Porter, Board Member Martin,Goit, Silverdale Mike Clift, Deputy Prosecuting Attorney Elaine Manheimer, Belfair Brad Banner, Health Services Director URBPA, Bremerton Mike Tokos, Environmental Health Specialist Al Hoover, Belfair Gary Sexton, Attorney representing Appellants Steve Tyner, Shelton Walter Goit, Appellant Kenneth Bittner, Belfair Rich Moore, Belfair Richard Medeiros, Belfair Janestell Chrey, Bremerton Al Adams, Union Deborah Dominguez An appeal hearing of Mason County Department of Health Services (MCDHS) Woodwaste Recycling Permit Denial and MCDHS Notice and Order dated May 10, 1994, on the basis that the orders were not supported by fact or law was scheduled at 2:30 p.m. After a brief conference between the Deputy Prosecuting Attorney, Michael Clift; Gary Sexton, Attorney for Appellants; and Mike Tokos, Environmental Health Specialist, to discuss procedural issues, the following information was presented. Mr. Sexton stated that Jeffrey Hartman was unable to attend today's hearing, and that his testimony was necessary during a hearing on this matter. He noted that he discussed this matter with Mr. Tokos and he was not objectionable to a continuance. ', Mr. Sexton stated that he discussed with Mr. Clift the question of jurisdiction; whether or not it M b MASON COUNTY BOARD OF HEALTH June 27, 1994 - Page 2 of 2 was appropriate for the Board of Health to hear this matter. Mr. Clift stated that since the issue of jurisdiction in this case was just put before him, time to research the matter was necessary. He stated he concurred with Mr. Sexton that a continuance was necessary; however, it should be a short delay due to the fact that everyone recognizes that a problem exists which needs to be dealt with as quickly as possible. Chairperson Hunter advised the audience that testimony would not be taken today and that a decision on the jurisdictional question would be decided as soon as possible.
