WHEREAS, on March 8, 1989 the Board of Mason County Commissioners adopted Mason County Ordinance 25-88 Litter Control prescribing design and placement for' litter receptacles; prohibiting damaging litter receptacles; providing for litter removal and mandatory litter has, regulating litter control in public places, sidewalks, roads and private residences and property; regulating. the distribution of handbills; prohibiting throwing. of litter from vehicles, watercraft and aircraft; providing for litter control compliance and receptacles standards; prescribing enforcement officials and procedures; generally regulating and prohibiting litter; and providing penalties; and WHEREAS, on April 25, 1987 the Washington State Legislature amended RCW 46.52.190. And on May 11, 1987, the Governor signed Chapter 311, Section 21, repealing RCW 46.52.190; and WHEREAS, pursuant to RCW 1.12,025 the act of repealing RCW 46.52.190 supercedes the earlier amendments to RCW 46.52.190; and WHEREAS, the effect of this action is to nullify Section 5 of the Mason County Litter Control Ordinance with respect to the removal of impoundwnt procedures. NOW, THEREFORE BE IT HEREBY RES0tVED, by the Board of Mason County commissioners that the Mason County Litter Control Ordinance. 25-33, Section 5, shall be amended to reflect reliance on RCW 46.55 et seq., not.
