY DEVELOPMENT:
a) Thirteen new 'duplex buildings (twenty-six dwelling
units) and a recreation hall are now proposed, i.-.iong with the
five community septic drainfields for these residences . A water
system of four community wells will provide the water supply to
the residences proposed.
b) Fifty-two pa king spaces are proposed for the twenty-six
new residential units,) as well as a loop road that would provide
residents and emergency vehicles access to the duplex buildings .
c) Due to the number of duplexes proposed and the location
of the project in a critical aquifer recharge area, a SEPA
environmental checklist public review was completed for the
proposed project . The 15-day review occurred from July 28, 1995
to August 14, 1995, and it considered the full scope of
development on the property (twenty-six residences, recreation
hall, wells, and septic systems) . Comments were received from
the Washington Department of Ecology, the City of Shelton
Planning Department, Shelton School District, and four citizens .
DEPARTMENT OF PUBLIC RKS :
The County Hydraulics Engineer views this duplex development as
similar to commercial 'development and emphasizes the need to
treat the stormwater runoff on site. The applicant has submitted
a storm drainage control plan to present the tei,,iporary-permanent
measures that control erosion and treat surface runoff in
vegetated ditches and !ltwo retention ponds . Temporary erosion-
sediment control should be in place during the construction of
the roads, parking are Zs, and structures (see MEP conditions) .

DEPARTMENT OF HEALTH (ENVIRONMENTAL HEALTH) :
Septic permit cases ( ' o. SWG94-0981 to -0984 and SWG94-2035) have
been evaluated throug a Method 2 Analysis (a state and local
health standard) to d termine the minimum gross area requirements
for sewage treatment . The analysis uses various site factors
(soil type, area geology and topography, impacts to water
quality, and land use' ) to show that the property has adequate
area with proper soi13 to retain and treat sewage effluent on-
site. The design inc Ludes a community drainfield for each group
of three duplexes on he property, and each community system will
comply with the enhan ed drainfield design standard for septic
systems in an aquifer recharge area (sand lined trenches and
pressure distribution' of effluent) .
Four Group B wells, each serving four residences, are proposed
but the review of the wells is not completed until the applicant
submits necessary information to the county. When the review is
completed, adequate water supply to each duplex shall be assured.
FIRE MARSHALL:
He has worked with the applicant to utilize a new access road, 20
feet wide and in a looped alignment, that crosses through the
center of the property. The applicant has proposed the
installation of two fire hydrants adjacent to the access road,
subject to the approval of the Fire Marshall . The applicant will
be required by the Fire Marshall to provide a public water system
capable of a certain flow rate, duration, and pressure prior to
combustible construction.
COUNTY BUILDING OFFICIAL:
Review of the building specifications has deterr:'.ned that they
conform with building, energy, and fire codes of the county.
The applicant shall file required building permits for structures
and for perimeter fencing over six feet in height . Compliance
with adequate building setbacks from existing structures and
property lines will be part of the building inspection process .
OTHER COMMENTS :
The City of Shelton Planning Department commented that a) the
project should have available a water system equal to City
standards and an unconnected sewer line installed in front of the
proposed structures; and b) traffic impacts may be higher than
stated (those typical of residential rather than a retirement
community) and merit that the road be built to County standards
and subject to regular maintenance. Washington Department of
Ecology commented on wells and water rights, erosion control and
stormwater management '' and solid waste issues related to the
development of 26 res dences. Shelton School District stated
potential demands on he school district and requested that the
developer meet to dis uss mitigation measures for the project .
Three citizens commented on the potential impacts of residential
use, drainfields, and traffic on the local aquifer recharge area
and that these issues be addressed. One citizen requested that
the County require the applicant to include the standard of
senior housing as a covenant to the proposed development.
CONCLUSIONS :
Based upon the above comments, this Department finds that the
proposed construction ' of thirteen duplexes (twenty-six dwelling
units) and recreation ,building will be located to lessen
potential impacts to the community and to the critical aquifer in
the area of the subject property. This conclusion is based upon
the applicant accomplishing the following project elements
(listed as conditions to this Mason Environmental Permit) :
a) the proposed community septic systems effectively treat
the anticipated volumes of effluent;
b) the measures for temporary and permanent erosion-sediment
control and infiltration of stormwater runoff address potential
impacts to surface and ground waters of the aquifer area;
c) a community water system is available for adequate water
supply and fire protection;
d) perimeter fencing is provided to serve as a visual buffer
to adjacent properties; and
e) the potential impacts to the school district are
addressed by the applicant .
On this date Mason Environmental Permit RLC95-0664 (MEP) is
approved with the attached conditions .

THIRTEEN 'DUPLEXES PROPOSAL - LAKE PARR
DAVID AND NANCY BAYLEY
1) As approved by the Mason County Health Department, the
applicant shall have i4stalled enhanced septic systems for the
proposed dwelling units in order to provide adequate effluent
treatment that does not impact the critical aquifer recharge
area. The community drainfield systems (each having 4 to 6
dwelling units) shall be designed to utilize pressure distri-
bution and two feet of sand augmentation in drainfield laterals.
2) In accordance with Washington State Bill E2SSB 5448 (1995) and
per discussions with Mason County Department of Health, the
applicant shall have the four proposed Group B wells approved by
Mason County Department of Health, and the water system of these
wells shall be owned and maintained by an approved satellite
management agency (an independent water purveyor) .
3) During the construction of roads, parking areas, and
buildings, the applicant shall implement the temporary and
permanent erosion and stormwater control methods presented in the
drainage control plan for this development proposal, as approved
by the Mason County Department of Public Works . Site grading
shall comply with Mason County Building Code standards . Roof
runoff shall be controlled by guttering to specified areas
located on the property and away from the septic drainfields .
Road and parking area runoff shall be kept on the property,
pretreated by routing to grass-lined swales or ditches adjacent
to the new road, and infiltrated into the soil .
4) The applicant shall provide only one access point to and from
Island Lake Road to serve the entire proposed development .
5) The applicant shall maintain the proposed 40-foot wide access
road through the development for use by emergency vehicles and by
residents of the development . If this access road will be a
county-maintained road, it shall meet county road standards .
6) The applicant shall provide a public water system capable of
delivering a fire flow of 500 gallons per minute for 30 minutes,
at 20 psi residual pressure . The storage capacity for fire flow
(15, 000 gallons) must be in addition to the maximum daily
domestic demand (MDD) . Hydrant locations to be approved by the
Mason County Fire Marshall . The water system must be in place
and serviceable prior to the start of any combustible
construction.
7) To comply with the Mason County Parking Ordinance, the
applicant shall provide two parking spaces per dwelling unit, or
4 spaces per duplex building, for a minimum of 52 spaces in the
development; other parking areas may be included but will need to
comply with standards in the drainage control plan for the
development and be approved by Mason County Department of
Community Development .
9) The applicant shall install perimeter fencing, as proposed,
along the exterior property lines and entrance to serve as a
visual buffer to adjacent properties . The applicant shall obtain
a county building permit for fencing over 6 feet in height .
10) The applicant shall include the following covenant in the
Declaration of Protective Covenants recorded with the Mason
County Auditor: "The occupancy of each living unit shall be for
adult individuals who are retired or are near retirement age. " .
11) The applicant shall meet with the Shelton School District to
discuss and resolve the School District' s concerns about impacts
to the School District by the proposed development . The
applicant shall send written notification of the resolved matter
or issues to Mason County Department of Community Development.
12) As specified in the Mason County Interim Resource Ordinance,
Sec. 17 . 01 . 080 .D. 1.a. Development Standards - Title Notification,
the applicant shall record a notice with the Mason County Auditor
stating that the proposed project is in an aquifer recharge area
and that limitations on regulated activities may exist. Proof of
this recording shall be provided to the Department of Community
Development as part of the permit approval .
RELEVANT CONSIDERATIONS :
A) Since the project site is located within the proposed urban
growth area of Shelton, the applicant shall coordinate with the
City of Shelton departments (by meeting or correspondence) to
discuss water and sewer utility services to the proposed duplex
development, if in the future the property were to be annexed
into the city limits .
