HomeMy WebLinkAbout1992/12/07 - Board of Health MASON COUNTY BOARD OF HEALTH DECEMBER 7,1992 The Board of Health was called to order at 3:45 p.m.by Chairperson Iaura E. Porter. ATTENDANCE Laura E:Porter, Chairperson William O. Hunter, Board Member Mary L.Faughender, Board Member J. Joanne Hoover, M.D.,Health Officer Brad Banner, Health Services Director Mike Clift,Deputy Prosecutor APPROVALOF MINUTES: Minutes were not approved for the November 2nd meeting at this time. ADMINISTRATION DISPUTE RESOLUTION POLICY Brad Banner, Health Services Director presented to the Board a resolution, and changed the first part of the procedure to say. "The aggrieved staff member should begin by discussing their disagreement directly with the offending staff member. The meeting will be scheduled in advance and facilitated by Betty.Wing, GHCF Director, or another staff member acceptable to both parties." See: (pg. 1-22,section 3 A) Board Member Meyer/Hunter moved and seconded to adopt the Dispute Resolution for the Mason County Health Department as written. Motion carried unanimously. P-aye; M-aye; H-aye. PERSONAL HEALTH CONSOLIDATED CONTRACT AMENDMENT(5) Brad Banner, Health Services Director presented to the Board a contract of consolidation for reimbursing DSHS for the immunization of Hepatitis B for pregnant women October and December 1992,for the total of$2,331.00. Chairperson Porter moved and seconded to amend the Consolidated Contract to include the Hepatitis vaccinations as presented by Brad Banner, Health Services Director. Motion carried unanimously. P-aye;M-aye; H-aye. YOUTH TOBACCO ACCESS BILL Dr. Hoover commented that she may be premature submitting since the items may change because State Legislature has not yet approved. The Federal "Synar Amendment" requires each State Legislature to institute the prohibition of the sale of tobacco to minors. There are penalties attached if a state does not institute something, and the State may lose drug and alcohol block grant money up to 10% a year as of 1993. Items being considered are dispensing machines, which would be more closely regulated and signs posted about age requirements. Provisions include sting operations, prohibiting the sale of single cigarettes due to label warnings,possible no tax,and free distribution. In the case of coupon redemption and free distribution, surveys found that 75% of cigarettes ended up in the hands of minors. A uniform license fee for tobacco would assist with enforcement and education across the state. MASON COUNTY BOARD OF HEALTH DECEMBER 7,1992-PAGE 3 ENVIRONMENTAL HEALTH DESIGNER LAWSUIT Mike Clift,Deputy Prosecuting Attorney for Mason County spoke to the Board regarding a lawsuit against a number of Health Districts filed 2 years ago. The suit was filed by a state licensed engineer who is also an attorney. The suit was originally filed in Thurston County under the theory that the state have exclusive rights to regulate the practice of engineering. With this suit,local Health Districts would not have the right to impose additional controls to people who design onsite sewage systems designs. As part of the lawsuit the Thurston County Judge is trying to determine what rights the people have. The Judge would also like to bring in other Health Districts that are not parties of this lawsuit, that's why we are being involved at this time. In order for us to be brought up to date on the proceedings, Yakima County has asked us to look over their work,since they have hired a private attorney. Mike Clift recommended to the Board that we consult with other public lawyers in other Counties to see if we can work with them and not do anymore research, and defend the case for us. At this time Mike Clift is going to explore what his options are, trying to keep costs to a bare minimum. The Board then asked for 24 hours notice, if a motion would need to be carried. i VARIANCES(INFORMATIONAL) Brad Banner, Health Services Director presented to the Board a problem where he was put in a position of determining who is right and who is wrong. The home owner should be the one responsible for the system,and the Health Department would be responsible for certifying installers. If problems arise the Health Department would investigate and would put the complaint in their record and when there is a pattern we would take action on their certificate. The home owner should allow the Health Department to make these decisions. Laura Porter made note that Brad's role is to carry out the authority of his department, not to resolve private disputes between contractors and members of the public.
