AUTHORIZING RETROACTIVE PAYMENT FOR SPECIFIC 2023 EXEMPT EMPLOYEES
WHEREAS, RCW 36.16.070 states that ... The Board shall fix the compensation of all
employees...;
WHEREAS, WAC 296-128-545, effective July 1, 2020, establishes a salary threshold,
adjusted annually for inflation, that must be met to maintain a position's exempt status;
WHEREAS, in 2023, salaries for certain County positions classified as exempt did not
meet the salary threshold rule and should have been classified as non-exempt;
WHEREAS, it is not practical or reasonably possible to determine what overtime
earnings might have been for such positions;
NOW, THEREFORE BE IT RESOLVED, that the Board of County Commissioners does
hereby authorize payment of retroactive wages for 2023, representing the difference between
2023 salary paid and 2023 salary that would have been paid under the revised 2023 salary
threshold, as set forth below:
